CITY TO TAKE A FIRST LOOK AT REVISED ETHICS CODE TUESDAY
City of Port Angeles Council meeting agenda highlight items:
Staff memo: The City’s current ethics ordinance lacks a provision that expressly addresses multiple complaints and claims against a public official based on conduct arising from a single action or event. The proposed ordinance adds a provision for guiding Council and staff through this process. The proposed ordinance also adds a defining provision for the term single action or single event. These two additions will clarify the code and provide a process for handling multiple complaints without subjecting public officials to repetitive complaints based on the same conduct or event.
Editorial note: This will be the first reading of this revised code. When passed, it will not be retroactive, the current ethic complaints filed against Kidd, Gase, and Downie. Will be under the old code.
According to staff memo from agenda packet: Summary: The City is required to make its third purchase period election with the Bonneville
Power Administration (BPA) for its Tier 2 power supply by September 30, 2016. As shown in
Figure 1, the City remains well under any Tier 2 power requirement. While the election necessity is moot, BPA’s contractual requirements must be fulfilled. Therefore, the recommended election is BPA’s Tier 2 Short-Term product for 100% of the City’s electric load that is above its High Water Mark (Tier 1) allocation, with a 10 megawatt ceiling.
Funding:
This election is for October 2019 through September 2024. In the unlikely event that any Tier 2 power would need to be purchased, the cost impact, either positive or negative, would be factored into the City’s retail electric utility rates at that time.
Recommendation: Authorize the Director of Public Works and Utilities to notify the BPA, in
accordance with Section 2.4 of Exhibit C of the BPA Power Sales Agreement, No. 00PB-12054,
the City should elect Section 2.4.1.2, the Tier 2 Short-Term rate alternative, for the period of
October 2019 through September 2024 for 100% of its above High Water Mark (Tier 1) load, with a 10 megawatt ceiling. The Utility Advisory Committee forwards a favorable recommendation for the authorization of this election.
According to the staff memo provided from the agenda packet: The proposed Cable Customer Service Standards (Standards) are applicable to all entities that provide cable services under a cable franchise in the City of Port Angeles. The Standards are intended to provide basic “rules of the road” related to the interactions between cable franchise holders and residents and users of cable service in Port Angeles.

According to staff memo: Summary: Bids were solicited for the replacement of the Civic Field lighting. Two bids were opened on April 26, 2016. The lowest responsible bidder with base and an additive bid, in the amount of $562,292.48, including tax, was Colvico, Inc. of Spokane, Washington.
Funding: Total funding from grants received will be in the amount of $407,700. Other funds
contributed by the City and the School District total $155,000, giving us a grand total of $562,700.
Recommendation: (1) Award and authorize the City Manager to sign a contract with Colvico,
Inc. in the amount of $562,292.48, including tax, for the replacement of the athletic field lighting at Civic Field and; (2) Allow the City Manager to sign the Amendment to the grant Agreement through the Washington State Recreation Conversation Office (RCO), and make minor modifications to the agreement, if necessary
Editorial Notebook: With a proposed minor league baseball club thinking in coming to Port Angeles, I would think more would be needed done than just replacing stadium lights at this point.

TO SOME, I'M A ROYAL PAIN IN THE BUTT...NOW IT'S OFFICIAL..GOT THE SHINGLES
This week's first news commentary, isn't about local politics, or the continuing three ring ethical circus. This story hits close to home. For a month or two, maybe more I been experiencing these cramps along my lower back, and stomach area. I was trying to handle it on my own, taking aspirin and whatever I had on hand at home. Lately, my rear end started to feel really painful so much that it was getting more difficult to sit up in my wheelchair for long hours. When attending those governmental meetings I attend to catch what was going on, maybe get a interview with one of these elected officials who supposedly represent all of us, not just be available to those who voted them in office. I been feeling an unbearable amount of pain on my rump, and itching! So I put aside my pride and went to the doctor to see what's going on. Come to find out, I got the Shingles! No wonder I was having troubles even moving, or laying down in bed, which I find myself doing these past few days.
I imagine their are those who would say I'm a big pain in the back side at times, I guess they now can say that with some level of accuracy. Oh, I'll do my best to share with you news and information as always, plus still plan to do video clips when feeling up to doing it.
So, today I want to share with you some information about The Shingles which many who get it suffer real pain. It also leaving you feel weak, and out of energy. Though I may not be really feeling a 100% I'll do my best to continue to provide you a worthy news source.

Shingles has a long recorded history, although historical accounts fail to distinguish the blistering caused by VZV and those caused by smallpox,[27] ergotism, and erysipelas. THINK TWICE BEFORE CASTING THE FIRST STONE.
The bible teaches us about Jesus being confronted by some jealous religious leaders when He walk among us. Who brought Him a woman caught in the act of adultery. The bible tells the tale quite clear in John 8: 2-11
2 Now early in the morning He came again into the temple, and all the people came to Him; and He sat down and taught them. 3 Then the scribes and Pharisees brought to Him a woman caught in adultery. And when they had set her in the midst, 4 they said to Him, “Teacher, this woman was caught in adultery, in the very act. 5 Now Moses, in the law, commanded us that such should be stoned. But what do You say?” 6 This they said, testing Him, that they might have something of which to accuse Him. But Jesus stooped down and wrote on the ground with His finger, as though He did not hear. 7 So when they continued asking Him, He raised Himself up and said to them, “He who is without sin among you, let him throw a stone at her first.” 8 And again He stooped down and wrote on the ground. 9 Then those who heard it, being convicted by their conscience, went out one by one, beginning with the oldest even to the last. And Jesus was left alone, and the woman standing in the midst. 10 When Jesus had raised Himself up and saw no one but the woman, He said to her, “Woman, where are those accusers of yours? Has no one condemned you?” 11 She said, “No one, Lord.” And Jesus said to her, “Neither do I condemn you; go and sin no more.” John 8: 1-11 NKJV...
The reason why I used this biblical story was to point out that many who attended that fateful meeting on Feb. 2nd were all behaving poorly at some point. I still say that entire meeting should be declared null and void, and have them do that agenda they had all over. Of course I don't expect that would happen. This passage of scripture, clearly illiterates how people who are so willing to cast the stone against wrong doers, never consider their own conducts in the process.
Though Kidd was found by the ethics board of misconduct, who will be able to toss the first stone of admonishment without being hypercritical themselves? According to the code on admonishing, that task is for the mayor to do, or his designate. So, I don't think Downie will be able to do it because like I said before he himself is on the ethic hook. There maybe two other council members who could do it without sounding hypercritical, as I said before. The third option if no other council members who can feel they can admonish Kidd without sounding hypercritical. The admonishment must be done, regardless. If they didn't the whole city council would be saying that you can get away with acts of misconduct. Making the code of ethics null and void.
But, before anyone starts casting stones we all should look at our behaviors as well during that meeting on Feb. 2.

An admonition shall be a verbal statement approved by the City Council and made to the individual by the Mayor, or his or her designee, or if the complaint is against the Mayor, the Deputy Mayor, or his or her designee. Applying christian virtues in dealing with the public
1) You have to take a lot of guff from people at times because of your beliefs, and stands on issues.
2) You have to be able to forgive others who insult and slander you.
3) You have to love your foes, and pray for them when they abuse you, and be gracious to those who you disagree with.
4) refrain from using trash talk, even when they use it on you.

COUNTY COMMISSION AGENDA HIGHLIGHT ITEM: The Prosecuting Attorney's Office has requested a 30-minute executive session with the Board of County
Commissioners, the Administrator, the Human Resources/Risk Department Director, and the Director of the Department of Community Development. The purpose of the session is to discuss with legal counsel representing the agency matters of pending litigation (Dungeness Heights Homeowners v. Radio Pacific 16-2-00226-1), which the agency, the governing body, or a member acting in an official capacity, is a party.
Discussing such matters in executive session is appropriate because public knowledge of the discussion would reveal the County's legal strategies and likely result in an adverse legal or financial consequence to the agency. RCW 42.30.110(1)(i) expressly authorizes a governing body to convene an executive session for the above-described purposes.
The Board of Commissioners may recess from this executive session and reconvene in open session in order to take action in connection with one or more administrative and/or substantive matters related to the above-referenced litigation. Thereafter, the Board may reconvene in executive session based upon the statutory authority set forth above in order to conclude its discussion with legal counsel.

COUNTY COMMISSION AGENDA HIGHLIGHT ITEM: The Prosecuting Attorney's Office has requested a 30-minute executive session with the Board of County
Commissioners, the Administrator, the Human Resources/Risk Department Director, and the Director of the Department of Community Development. The purpose of the session is to discuss with legal counsel representing the agency matters of pending litigation (Dungeness Heights Homeowners v. Radio Pacific 16-2-00226-1), which the agency, the governing body, or a member acting in an official capacity, is a party.
Discussing such matters in executive session is appropriate because public knowledge of the discussion would reveal the County's legal strategies and likely result in an adverse legal or financial consequence to the agency. RCW 42.30.110(1)(i) expressly authorizes a governing body to convene an executive session for the above-described purposes.
The Board of Commissioners may recess from this executive session and reconvene in open session in order to take action in connection with one or more administrative and/or substantive matters related to the above-referenced litigation. Thereafter, the Board may reconvene in executive session based upon the statutory authority set forth above in order to conclude its discussion with legal counsel.

WHETHAM EXPRESSES HIS CONCERNS MESSAGE NOT BEEN HEARD...
THAT HE SUPPORTS ELWHA, AND PAPA. BUT DECLINES INTERVIEW WITH THE RIPLEY REPORT.

Perhaps it was out of wanting to get even or pay back for all those negative articles I wrote about Councilman Whetham in the past that made Whetham decline my olive branch to conduct an interview with me on some of these issues that he had some concerns with. I was willing to cut some slack with the guy, and offer an olive branch by doing an interview so he could express his concerns over some key issues.
Now during the city council meeting on Tuesday, during the discussion regarding the lease agreement with PAPA to lease out the second floor of the old fire hall on South Lincoln in a 5-1 vote. Whetham voted against the lease because he expressed concerns that the issue of PAPA's lease agreement wasn't vetted through a public hearing process. He said during the debate he would like to see all groups who may want to lease out the property be given a chance to be heard. He wanted in his words to get the best deal for the community. He also the same method of agreeing to a lease agreement with the Lower Elwha Tribe hadn't been vetted by a public hearing for the Carnegie library, which is next door to the old fire station. Saying though he supports both the Elwha and PAPA leases, he didn't support how the process of those leases were made. He said during the meeting that he would like to see the Real Estate committee be an open forum, rather a closed one. Councilman Dan Gase, mention that all parties who were interested in the leases were shown the properties, and vetted through the Real Estate Committee. He didn't understand Whetham's concerns over the process issues.
Whetham, wasn't the only one expressing concerns over the vetting process, Councilman Mike Merideth, agreed that the leases should go through a public hearing and other groups needed time to chime in, but, he voted in favor of the lease with PAPA.
One point during the debate, Whetham expressed his concerns that the "word" wasn't getting out that he supports both groups, and was willing to vote for the leases if they first had a chance to hear from other groups who maybe interested. Because of that he voted against the two leases. Not because as he put it, he didn't want to sound like a hypocrite. After they voted on the issue 5-1 Whetham, voting against, and after they completed the meeting
I approached Whethm and asked for an interview, he declined...So much for my olive branch.

According to staff memo provided: Summary: On December 4, 2015 the City received a proposal from Peninsula Area Public Access for the lease of 215 South Lincoln (Old Fire Hall Building).
Funding: The lease of the facility would have no cost implications for the City of Port
Angeles. The City will benefit by having occupancy of the building which results in no
further decline or devaluation of this important historic property.
Recommendation: Approve and authorize the City Manager to sign the Lease Agreement
and authorize the City Manager to make minor modifications as necessary
Action: Lease agreement passed by a 5-1 vote, Councilman Lee Whetham voting against, on the grounds that the process hasn't been vetted by the public, or a public hearing on the issue hadn't been done.

City agenda item: Customer Service Standards Applicable to Cable Television Franchises
According to staff memo: The proposed Cable Customer Service Standards (Standards) are applicable to all entities that provide cable services under a cable franchise in the City of Port Angeles. The Standards are intended to provide basic “rules of the road” related to the interactions between cable franchise holders and residents and users of cable service in Port Angeles.
Action taken: Tabled until PAPA as an opportunity to comment on the proposal, it was suggested by council member Sisi Bruch to hold off in making any decisions on the matter until all cable providers had a say in the matter, she made the motion to postpone, Whetham 2nd the motion.
City agenda Item: Ethics Board (1) Recommendation
according to staff memo: On February 4, 2016, a complaint was filed against Deputy Mayor
Cherie Kidd alleging she had violated the City’s Code of Ethical Conduct as outlined in Chapter
2.78 of the Port Angeles Municipal Code. On February 16, 2016, Council chose three members
from a pre-approved pool of applicants to receive, investigate and make recommendations for
disposition of the complaint. Board (1) has completed its review and forwarded its findings and
recommendation to Council. In accordance with PAMC 2.78.080, the recommendation of the
Board of Ethics shall be subject to review by the City Council.
Action taken: Postpone action until legal issues are resolved.

CITY TO HOLD FINAL PUBLIC HEARING ON OMC PETITION
City Council agenda Item: STREET VACATION PETITION – STV 16-01 A PORTION OF COLUMBIA STREET WEST OF CHAMBERS STREET.
According to staff memo provided:
The petition proposes the vacation of a 70 foot right-of-way a distance of approximately
200 feet. The Real Estate Committee has recommended a price of $15.00 per square foot, or
approximately $140,000.00 for the entire proposed vacation area. The assessed per square foot
land value of the surrounding properties within a 300 foot buffer is $7.54, with the omission of
11 of the total 28 properties due to their public ownership. On May 5, 2015, Council approved a
similar street vacation for the Olympic Medical Center at a price of $15.00 per square foot.
Conditions 3 and 5 within the ordinance have been clarified based on Council inquiries.
The Planning Commission conducted a public hearing on this matter on March 23, 2016,
and forwarded a recommendation of approval for the vacation by a vote of 7 – 0. There were no concerns raised by the Commission, or the public, at the meeting.
