Task force brings law enforcement, prosecutors, retailers together to combat growing problem


SEATTLE — Attorney General Bob Ferguson announced today the creation of a statewide Organized Retail Crime Theft Task Force. The Task Force will improve coordination and collaboration among law enforcement agencies to address these multi-jurisdictional crimes that endanger employees and cause significant economic harm to our state.


The task force will focus on sophisticated, organized crime rings that account for almost $70 billion in retail losses across the country.


The Task Force is the first of its kind in Washington. Nine other states have a task force dedicated to organized retail crime.


An analysis from the Retail Industry Leaders Association estimates Washington retailers lost $2.7 billion to organized retail crime in 2021. Federal crime statistics show that the value of items stolen from Washington retailers increased by 151 percent from 2019 to 2020.


The first Task Force meeting will be held on Thursday, July 7. The Attorney General has committed to convening quarterly meetings for at least a year.


“Coordination is key to combatting this growing, and sometimes dangerous problem,” Ferguson said. “These organized crimes cross jurisdictions and cause significant economic harm. I’m committed to working together with law enforcement and retail partners to put help combat this significant and growing problem.”


Organized Retail Crime involves a group of individuals that steal products not for their own personal use, but to resell them for a profit. This do not include general retail crimes like petty theft, shoplifting or poverty-driven crimes.


According to the Department of Homeland Security, the thefts that the task force will focus on are often perpetrated by sophisticated criminal organizations, and can involve threats to store staff and the public.


Often, but not always, these stolen goods are then sold on online marketplaces.


Organized retail crime differs from burglary and larceny — such as shoplifting — in that it is not the result of a single individual breaking the law, but rather part of an organized scheme to defraud retailers or to steal products for resale elsewhere. Organized crime can result in intimidation and violence for employees in those stores.


Organized retail crimes impacting Washington

Recent headlines provide examples of organized retail crimes impacting Washington businesses and consumers.


Even before the recent, well-publicized national shortage, baby formula accounted for 13 percent of the most-stolen items from stores, according to the 2020 National Retail Foundation Organized Retail Crime survey. The stolen formula then can appear for sale on online marketplaces.


Parents who buy stolen formula on the secondary market may be putting their babies at significant risk if the thieves failed to store it at the appropriate temperature. Additionally, thieves may have manipulated the packaging, such as changing expiration dates.


Washington’s legal cannabis retailers provide another example. The state Liquor and Cannabis Board has reported more than marijuana retail store robberies through the first three months of this year.


These incidents can be dangerous and traumatic for employees. For example, in March, a suspect took an employee hostage before being fatally shot by the store’s security guard.


At a robbery in Bellevue, police pursued three suspects into a south Seattle neighborhood. Two suspects surrendered, but the third engaged in a standoff with police before opening fire and ultimately being killed by officers.


The task force will bring together prosecutors and retailers from across the state with local, state and federal law enforcement representatives, including the FBI and U.S. Attorneys Nick Brown and Vanessa Waldref. The Task Force will also include the Port of Seattle, small business representatives and workers’ representatives.

Have you seen them? Meet your new Japanese beetle trappers.--WSDA

If you live in the Grandview area, you have likely seen Washington State Department of Agriculture team members in bright yellow and orange vests around town. Why Grandview? Who are they? What are they doing?

Why Grandview?

A few years ago, WSDA discovered an infestation of Japanese beetle in Grandview and the surrounding areas. That was alarming, because the ramifications to local yards, as well as the implications on agriculture, could be devastating. So, we buckled down and got to work. It started with determining where exactly the infestation was. Our teams went out and set traps to see where the beetles had set up camp.

The team determined the infestation was inside a 49-square-mile grid, in Yakima and Benton counties, centered on the City of Grandview.

This year, we’ve expanded the efforts to include treating properties with the most concentrated area of Japanese beetles, setting traps for the pest, and working on establishing a proposed quarantine to limit the spread of the Japanese beetle population beyond the identified infestation area. Part of that effort included hiring several new trappers to increase the grid we are keeping an eye on.

Who are they?

Amanda

The team’s supervisor, Amanda was born and raised in the Grandview area. She is looking forward to serving the community in which she lives, and helping save agriculture by ridding the area of this invasive pest.

Gabe

Originally from Florida, Gabe has lived in Washington state for about a year. He was drawn to WSDA and being part of the Japanese beetle eradication efforts because of the ability to benefit the community of Grandview.

Drew

Originally from Oregon, Drew and his family moved to Yakima. He was looking for a summer job while he looks for a job in his field of study, medical sciences. He loves being outside and is looking forward to the summer of Japanese beetle trapping.

Fernando

Fernando knows the importance of agriculture in Washington state. Growing up in the Yakima Valley, Fernando’s father owns a cherry orchard, and he has seen firsthand the type of damage a pest can do. He’s looking forward to being part of the effort to rid the area of this invasive pest.

Brenda

Brenda is looking forward to being part of the eradication and survey effort. She is excited to be part of the effort and to see the beetles firsthand. 

What are they doing?

The Japanese beetle trappers will be going around to each set trap during the “adult flight season” between May and October, checking for catches and recording their findings. There will be more than 2,500 traps set in the area, and each trap will be checked every 10-14 days. If you see the friendly, smiling face of someone wearing a bright yellow vest, please wave, and know they are working hard to get rid of this pest to protect our lawns, roses, and especially, our agriculture.

OLYMPIA — Attorney General Bob Ferguson today announced that his lawfully owed DNA project identified 387 sex, kidnapping and homicide offenders still living in Washington who illegally failed to provide DNA samples after their criminal conviction. Of these 387 individuals, the Attorney General’s Office already collected 102 new DNA profiles, including:


5 new DNA profiles from individuals convicted of homicide;

10 new DNA profiles from individuals convicted of kidnapping; and

88 new DNA profiles from convicted sex offenders. (The previous phase of this project collected DNA profiles from registered sex offenders. This phase focused on sex offenders who are not required to register.)

All 102 new profiles were added to CODIS, the national DNA database.


Cleaning up for affordable housing on Bellingham Bay.

Once contaminated by decades of use as storage for a paper mill byproduct called lignin, four acres of downtown Bellingham will soon be cleaned up and redeveloped into affordable housing, thanks to a partnership between us, the Port of Bellingham, and Mercy Housing Northwest.



Washington’s 2021 average annual wage increase: second largest on record

OLYMPIA – Washington’s average annual wage grew by 7.5% in 2021 to $82,508, according to the state Employment Security Department. The strong demand for workers and hiring difficulties across different sectors drove average wage growth in 2021 to the second largest increase on record.

Attorney General’s Office shuts down US Stemology’s deceptive marketing, including claims that stem cell injections could treat COVID-19


SEATTLE — Attorney General Bob Ferguson today announced that, as a result of his lawsuit against the company, Seattle-based US Stemology and its owner, Dr. Tami Meraglia, cannot advertise, market or receive any payment for unproven stem cell treatments. US Stemology must also pay $500,000 to the Attorney General’s Office, which will be used to provide restitution for those who paid for stem cell procedures. 107 individuals paid for the procedures and are eligible for restitution.


In March, Ferguson filed a lawsuit against the company, asserting it claimed in its marketing that stem cell injections could treat COVID-19 and dozens of other serious medical conditions, including asthma, lupus, Parkinson’s disease, congestive heart failure and multiple sclerosis. There is no reliable clinical evidence stem cell therapy can effectively treat these conditions.


After the Attorney General’s Office began its investigation, US Stemology stopped performing stem procedures in June 2021, and has not performed any procedures since.


Some people paid up to $10,000 for the unproven treatments. Due to medical privacy laws, the Attorney General’s Office cannot obtain information about US Stemology’s clients unless those clients provide a waiver. All 107 people eligible for restitution will receive a letter from US Stemology in the mail in the next two months, which asks them to provide some information to the Attorney General’s Office for the purpose of providing the refunds. Individuals must complete this form to receive their refund.


“Dr. Meraglia and US Stemology advertised stem cells as a life-changing miracle cure that could treat almost anything — even COVID,” Ferguson said. “They preyed on people’s fears and frustrations about their health to sell hundreds of thousands of dollars in unproven treatments. Our work put a stop to US Stemology’s modern day snake-oil scheme.”


Under the consent decree, filed in King County Superior Court, the company must pay $500,000 to the Attorney General’s Office, which will be used as restitution for those who paid for Dr. Meraglia’s stem cell treatments. The company must pay $300,000 in suspended penalties if they violate the terms of the consent decree.


The Attorney General’s Office has independently verified that US Stemology lacks the funds to pay the full judgment amount immediately. The company is required to pay the $500,000 within 24 months, at a 6 percent interest rate. The Attorney General’s Office will provide restitution before utilizing any remainder to cover the cost of the case and future enforcement of the Consumer Protection Act.


Under the consent decree, the company also cannot claim its treatments are part of a “clinical trial” without proper FDA approval. In its marketing to consumers, the company claimed it was treating patients as part of clinical trials. In reality, the “trials” did not follow generally accepted standards of scientific research — and the researchers themselves led the “independent review” of the trials.


Details of the case


US Stemology owns the Seattle Stem Cell Center in lower Queen Anne. The Attorney General’s Office was first alerted to this case when a concerned Washingtonian reported the company’s false claims that it could treat and prevent COVID-19. The company made these claims for at least three months in the early stages of the pandemic.


For example, an ad from the company claimed that a “critically ill” COVID patient got better from stem cell treatments. In spring 2020, the company posted a downloadable “Free Coronavirus Thriving Guide,” that called stem cell treatment “your personalized ‘vaccine’ against getting sick with COVID-19.”


After the Attorney General’s Office sent a cease and desist letter, the company removed from its website the claims that stem cells are effective against COVID-19.


While looking into the consumer complaint, investigators at the Attorney General’s Office discovered that the company claimed it could treat dozens of other conditions — including serious heart, autoimmune and neurological conditions — without reliable scientific evidence that stem cell treatments are effective in treating them.


US Stemology began marketing that it could treat these conditions starting as early as 2018. Meraglia began the stem cell clinic out of the basement of the medispa she owned, which mostly performed aesthetic and cosmetic treatments at the time.


The Seattle Stem Cell Center performed its stem cell “treatments” on over 100 patients for a host of serious, chronic conditions, including asthma, muscular dystrophy, stroke, diabetes and Crohn’s disease.


The Food and Drug Administration (FDA) has only approved stem cell treatments for some blood disorders, but these procedures use a different cell type than what US Stemology used. The FDA has not approved stem cell treatments for any other condition. Health insurance plans generally do not cover stem cell treatments.


Assistant Attorneys General Daniel Davies and Logan Starr, investigators Anton Forbes and Eric Peters, paralegal Rosa Hernandez and legal assistant Michelle Paules are working on the case.
