Indian Affairs Committee Passes Bipartisan Cantwell, Murray Legislation to Repeal Outdated 1834 Ban on Distilleries on Tribal Land.

Washington, D.C. – Today, the Senate Committee on Indian Affairs unanimously passed bipartisan legislation introduced by U.S. Senators Maria Cantwell (D-WA), a current member and former Chairwoman of the Senate Indian Affairs Committee, and Patty Murray (D-WA) to repeal an outdated 1834 law that prohibits Native American Tribes from building and operating distilleries on their Tribal lands.
“Tribes in Washington, like the Chehalis Tribe, are moving forward with plans for a distillery to participate in the burgeoning craft liquor industry,” Senator Cantwell said. “There’s no place for this law that discriminates against our Native American communities and limits their economic opportunities.”
“We should be doing more to empower entrepreneurship for tribal nations, and repealing this nearly 200-year-old law is a great step forward,” Senator Murray said. “I urge my Senate colleagues to take this bill up immediately to allow the Chehalis Tribe and others to break ground on new and exciting projects that spur economic development.”
Washington state’s Confederated Tribes of the Chehalis Tribe Reservation established plans to build a brewery with an attached restaurant and distillery on Tribal lands in Grand Mound, WA. However, the Bureau of Indian Affairs warned the Tribe that the pre-Civil War law prohibited distilleries on Indian lands and that it would be unable to approve documents necessary for the Tribe to operate it. The 1834 law currently directs to Bureau of Indian Affairs to “destroy and break up” any distillery on Indian land. As a result, the Tribe chose to not begin construction of the facility until the issue is resolved.

It will allow the Chehalis Tribe to pursue its economic development efforts that have proven beneficial, not only to the Tribe and its members, but also to the surrounding non-Indian community. Congress has recently undertaken efforts to repeal many of the antiquated and paternalistic laws that impair development in Indian country and this legislation advances those efforts,” said Chehalis Tribe Chairman Harry Pickernell Sr. when Cantwell and Murray introduced their legislation in June.
The legislation introduced by Senators Cantwell and Murray is also sponsored by U.S. Senator Jerry Moran (R-KS), a member of the Senate Indian Affairs Committee.
U.S. Representatives Jaime Herrera Beutler (R-WA), Derek Kilmer (D-WA), Don Young (R-AK), Denny Heck (D-WA), Tom Cole (R-OK), and Betty McCollum (D-MN) passed identical legislation through the House of Representatives earlier this month.

WASHINGTON, D.C. – Today, the Senate passed bipartisan legislation sponsored by U.S. Senator Maria Cantwell (D-WA), the top Democrat on the Senate aviation subcommittee, to reauthorize the Federal Aviation Administration (FAA).
The Cantwell legislation fully funds contract air traffic control towers, which will help Walla Walla Regional Airport pay for its air traffic control tower under contract with the FAA. The bill also reforms the FAA’s Contract Tower Cost Share Program, which will save Walla Walla Regional Airport roughly $100,000 per year.
“Regional airports are a critical economic driver for communities throughout Washington state,” Senator Cantwell said. “From Walla Walla to Bellingham, ensuring these communities have thriving airports helps grow small businesses and create new jobs.”
Under the current Contract Tower Cost Share Program, airports that contract out their air traffic control must pay a portion of the operating costs to run their towers
Cantwell’s provision will provide an exemption to all airports under the Cost Share Program that have at least 25,000 annual passenger boardings, including Walla Walla Regional Airport. Without the Cantwell provision, the airport would be forced to pay more than $90,000 in operating costs.
Contract towers provide a critical and cost-effective layer of safety at smaller airports. In addition to the reforms to the cost sharing program, the full funding provided in this bill will help keep contract towers operating at airports in Spokane (Felts Field), Yakima, Tacoma Narrows, Olympia, Bellingham, and Renton.

WASHINGTON, D.C. – Today, the Senate passed bipartisan legislation sponsored by U.S. Senator Maria Cantwell (D-WA), the top Democrat on the Senate aviation subcommittee, to reauthorize the Federal Aviation Administration (FAA) for five years, sending a number of important wins for consumers to President Trump’s desk.
As security wait times at busy airports around the country increase, the legislation will help get more bomb-sniffing canines into airports to reduce TSA checkpoint lines and enhance security. With the changes, airports will be able to purchase and train these canines through accredited third-party security programs. Once certified by the TSA, these dogs can be used to screen passengers, increasing security while reducing wait times.
Over the past few years, Cantwell has worked with Seattle-Tacoma International Airport (Sea-Tac) to get the airport more bomb-sniffing dogs, which help reduce security wait times by nearly half while improving passenger safety.
“In the Northwest, we’ve seen that canines can do unbelievable things to help us speed up the passenger screening process,” Cantwell continued. “We’re so happy this legislation helps us train more canines.”
The bill also contains a number of important new protections for airplane passengers to address common complaints and concerns. The pro-consumer provisions include:
Refunds of fees – Requires airlines to promptly refund fees to travelers for services purchased but not provided.
Passengers with Disabilities Bill of Rights – Establishes a bill of rights for passengers with disabilities to ensure everyone has equal access to travel.
Involuntary bumping reforms – Prohibits airlines from involuntarily removing passengers who have already boarded, except for safety, security, and health reasons.
Seat and leg room standards – Directs the FAA to set standards for minimum seat size and leg room.
“We’re trying to improve the flying experience,” Senator Cantwell said. “More people are flying than ever, and airplanes and airports are becoming more cramped and chaotic. This bill raises the bar to make sure that the traveling public is treated with dignity and respect.”

Cantwell Bill to Modernize Firefighting Technology Passes Committee

Washington, D.C. — Today, at a business meeting of the Senate Energy and Natural Resources Committee, U.S. Senator Maria Cantwell (D-WA) – the committee’s top Democrat – secured passage of her bipartisan Wildfire Management Technology Advancement Act. The bill passed through committee unanimously.
The bill, co-sponsored by Senator Cory Gardner (R-CO), increases the use of technology to keep firefighters and communities safe, better reduce the risks from wildfires, and increase the effectiveness of wildfire response.
“We owe it to the brave men and women who risk their lives to fight wildfires to equip them with the best available technology, to keep them safe, and to ensure their efforts are effective,” said Senator Cantwell in her opening statement before the Senate Energy and Natural Resources Committee.
Included in the bill are measures to increase firefighter safety by providing crews on wildfires with GPS locators and using Unmanned Aircraft Systems to scout out and map wildfires in real-time. Wildfire Today refers to the simultaneous use of mapping aircraft and GPS locators as the ‘Holy Grail’ of firefighter safety. The bill also helps protect families and communities by assisting with smoke forecasting and planning for the impacts of smoke from wildfires.
The bill also increases collaboration across government agencies to better strategically plan and stage resources before wildfires occur. Specifically, the bill directs the Department of the Interior and the Forest Service to work with NASA’s Jet Propulsion Lab and U.S. National Labs, such as the Pacific Northwest National Laboratory in Richland, to better predict the areas most likely to experience large wildfires during fire season, enhancing our ability to plan.
This legislation also takes aim at preventing erosion and landslides that can occur after wildfires by authorizing disaster agencies to make use of NASA’s tools to speed-up the installation of post-fire, erosion-prevention measures, such as the seeding of recently-burnt areas.
In addition to the use of advanced technology, the Wildfire Management Technology Advancement Act requires that trends in firefighter injuries be analyzed in order to target training to prevent future injuries and fatalities.
Earlier this year, Senator Cantwell led a bipartisan, bicameral group of lawmakers to enact the largest package of forestry and wildfire legislation in 15 years. Cantwell’s bill established a contingency account for funding the fighting of wildfires in bad years and helped secure over $2 billion in yearly funding for the account for each of the next 10 years. The funding will allow the Forest Service to end its practice of borrowing funds to fight wildfires from much-needed restoration work, freeing up over $100 million for fire risk projects, including thinning.

WASHINGTON, D.C. – Today, Ranking Member of the Senate Energy and Natural Resources Committee Maria Cantwell (D-WA) secured a major win for outdoor recreation and conservation efforts across the country by passing her Land and Water Conservation Fund (LWCF) legislation out of committee. S.569, which would fully fund and reauthorize this landmark conservation program, passed 16-7 and now heads to the Senate floor.
"Since it was enacted 54 years ago, the Land and Water Conservation Fund has helped protect many of the nation’s most popular national parks, forests, and public lands. It has provided millions of Americans the opportunity to hunt, fish, hike, vacation and enjoy the beauty of nature and our great American landscapes,” said Senator Cantwell. "It has pumped billions of dollars into the outdoor economy and provided millions of good jobs."

The Land and Water Conservation Fund expired on September 30th, marking the second time in three years that Congress failed to reauthorize and fund the program. Senator Cantwell’s legislation will for the first time ensure dedicated, mandatory annual funding for the LWCF at its $900 million authorized level so the program will no longer be subject to appropriation.

The Land and Water Conservation Fund is a key component of the nation’s robust outdoor recreation economy, which generates over $887 billion in annual consumer spending and supports 7.6 million American jobs. In Washington State alone, the outdoor recreation economy contributes over $26 billion in consumer spending and supports over 200,000 direct jobs.
Popular recreation sites such as Olympic National Park, Lake Chelan and Riverside State Park have been preserved through the LWCF. Washingtonians have benefitted from access to trails and outdoor recreation opportunities, as well as clean air and water preservation, which would not have been possible without the LWCF.
Senator Cantwell announced last week that five Washington State projects will receive more than $2 million in funding. The grants include $500,000 to the City of Edgewood for a new park; $500,000 to Snohomish County for work at Flowing Lake Park; $500,000 to Spokane County for work at Bidwell Park; $448,000 to the City of Shoreline for creek restoration at Shoreview Park; and $300,040 to the City of North Bend and the Si View Metropolitan Park District to create a new park.

U.S. Department of Education Awards $4.9 Million Grant to University of California, Davis to Develop Free, Open Textbooks Program
To help stem the rising cost of college textbooks, the U.S. Department of Education today announced a $4.9 million grant to the University of California, Davis (UC Davis) to lead a pilot program to develop free, open textbooks in targeted subjects.
Under the Open Textbooks Pilot Program, funded by Congress in the FY 2018 omnibus spending bill, UC Davis will head a consortium of 12 campuses that will begin by creating open textbooks focused on high-enrollment courses like chemistry, as well as career-technical education (CTE) fields. Technical textbooks are among the more expensive books that students must purchase, as they often must be updated frequently to keep pace with changing technologies.

WASHINGTON—The federal depository institutions regulators and the U.S. Department of the Treasury’s Financial Crimes Enforcement Network (FinCEN) today issued a statement to address instances in which certain banks and credit unions may decide to enter into collaborative arrangements to share resources to manage their Bank Secrecy Act (BSA) and anti-money laundering (AML) obligations more efficiently and effectively. Collaborative arrangements as described in the statement generally are most suitable for financial institutions with a community focus, less complex operations, and lower-risk profiles for money laundering or terrorist financing. The statement, which was issued by the Board of Governors of the Federal Reserve System, the Federal Deposit Insurance Corporation, FinCEN, the National Credit Union Administration, and the Office of the Comptroller of the Currency, explains how these institutions can share BSA/AML resources in order to better protect against illicit finance risks, which can in turn also reduce costs. Calendar year 2018 marks the highest number of Hizballah-related designations by OFAC in a single year. The designation of al-Amin and his companies builds upon additional actions taken in February 2018 targeting the Tabaja network operating in West Africa and Lebanon. OFAC designated Tabaja on June 6, 2015, for acting for or on behalf of Hizballah. Tabaja maintains direct ties to senior Hizballah officials and Hizballah’s operational component, the Islamic Jihad, which is responsible for planning, coordinating, and executing Hizballah’s terrorist attacks worldwide. Tabaja also holds properties in Lebanon on behalf of Hizballah.
All property and interests in property of those persons designated today that are subject to U.S. jurisdiction are now blocked, and U.S. persons are generally prohibited from engaging in transactions with them.

Making America More Competitive
The Compete for the Future Act empowers the Department of Education, with the advice of the Department of Labor to run a prize competition that would award eligible youth and pre-apprenticeship programs with money to expand their programs and serve more students. In order to be eligible for award money, qualifying programs must have a track record of successfully placing students in apprenticeships or helping high school students earn an industry-recognized credential. The programs must also have a formal partnership with an industry partner, and incorporate training and curriculum based on industry standards.
“More than 3 million workers will be needed in the infrastructure industry alone in the next decade,” Thompson said. “Youth and pre-apprenticeship programs offer students the opportunity to learn the skills-based education needed to fill in-demand jobs throughout the Nation. The Compete for Future Act of 2018 strives to invest in our youth to ensure our American workforce is well-trained and highly skilled in order to not only compete with the rest of the world, but lead the way.”
Eligible programs would receive favor if they are located near or in Economic Opportunity Zones. The Economic Opportunity Zone program creates tax incentives for new investments in economically-distressed communities.
“As I travel across Wisconsin, I hear from students and employers alike that we need more hands-on training opportunities. I am proud to help introduce the Compete for the Future Act, which will invest in the next generation of Wisconsin workers by bolstering industry partnerships and bring real-world experience right to our students and apprentices,” Kind said. “I am also happy to see that Opportunity Zones, which were based on my bipartisan bill, the Investing in Opportunity Act, will be given priority in this competition program. The prize competition in The Compete for the Future Act is modeled after the successful prize competitions carried out under the 2010 America COMPETES Reauthorization Act, which added Prize Competitions to the Stevenson-Wydler Technology Innovation Act of 1980. Between 2010 and 2015, the government ran more than 450 challenges and awarded more than $150 million in awards on topics ranging from finding a better way to detect salmonella in foods, to creating solar-powered water purification systems.
Throughout history, prize competitions have spurred innovation. In 1714, after a lack of accurate navigational devices led to disasters at sea, the British parliament commissioned a prize competition to develop a tool that would allow sailors to pinpoint their exact longitude. Kilmer Invites Vietnam Veterans, Community to Pinning Ceremony on October 7th in Ocean Shores.

The pinning program was established by the Secretary of Defense after it received a 2007 directive from Congress to establish an official commemoration of the 50th Anniversary of the Vietnam War. Kilmer’s office received assistance connecting with area veterans and organizing the event from the City of Ocean Shores and members of the city council.
Community members are welcome and encouraged to attend and show their support for their friends and neighbors who served in Vietnam.

The Port owns and operates a cofferdam/barging facility located east of Terminal 5 in the Port operated log yard. This facility was constructed by Kiewit-General in 2004, as part of the Washington State Department of Transportation (WSDOT) Graving
Dock Project. The cofferdam became a Port owned improvement following the execution of the Settlement Agreement between the Port, City, LEKT and WSDOT in August of 2006.
The permit for the temporary structure was transferred to the port in 2008 and the Port obtained a permanent structure permit in 2010. Recently, the Port has been using the facility as a means to transload logs to and from barges to the uplands.
The cofferdam/barging facility consists of a series of thirty (30) 24” steel piles driven in a rectangular formation, approximately 530 LF of steel interlocking sheet pile, below grade soil tiebacks and a double channel waler running horizontally along the outside / harbor side of the sheet pile.
