Kilmer’s Emergency Preparedness Amendment to Protect Airports like Fairchild Cleared for Landing on President’s Desk

WASHINGTON, DC—Today the House of Representatives passed the FAA Reauthorization Act of 2018, which authorizes appropriations for the Federal Aviation Administration. The bill includes an amendment authored by Kilmer that requires the FAA to consider community emergency response needs as it determines the amount of funding an airport receives under the Airport Improvement Program (AIP). That requirement will protect regional rural airports in communities like Port Angeles, where Fairchild International Airport is a vital emergency lifeline and economic driver. Last year, the FAA considered cutting the AIP funding that Fairchild Airport receives which the airport uses to maintain its runway. Kilmer, the Washington National Guard and county and local leaders successfully worked with the FAA to prevent the cuts because it would have resulted in a shorter runway. That, in turn, would have limited the size of planes capable of taking off and landing at the airport in an emergency such as a forest fire or earthquake. The region’s residents also rely on the current runway to quickly reach advanced medical care at hospitals in Seattle and Portland.

Kilmer’s amendment will help protect future funding for Fairchild Airport and airports nationwide that serve a critical role in disaster planning by requiring the FAA to explicitly consider the emergency preparedness needs of the communities served by an airport when reviewing its AIP master plan. In addition, maintaining the current 5,000-foot runway at Fairchild will help support future economic development initiatives being considered by the Port of Port Angeles.

Other wins for the region
In addition to Kilmer’s amendment, the bill includes the following items:
A four-year reauthorization for the NTSB, which is tasked with investigating and preventing transportation incidents and accidents.
The Disaster Recovery Reform Act (DRRA), which:
Establishes investments in pre-disaster mitigation so communities can build stronger, more resilient infrastructure before disaster strikes.
Encourages resilient rebuilding as well as the enforcement and implementation of stronger building codes;
Authorizes mitigation funding after wildfires on State, local, and private lands; and
Clarifies eligibility of earthquake early warning system components for mitigation funds.
A number of policy provisions that will make air travel safer and more enjoyable.
Requires FAA to set minimum dimensions for passenger seats, including pitch and width;
Establishes a new "Aviation Consumer Advocate" position at the Department of Transportation (DOT) to help resolve consumer complaints;
Prohibits the involuntary bumping of passengers from flights after their boarding passes have been collected or scanned;
Prohibits cell phone calls and the use of e-cigarettes during flights;
Prohibits airlines from denying passengers the ability to check baby strollers at the departure gate unless there are safety or security issues;
Requires all medium and large U.S. airports to have private rooms for nursing mothers and baby changing tables in at least one restroom in each passenger terminal;
Creates a task force on eliminating sexual misconduct on commercial aircraft; and
Addresses issues faced by passengers with disabilities, including by requiring DOT to develop an "Airline Passengers with Disabilities Bill of Rights" and creates a civil penalty for damage to passengers' wheelchairs and mobility aids.

Senator Murray Champions New Provision in FAA Bill That Creates a National Task Force to Combat Sexual Assault and Harassment on Airplanes; Vows to Keep Fighting for Additional Measures to Help Survivors Seek Justice.

(Washington, D.C.)  – Today, U.S. Senator Patty Murray (D-WA) announced that the FAA Reauthorization Act of 2018 now before Congress includes a provision to establish a national task force that was inspired by her legislation, the Stopping Assault while Flying Enforcement Act, or the SAFE Act, S. 1605. The National In-Flight Sexual Misconduct Task Force will be tasked with issuing recommendations to ensure airlines are properly responding to and addressing in-flight sexual misconduct, including training, reporting, data collection, and law enforcement notification. The U.S. Department of Transportation Secretary must make changes to guidance, policies, and regulations based upon the task force’s recommendation within two and a half years. To help survivors seek justice, the Attorney General is required to develop and make public a process for individuals to report in-flight sexual misconduct to law enforcement. Senator Murray and her colleague Senator Bob Casey (D-PA) have been leading efforts in Congress to address sexual assault and harassment incidents aboard flights, calling for new requirements on training, reporting, data collection, as well as the creation of a national task force.

“Establishing a national task force is an important step forward in our efforts to start addressing sexual assault and harassment on flights,” Senator Murray said. “It makes clear that commercial flights are not law-free zones. If you sexually assault or harass another passenger or member of the flight crew, even at 35,000 feet, there must be consequences. I look forward to getting this provision signed into law, but our work doesn’t end here. I will push the Transportation Secretary to set up the task force as soon as possible and to implement the recommendations in good faith. I will also keep fighting for additional measures to ensure flight crews have the tools and training necessary to respond and to collect data on incidents so we can make even more progress helping survivors of sexual assault and harassment seek justice.”

A longtime advocate for policies to prevent sexual assault and provide justice and support to survivors, Senator Murray began looking into the problem of sexual assault and harassment on airplanes after hearing from Seattle resident Allison Dvaladze and her story of surviving an in-flight sexual assault. In 2016, Senator Murray worked with Senator Casey to urge the U.S. Department of Justice and Federal Aviation Administration to take action to strengthen airline requirements to ensure flight crews are prepared to respond to and support survivors of sexual assault when it occurs during a flight. This was followed by raising Allison’s story directly with Transportation Secretary Elaine Chao and introduction of the SAFE Act in 2017. In June Senator Murray led her colleagues in a letter to Secretary Chao urging her to establish the task force to address in-flight sexual assault and harassment as directed by Congress in the bipartisan 2018 spending deal. The importance of addressing in-flight sexual assault is underscored by the increase in the number of cases opened by the Federal Bureau of Investigation to investigate sexual assault on airplanes, jumping from 38 cases in Fiscal Year 2014 to 63 cases in Fiscal Year 2017.

"I am grateful to Senator Murray and her staff for their leadership and commitment to this issue and call on Congress to support this legislation. I appeal to the airline industry to respect the health and safety of your crew and passengers by taking urgent action to develop protocols, provide trauma-informed response training, and document and report assaults to the authorities. Additionally, I call on airlines to deter would-be assailants by stating in your in-flight messaging that you have a zero tolerance policy for assault against passengers and crew,” said Ms. Dvaladze. “It is unacceptable to put the burden of addressing these crimes on crew, who may themselves be survivors of assault, without giving them the proper tools.”

Provisions included in FAA Reauthorization Act of 2018:

Section 338: Expresses the Sense of Congress that all airlines should have policies and procedures in place to address sexual misconduct, including reporting to law enforcement; communicating the rights of employees and passengers; and training employees on responding to sexual misconduct.
Section 339: Establishes a civil penalty for sexually assaulting or the threat of sexually assaulting a member of the flight crew, cabin crew, or other individual on the airplane and increases the current civil penalty for interference from $25,000 to $35,000.
Section 339A: Requires the U.S. Department of Transportation (DOT) to establish the National In-Flight Sexual Misconduct Task Force to review current airline practices, protocols, and requirements in responding to and addressing in-flight sexual misconduct by passengers, including training, reporting, and data collection. The Task Force must review and utilize first-hand accounts from passengers who have experienced in-flight sexual misconduct. The Task Force must deliver a report to the Secretary of Transportation with recommendations on training, reporting, data collection, and law enforcement notification within 1 year of enactment. Within 180 days of receiving this report, the Secretary of Transportation must submit a plan to Congress to address the Task Force’s recommendations. Within 1 year of submitting this plan, DOT is required to make changes to guidance, policies, and regulations based upon the Task Force’s recommendations. Further, within 1 year of submitting the plan, DOT is directed to issue regulations to require all airlines to develop a policy concerning sexual misconduct based upon the Task Force’s recommendations. These provisions are based upon the SAFE Act.
Section 399B: Within 2 years of enactment, requires the Attorney General to develop and make public the process for individuals to report in-flight sexual misconduct to law enforcement based upon the Task Force’s recommendations. These provisions are based upon the SAFE Act.



Senator Murray Slams Education Secretary DeVos For Allowing States to Use Federal Funds to Purchase Guns and Firearm Training for Teachers.

During the hearing, Senator Murray also criticized Secretary DeVos for approving state plans that do not comply with provisions in the bipartisan Every Student Succeeds Act (ESSA) law to promote equity—and the negative impacts on our most vulnerable students as a result—and called on Chairman Alexander to work with her to uphold the bipartisan agreement made in ESSA to address these concerns.

Cantwell Introduces Legislation to Expand Basic Health Program to Cover More People at Lower Cost
Basic Health Program (BHP) would make more affordable health care available for more than 162,000 Washingtonians; Legislation would expand BHP eligibility, help states develop and implement new programs to cover uninsured, people struggling to afford insurance.

Sen. Cantwell Announces Over $2 Million in LWCF Grants for Outdoor Recreation Projects in Washington State.

WASHINGTON, D.C. – Today, U.S. Senator Maria Cantwell (D-WA), the top Democrat on the Senate Energy and Natural Resources Committee, announced that Washington state will receive over $2 million from the Land and Water Conservation Fund (LWCF) for five outdoor recreation projects throughout the state.

“These grants will help ensure communities throughout Washington continue to have access to local parks and outdoor recreation opportunities,” said Cantwell. “Not only will this money help make improvements and create new parks, it will also provide an economic boost for these communities by supporting local jobs and attracting new business.”

Five projects throughout Washington will receive a total of $2,248,040 in funding. The grants include $500,000 to the City of Edgewood for a new park; $500,000 to Snohomish County for work at Flowing Lake Park; $500,000 to Spokane County for work at Bidwell Park; $448,000 to the City of Shoreline for creek restoration at Shoreview Park; and $300,040 to the City of North Bend and the Si View Metropolitan Park District to create a new park.

The LWCF has supported more than 42,000 state and local projects in communities across the country since it was created through the leadership of Senator Henry “Scoop” Jackson in 1965. Without congressional reauthorization, however, the program is set to expire on September 30.

“These grants are another reminder of why it’s critical we reauthorize and permanently fund the LWCF as soon as possible,” said Cantwell.

Senator Cantwell is the leading champion of the Land and Water Conservation Fund. In March 2017, Senator Cantwell introduced bipartisan legislation with Senator Richard Burr (R-NC) to permanently authorize and fully fund the LWCF. It now has 47 cosponsors in the Senate.

The United States announced today, during the United Nations (UN) General Assembly in New York, The AMR Challenge—the most ambitious global initiative to date to combat the growing threat of antibiotic resistance (AR or AMR). This unprecedented challenge, led by the U.S Department of Health and Human Services (HHS) and Centers for Disease Control and Prevention (CDC), charges pharmaceutical and health insurance companies, food animal producers and purchasers, medical professionals, government health officials, and other leaders from around the world to work together to address antibiotic resistance by:
reducing antibiotics and resistance in the environment (e.g. in water and soil);
improving antibiotic use, including ensuring people can access these medicines when they are needed;
developing new vaccines, drugs, and diagnostic tests;

FTC and DOJ Return a Record $505 Million to Consumers Harmed by Massive Payday Lending Scheme.

The Federal Trade Commission, working jointly with the U.S. Department of Justice, is mailing 1,179,803 refund checks totaling more than $505 million to people who were deceived by a massive payday lending scheme operated by AMG Services, Inc. and Scott A. Tucker.

The consumer refunds stem from a record-setting $1.3 billion civil court judgment and order the FTC obtained against Tucker and his companies for violating the FTC Act and the Truth in Lending Act when they deceived consumers across the country and illegally charged them undisclosed and inflated fees. The order represents the largest litigated judgment ever obtained by the FTC.
In its 2012 complaint, the FTC alleged that the operators of AMG Services, Inc. falsely claimed they would charge borrowers the loan amount plus a one-time finance fee. Instead, the defendants made multiple withdrawals from consumers’ bank accounts and assessed a new finance fee with each withdrawal. As a result, consumers paid far more for the loans than they had originally agreed to pay.

In 2017, the United States Attorney’s Office for the Southern District of New York obtained criminal convictions against Tucker and his attorney, Timothy Muir. In 2018, they obtained a sentence of more than 16 years in prison for Tucker, and a penalty of $528 million against U.S. Bancorp for violations of the Bank Secrecy Act, including failing to timely report suspicious banking activities of Tucker.

The FTC and U.S. Attorney’s Office also obtained settlements in January 2015, November 2015, February 2016, and June 2018 with three Native American tribes involved in Tucker’s operation.

The FTC and Department of Justice are jointly using funds obtained in the civil and criminal matters to provide refunds to consumers who took out loans before January 2013 from the following seven loan portfolios serviced by AMG Services: 500FastCash, Advantage Cash Services, Ameriloan, OneClickCash, Star Cash Processing, UnitedCashLoans, and USFastCash.
Recipients should deposit or cash checks within 60 days, as indicated on the check.

Rust Consulting, Inc., the refund administrator for this matter, will begin mailing refund checks today. The FTC and the administrator have used the defendants’ business records from January 2008 through January 2013 to identify consumers and calculate their refund amounts, so it is not necessary for these consumers to contact the FTC to make claims. The FTC never requires consumers to pay money or provide information to cash refund checks. FTC Approves Final Consent Order in Aromaflage Insect Repellent Advertising Case.

Following a public comment period, the Federal Trade Commission has approved a final consent order settling deceptive advertising charges against Mikey & Momo, Inc. and its owners regarding the marketing of their Aromaflage sprays and candles.

According to the FTC’s complaint, the New Jersey-based company and its owners used deceptive claims to sell perfume sprays and scented candles that purportedly repelled mosquitoes carrying the Zika virus and other diseases. The FTC alleged that the company’s efficacy claims for its Aromaflage products—marketed as “fragrance with function”—are not supported by scientific evidence, and that multiple five-star Amazon reviews were written by one of the owners and her relatives.

The administrative final order settling the Commission’s charges bars the company, Michael Fensterstock, and Melissa Matarese Fensterstock from engaging in such deceptive conduct in the future. It also requires them to clearly and conspicuously disclose any material connections between a reviewer or endorser and the product being reviewed.

New employer tax credit for paid family and medical leave available for 2018 and 2019.

WASHINGTON — Today the IRS announced that eligible employers who provide paid family and medical leave to their employees may qualify for a new business credit for tax years 2018 and 2019.
In addition, eligible employers who set up qualifying paid family leave programs or amend existing programs by Dec. 31, 2018, will be eligible to claim the employer credit for paid family and medical leave, retroactive to the beginning of the employer’s 2018 tax year, for qualifying leave already provided.
In Notice 2018-71, posted today on IRS.gov, the IRS provided detailed guidance on the new credit in a question and answer format. The credit was enacted by the 2017 Tax Cuts and Jobs Act (TCJA).
The notice released today clarifies how to calculate the credit including the application of special rules and limitations. Only paid family and medical leave provided to employees whose prior-year compensation was at or below a certain amount qualify for the credit. Generally, for tax year 2018, the employee’s 2017 compensation from the employer must have been $72,000 or less.

“At the same time, Republicans on the Judiciary Committee, who were clearly able to sympathize with Judge Kavanaugh’s experiences over the past two weeks, were too scared to do their jobs for themselves and ask Dr. Ford about her experiences or pain over the past three decades. Instead, Republicans directed their hired prosecutor to interrogate and cross-examine Dr. Ford and treat her like a criminal on trial. Anyone who went through anything like what Dr. Ford went through understands how difficult it is to relive these worst moments of your life, how you wish you could remember some details that escape you, and how you can never forget those moments that have been seared into your memory.
“Judge Kavanaugh should withdraw immediately. If he won’t, then President Trump should pull his nomination. And if he won’t do that, then all eyes will turn to Senate Republicans in the hopes that just a few of them will do the right thing.
“If this nomination isn’t withdrawn, then Senate Republicans must stop this mad dash to the finish line, must allow a full investigation into the allegations of all three women who have shared their experiences so far, and must hold additional hearings with Mark Judge and all other relevant witnesses to make sure that the United States Senate has the information it needs to do its job.
“If Republican leaders continue with their plan to rush this nomination through in the coming days after seeing what we all saw this morning, and with so much that still needs to be investigated and heard, women and men across the country are going to stand up and fight back. The United States Senate failed Anita Hill and all women in 1991, and 27 years later we must do better.”

“The Obama administration proposed thoughtful electronic braking system requirements that would help keep trains from speeding off the tracks. It is incomprehensible why this administration would pursue a biased cost-benefit analysis to make a case that this safety measure is too expensive and then dismiss such a common sense measure from further consideration. I fear the day we witness a destructive or deadly derailment that could have been prevented with readily available technology.

Background
Inslee has been advocating for stronger oil train safety measures for years. He issued a directive in 2014 directing various state agencies to conduct risk analyses and develop response plans in coordination with state and provincial partners, and has worked with legislators to implement additional inspection, safety and notification requirements. Inslee met with federal officials in June 2014 following a derailment in Mosier, Oregon, and sent a letter to the U.S. Department of Transportation and wrote an op-ed in 2016 pleading with federal officials to pursue numerous actions, including phasing out outdated tank cars, requiring lower speeds in populated areas and implementing electronic braking requirements.

Inslee and Washington tribes convene for 29th Annual Centennial Accord

The Suquamish Tribe hosted this year’s Centennial Accord at the Suquamish Clearwater Casino Resort. Suquamish Tribal Chairman Leonard Forsman and Inslee opened the accord by emphasizing the importance of government-to-government collaboration and the many shared priorities of tribes and the state.

Inslee said he plans to propose significant new investments in restoring and improving culverts for fish passage and will be relying on the recommendations from his orca task force to prioritize additional investments and policy actions in the 2019 legislative session.

Inslee also spoke about his intention to pursue more expansion of broadband, saying he views it as one of the most important tools for opening up economic opportunities across Washington.  Inslee recently celebrated an effort in La Push with the Quileute Tribe to bring broadband internet to the coastal community.
“This has tremendous potential for tribal communities,” Inslee said. “We know the spirit of innovation and entrepreneurship runs deep in your tribes. Tribes and tribal-owned businesses support more than 27,000 jobs across the state, for both native and nonnative Washingtonians. Broadband can open up even more economic opportunity.”
The day’s discussions included updates on legislation to improve reporting and investigating the disappearance of Native American women, tribal traffic safety, natural resources and fisheries, social services, health care and education.

Cantwell, Law Enforcement Leaders Highlight Benefits of Senate-Passed Opioid Legislation, Needs in Washington State.

Seattle, WA – (Wednesday), U.S. Senator Maria Cantwell joined Attorney General Bob Ferguson and local law enforcement leaders to discuss the importance of major bipartisan legislation passed by the Senate on Monday to combat the ongoing opioid and heroin epidemic, and to highlight the legislation’s potential benefits for Washington state.
“We are here today to say that we are one step closer with the passage of this legislation in the United States Senate to… giving law enforcement the tools they need to help us fight this big challenge,” Senator Cantwell said.
In particular, Senator Cantwell highlighted provisions she authored in the legislation to crack down on opioid manufacturers who fail to take reasonable steps to keep their drugs off the black market.
“Current fines for failing to follow the federal law just aren’t enough,” Cantwell continued. “That is why there is a provision in this legislation to increase those civil penalties for opioid manufacturers who fail to follow the law by ten times, from $10,000 to $100,000 per violation. And it doubles the criminal liability from $250,000 to $500,000 per violation.”

Local law enforcement leaders, including King County Undersheriff Scott Somers, Pierce County Sheriff Paul Pastor, and Snohomish County Sheriff Ty Trenary, highlighted the importance of the Senate’s legislation, and Cantwell’s provisions, in helping them fight back against the opioid epidemic in their communities.
“For those AGs and counties and cities who are filing lawsuits against distributors and entities related to the opioid epidemic to hold them accountable, the bill that Senator Cantwell proposed increases dramatically the penalties for those manufacturers when they know, or have reason to know, that there is suspicious activity going on,” said Washington Attorney General Bob Ferguson. “Those penalties need to be increased, and Senator Cantwell is leading the charge in making that happen.”
“I’d like to acknowledge my gratitude to Senator Cantwell for her leadership on the Opioid Crisis Response Act, which takes a number of positive steps to support our public health response to the devastating impact that this opioid epidemic continues to have on people here in King County and across the country,” said Dr. Jeffrey Duchin, the Chief Health Officer for Public Health Seattle and King County.

The provisions proposed and supported by Senator Cantwell in the legislation would:

Crack Down on Illegal Drug Distribution:

Increases civil penalties on manufacturers and distributors of opioids that fail to report suspicious orders for opioids or fail to maintain effective controls against diversion of opioids by ten times, from $10,000 to $100,000;
Increases criminal penalties for failing to maintain effective controls against diversion of opioids from $250,000 to $500,000;
Authorizes grants to state law enforcement agencies to help locate and investigate illegal distribution of opioids, heroin, fentanyl, or carfentanil;
Authorizes $280 million for the High-Intensity Drug Trafficking Area Program (HIDTA), which provides assistance and coordination between federal, state, local, and tribal law enforcement agencies whose jurisdictions are in major drug-trafficking areas throughout the country.
Increase Funding and Resources for Opioid Treatment:

Provides permanent authority for qualified physicians to provide Medication Assisted Treatment (MAT) for up to 275 patients;
Expands the ability of health providers to use telehealth services to treat people with opioid use disorder;
Authorizes $75 million for the Drug Court Program, which has helped reduce substance abuse and criminal recidivism among non-violent offenders;
Authorizes $46 million a year to help prevent fatal overdoses and train first responders about safe practices for dealing with fentanyl and carfentanil to protect them from exposure to these deadly drugs.
Support New Research and Treatment Alternatives:

Authorizes $5 million a year to support hospitals and other acute care facilities that manage pain with alternatives to opioids;
Requires the study of the impact of federal and state laws limiting the length, quantity, or dosage of prescription opioids;
Reauthorizes the State Targeted Response (STR) grants, originally funded in the 21st Century Cares Act, which have provided more than $23 million to Washington state for opioid treatment and prevention programs.
Throughout the United States, opioid sales nearly quadrupled between 1999 and 2014, and by 2012, 259 million opioid prescriptions were being written each year. The massive surge in opioid consumption has also led to increased usage of heroin, with studies showing that nearly 75% of new heroin users become addicted by using prescription opioids.

The resulting opioid and heroin epidemic has devastated communities across the country. Since 2000, more than 300,000 Americans have died from opioid or heroin overdoses. One hundred forty-five people fatally overdose on opioids or heroin each day, and nearly 700 Washingtonians and 42,000 Americans died of an opioids overdose in 2016 alone. The epidemic also has a significant economic impact, costing the United States at least $78 billion every year.

The passage of the Opioid Crisis Response Act comes as Senator Cantwell continues her leadership in the fight against the opioid crisis. In December of 2016, Senator Cantwell supported the 21st Century Cures Act, which provided over $1 billion in new federal funds to combat the opioid epidemic, including more than $23 million in funding for Washington state over two years. In February 2018, Cantwell introduced the CARES Act, to hold opioid manufacturers accountable for misleading advertising and negligent distribution practices. Later that month, Cantwell joined a bipartisan group of colleagues to introduce CARA 2.0, a comprehensive bill to increase funding for programs providing opioid education, treatment, and recovery. Cantwell has also been a fierce defender of the Medicaid program and Washington state’s successful Medicaid expansion, which has opened up substance abuse treatment to more than 30,000 Washingtonians.
After passing the Senate Monday, the legislation now moves on to conference committee with the House of Representatives.

Washington, D.C. – Today, U.S. Senator Maria Cantwell (D-WA), the top Democrat on the Senate Energy and Natural Resources Committee, made the following statement regarding the Department of the Interior’s decision to roll back the Bureau of Land Management’s (BLM) Methane and Waste Prevention Rule. 

"Even though Congress has already rejected an attack on the Obama-era methane rule, Secretary Zinke has ignored Congressional intent and moved forward with this ill-advised scheme anyway. If this new rule is implemented, companies will be able to waste millions of dollars in taxpayer resources by releasing 180,000 tons of methane pollution per year into our air,” said Senator Cantwell. 

The 2016 Obama Methane and Waste Prevention Rule followed through on BLM’s legal responsibility to prevent the waste of valuable taxpayer resources. From 2009 to 2015 alone, 462 billion cubic feet of federal natural gas was wasted – enough to serve 6.2 million households for a year.

In addition, GAO found in 2010 that taxpayers and states lose as much as $23 million in annual royalty revenue due to wasted natural gas – and that about 40% of wasted natural gas on federal onshore leases could be economically captured with existing technology.

The 2016 rule took advantage of available technologies to rein in waste of federal natural gas supplies, reduce harmful air pollution, and provide a fair return on public resources for federal taxpayers, tribes, and states. Other benefits included:

Reducing methane emissions by about 180,000 tons per year. This is equivalent to removing about 950,000 vehicles from the roads or retiring a large coal-fired power plant.
Modernizing BLM’s almost forty-year-old methane regulations to address changing technologies and increased oil and gas development on federal lands. From 2005 to 2014 alone, the number of applications BLM received under the 1979 rule to vent or flare gas increased 2,500%.
In May 2017, Senator Cantwell led the successful effort to save the BLM Methane Waste Prevention Rule from repeal through the Congressional Review Act. "We've had an explosion of natural gas and oil production in the last ten years. Making sure we update and keep in place a rule to adequately regulate the production of this resource, while cutting down on needless waste, is critically important,” said Senator Cantwell after the Senate voted to prevent the use of a Congressional Review Act (CRA) resolution to repeal the BLM Methane and Waste Prevention Rule. “Special interests in Washington tried to override this common-sense rule, and today we stopped them in their tracks."

Despite the May 2017 Senate vote, the Trump administration has made numerous attempts to repeal the Methane Rule, prompting Senator Cantwell to lead a June 2017 letter to Secretary Zinke questioning the Department of the Interior’s decision to suspend parts BLM Methane and Waste Prevention Rule. In a July 2017 letter to President Trump, Senate Cantwell urged him to reverse dangerous decisions by his administration to suspend the BLM and EPA methane rules.

On November 2, 2017, Senator Cantwell led a bicameral group of 81 lawmakers in urging Secretary of the Interior Ryan Zinke not to suspend or unlawfully delay implementation of the BLM’s methane waste prevention rule. The lawmakers disputed the department's stated rationale for attempting to repeal the rule and requested public hearings and an extension on the public comment period regarding any changes to the rule.

Earlier this year, following the District Court of California ruling that BLM must immediately implement the 2016 Methane Waste Prevention Rule. Senator Cantwell said “Secretary Zinke and President Trump may think they are above the law, but yesterday’s ruling on the BLM methane waste prevention rule makes it crystal clear they are not. Instead of wasting more taxpayer dollars on this ill-advised crusade, the administration must immediately start implementing this rule, protecting the public from unhealthy methane pollution and saving the American people money.”

WASHINGTON, D.C. – Today, U.S. Senator Maria Cantwell (D-WA), the top Democrat on the Senate Aviation Subcommittee, announced that the Pullman-Moscow Regional Airport will receive an additional $7 million in funding for the ongoing construction of a new runway. This additional funding comes after Senator Cantwell helped secure $16 million in July of this year to begin the construction.

“Securing this additional funding is critical to getting the new runway project done and creating more economic opportunity for everyone on the Palouse,” Senator Cantwell said. “I will continue to fight for Washington’s small airports and making smart investments in infrastructure throughout the Northwest, especially in our rural communities.”

The $7 million the Pullman-Moscow Regional Airport will receive comes from the U.S. Department of Transportation’s Airport Improvement Program (AIP), which provides funding for airport development and planning. The grant will help the airport pave, flight check, and open the new runway for full service in the fall of 2019.

The impact of air service on the economy cannot be overstated. In Washington state, 97% of Gross Business Income is generated by businesses within 10 miles of an airport, and 70% by businesses within five miles of an airport.

As the former Chair and current top Democrat on the Senate Aviation Subcommittee, Senator Cantwell has been a strong advocate of federal grant money to help Pullman-Moscow Regional Airport, as well as for airport projects throughout the state of Washington. Earlier this year, Cantwell helped secure $10 million to help fund the ongoing realignment project of the existing runway at the airport. In 2017, she secured $5.2 million for Pullman-Moscow to begin the runway realignment project.

Since 2014, Senator Cantwell has helped secure more than $50 million in funding for airport improvements in the state. And in March 2018, she worked with her colleagues to secure a $1 billion increase in funding for the Airport Improvement Grant program, which has provided funding for Pullman-Moscow and many other projects throughout the state.

WASHINGTON ― In the wake of Hurricane Florence, the Internal Revenue Service is reminding taxpayers that criminals and scammers try to take advantage of the generosity of taxpayers who want to help victims of major disasters.

Fraudulent schemes normally start with unsolicited contact by telephone, social media, e-mail or in-person using a variety of tactics.

Some impersonate charities to get money or private information from well-intentioned taxpayers.
Bogus websites use names similar to legitimate charities to trick people to send money or provide personal financial information.
They even claim to be working for or on behalf of the IRS to help victims file casualty loss claims and get tax refunds.
Others operate bogus charities and solicit money or financial information by telephone or email.

USDA BLOG: Cranberries at the Heart of Conservation
The Glacial Lake Cranberries farm, located in Cranmoor, Wisconsin, has been in Mary Brown’s family since 1923. Her 6,000 acres consists of 330 acres of cranberries, 2,600 acres of forest, and 3,000 acres of reservoirs that support the cranberry acres. Her 96 fruit beds produce 10 million pounds of fruit yearly. She runs the operation with her son, Stephen, four employees that live on the property year-round, seasonal staff, and help from family.
Cranberries have been growing there even longer, though. The farm was originally purchased in 1873 for lumber until the owners discovered an abundance of wild cranberries. “They built dikes and ditches around the native stands of vines and started cultivating the fruit,” Mary said. Wisconsin is the top state in the country for cranberries, and many producers use native vines.

Biobased bioplastics are plastics made from renewable resources – agricultural feedstocks such as corn, soybeans, or sugarcane. The starches, oils, and sugars from these feedstocks are extracted, modified, and used as the chemical building blocks for these new bioplastic products. This is valuable because these feedstocks are sources of “new” carbon because of their renewability. Petroleum/oil-based products contain “old” carbon. The amount of new carbon in a product can be an important measurement for the product’s sustainability. Bioplastics can also be made from used cooking oil, straw, food waste, and natural gas. THE FED: Agencies propose rule regarding the treatment of high volatility commercial real estate.
Three federal banking agencies on Tuesday invited public comment on a proposal to modify the agencies' capital rules for high volatility commercial real estate exposures, as required by the Economic Growth, Regulatory Relief, and Consumer Protection Act.

The proposal also asks for comment on certain terms contained in the revised definition of high volatility commercial real estate. Texas Couple Indicted on Forced Labor and Related Charges
Defendants Mohamed Toure, 57, and Denise Cros-Toure, 57, of Ft. Worth, Texas, were charged today in a five-count indictment with forced labor, alien harboring for financial gain, and conspiracies to commit forced labor and alien harboring, announced Acting Assistant Attorney General John Gore of the Justice Department’s Civil Rights Division, U.S. Attorney Erin Nealy Cox of the Northern District of Texas, and Special Agent in Charge Jeffrey McGallicher of the Department of State, Diplomatic Security Services’ Houston Field Office. Agreement to boost salmon returning to Pacific Northwest waters
Pacific Salmon Treaty agreement finalized; agreement will support improved salmon recovery to benefit orcas.
Gov. Jay Inslee announced today that representatives from the United States and Canada have agreed to recommend their governments approve new coast-wide fishing agreements under the Pacific Salmon Treaty.
 The agreement outlines each nation’s fishery management plans for chinook, coho and chum stocks from 2019 to 2028. If approved, the treaty will result in more salmon returning to Washington and Oregon waters, where many populations are listed for protection under the federal Endangered Species Act. ----Governor's Medium page article

Washington state receives $21.5 million to tackle opioid epidemic.
Gov. Jay Inslee announced today that Washington will receive an additional $21.5 million to support state efforts to combat the opioid crisis. 

The funding is part of more than $1 billion in State Opioid Response (SOR) grants to states to prevent opioid-related overdoses and deaths, the U.S. Department of Health and Human Services (HHS) announced today. Commerce awards $9.9 million to preserve 1,179 affordable housing units.
OLYMPIA, WA – The Washington State Department of Commerce today announced $9.9 million in grants and loans from the state’s Housing Trust Fund (HTF) for 23 housing preservation projects in communities throughout Washington. See the complete list.

The funds will preserve 1,179 multifamily rental and shelter units, 790 of which will be occupied by households earning 30 percent or less of the area median income. Estimated total cost to complete preservation work is in excess of $64 million, meaning that each state dollar invested will leverage $5.4 additional from other sources. Funding partnerships with private, public, nonprofit and community organizations will ensure completion of these projects.

WDFW plans controlled burns on wildlife areas in Eastern Washington
The Washington Department of Fish and Wildlife (WDFW) will be conducting controlled burns on department lands in Okanogan, Ferry, Pend Oreille, Kittitas, and Yakima counties to reduce wildfire risks and enhance wildlife habitat.

Labor market continued to improve in August.
OLYMPIA – Washington’s economy added 9,100 jobs in August and the state’s seasonally adjusted monthly unemployment rate for August was 4.5 percent according to the Employment Security Department. The August unemployment rate decreased slightly from the July 2018 unemployment rate of 4.6 percent and is the lowest rate for August since 1976.

State’s Boating Program encourages hunters to boat safely
OLYMPIA – Sept. 20, 2018 – With the upcoming opening of waterfowl and upland game hunting seasons, Washington State Parks’ Boating Program wants people who hunt from boats to be safe and know the boating laws before they head out on the water.
Most hunting and angling take place on boats less than 16-feet long. Small boats are known for their instability. Recreational boating data from the U.S. Coast Guard and the Boating Program shows that most drowning victims were using vessels less than 21 feet in length. In addition, the primary causes of boating fatalities are capsizing, falling overboard and swamping.

Clallam County Administrator Withdraw announcement
The Clallam County Board of Commissioners (BOCC), upon review of required pre-hire administrative processes, have elected to withdraw the conditional job offer to County Administrator candidate David Fraser. The County is now exercising its option with Strategic Government Resources (SGR) to re-start the search process on a national level for filling the position of Clallam County Administrator.
SGR CEO Ron Holifield has advised that the County should receive a fresh pool of applicants in this new search, expected to be concluded over the next two and one-half months. The BOCC are cognizant of the needed time and effort to appropriately fill this critical position and are willing to invest this additional time in order to find and appoint the right person for this position.
Current Clallam County Administrator Jim Jones will be retiring on October
26th. The BOCC will be speaking with Jim as to his availability to continue on in a consultant basis for the foreseeable future.
