“Before we begin today’s conversation I want to comment on the decision by Senate Republicans to once again attempt to raise families’ costs and take away their health care—this time to fund tax cuts for massive corporations and the rich—while using the bipartisan agreement Chairman Alexander and I, and members of this committee, reached as nothing more than political cover.

“First—let’s be clear about the policy: tacking Alexander-Murray onto the partisan Republican tax reform effort is like trying to put out a fire with penicillin. It will not do anything to help.

“The Alexander-Murray bill was intended to lower costs and stabilize the market—but millions of people will still be left paying more and losing coverage if Senate Republicans sabotage families’ health care to help millionaires and billionaires get more tax breaks they probably don’t need.

“Second—the way that this was done, by sneaking devastating health care changes into a partisan bill at the last minute, is completely counter to the bipartisan spirit in which we worked on our stabilization bill.
“Many of us agreed in the wake of partisan repeal efforts earlier this year that jamming partisan policy through before anyone has a chance to see it is absolutely not the right way to get things done, and it’s especially disappointing to see this happen because in working on our bill and reaching agreement, we proved we can work under regular order and find common ground.
“And finally, Chairman Alexander, I’ve said many times before how much I appreciated your willingness to work across the aisle after Trumpcare failed in July—to try to get a result that actually helps families rather than burdening them with higher costs and causing millions to lose coverage.
“I think the work we and this committee are able to do together when we focus on what’s best for patients and families is exactly what people want to see happening in Congress.
“What Senate Republicans are proposing now is the exact opposite and the wrong direction for families’ health and financial security.

“We have strong concerns that the FCC’s ongoing review of the proposed merger of Sinclair Broadcasting and Tribune Media may be tainted by a series of actions and events that raise questions about the independence and impartiality of the FCC,” wrote the senators to FCC Inspector General David Hunt.

In addition to Sens. Cantwell and Udall, Sens. Richard Blumenthal (D-CT), Patty Murray (D-WA), Ed Markey (D-MA), Al Franken (D-MN), Elizabeth Warren (D-MA), Dick Durbin (D-IL), Ron Wyden (D-OR), Bernie Sanders (I-VT), Tammy Duckworth (D-IL), Jeff Merkley (D-OR), Catherine Cortez-Masto (D-NV), Cory Booker (D-NJ), and Patrick Leahy (D-VT) also signed the letter.
In their letter to the inspector general, the senators point out 16 actions and events that suggest a disturbing pattern of a three way quid pro quo involving Sinclair, the Trump Administration, and Chairman Ajit Pai. Cantwell, Colleagues Call for Inspector General Investigation of Commerce Secretary Wilbur Ross

WASHINGTON, D.C. – U.S. Senator Maria Cantwell (D-WA) and five of her Senate colleagues are calling on the Inspector General (IG) of the Commerce Department, Peggy Gustafson, to open an independent inquiry into Commerce Secretary Wilbur Ross’ compliance with ethics requirements. Today’s letter was also signed by U.S. Senators Richard Blumenthal (D-CT), Maggie Hassan (D-NH), Cory Booker (D-NJ), Tammy Baldwin (D-WI), and Tammy Duckworth (D-IL).

The Senators’ letter details several areas of concern, including:

Ascertaining the true value of Secretary Ross’ personal wealth;
Whether Secretary Ross has complied with the divestment requirements in his ethics agreement;
Whether Secretary Ross has complied with the recusal requirements in his ethics agreement and the adequacy of that agreement; and
Whether senior department officials have been allowed to serve despite conflicts of interest.
As part of his confirmation process, Ross committed to an ethics agreement that required he divest significant assets and recuse himself from actions that would affect the assets he was permitted to retain. After missing several deadlines to provide proof that he has sold problematic assets, it remains unclear whether Ross has actually complied with the divestment requirements outlined in his original ethics agreement. Ross also appears to be actively participating in policymaking that could have a direct and predictable effect on the financial interests of the assets he has retained, which would violate that agreement’s recusal terms.

Following additional reporting that raises serious questions about Ross’ true net worth and the structure of his finances, it is also unclear whether or not the original ethics agreement is truly sufficient to prevent conflicts of interest. This reporting also raises concerns about high-ranking Department of Commerce officials including Secretary Ross’ chief of staff, Wendy Teramoto, who appears to have served on the board of a shipping company at the same time she oversaw trade deals that may have impacted that company’s finances.

Opening Remarks before the Senate Finance Committee Markup on Republican Tax Bill

Senator Cantwell: Mr. Chairman, I’ll try to do my best but this is pretty important legislation. First I want to say I don’t agree with many of the president’s economic strategies. I don’t believe in his notion of fear and isolationism. I don’t believe in his notion of discussing things that are going to start trade wars. I don’t believe in his lack of support for a functioning Export-Import Bank that will help US manufacturers build products and seek homes and find their acceptance in international markets. I don’t support his notion that the FERC ought to mandate that consumers in Ohio or Pennsylvania or Kentucky pay higher electricity rates by forcing them to adhere to purchasing coal because he wants to bring coal back. And I don’t support his notions of cutting innovation and R&D in various sectors of our economy. I sure don’t think you have to apply this sort of FERC logic on coal to oil and say that the only way that Amazon or Microsoft can get a tax break is if we destroy the great wilderness of the Arctic Wildlife Refuge.

So no I too had high hopes for what would be a discussion about our corporate tax rate, having many companies in my state that have to compete on an international basis. I hoped that we were going to have that discussion and when my colleagues on the other side of the aisle said it needed to be deficit-neutral, I listened. I thought ‘okay, this is interesting.’ When they said we are going to close corporate loopholes to pay for a corporate rate reduction, I listened and I thought ‘well, maybe this is where we’re going to go. We’re going to sit down in a collaborative fashion and work together.’ And Mr. Chairman, you and I do have a good working relationship, but the notion that the president had a meeting of the Finance members to come down the White House and I wasn’t invited because I represent a state that he didn’t win is a ridiculous idea.

So, the notion that where we are today and my main objection, is that instead of doing those things that we talked about on the corporate tax rate, looking at some of these things like carried interest or in-kind exchanges or the fact that golf courses get tax breaks. Instead, a big chunk of this bill is being paid for on the backs of middle class families by taking away their deductions. Their local sales tax deduction from a state like mine that doesn’t have an income tax, from their property taxes not being able to be deducted, or the mortgage deduction and I know there’s differences between the House and the Senate bill. But this isn’t simplification of our tax code, it’s simply raising taxes on middle class families in my state. And it’s raising taxes on millions of Americans across the United States to give a break to the corporations. So it’s a very different structure than we talked about.

Now, most are objecting – because Mr. Chairman you and I have worked very hard – trying to make more affordable housing. But by getting rid of these deductions on property taxes on home mortgage, the notion that you’re getting rid of private activity bonds in the House legislation and that you’re making changes to the Low Income Tax Credit in this Senate bill is just making housing more expensive at a time when we have a record number of Americans who are in unaffordable housing situations.

So I look at our challenges and I know that you or some of our colleagues talked about the credit that small business are getting. It’s so complex. It’s so challenging. I don’t know what small businesses are going to benefit from this. So Mr. Chairman I hope that we can slow down. The reason I mentioned the housing, and I will wrap up, is that housing used to be 15% of GDP. In the few hearings that we did have on this, now it’s only 12% of GDP. This bill, I know you think this notion of returning investment overseas, not a bad idea, something we could talk about. But we’re just returning it and it’s just going to the dividend pool. There’s nothing in there that says it should go to infrastructure investment. There’s nothing in there that says it should go to roads or housing or even job training. And I guarantee you: it’s not worth giving a tax break to corporations if you can’t find a qualified workforce or they have to live an hour and a half away because housing is so expensive. So Mr. Chairman, thank you for the additional minute. I think five is a very good target. And I appreciate, I hope we’ll slow down. I hope we’ll have the courage to work together in a regular order process.

WASH. COMMERCE DEPT: Washington state delegation exhibits at MEDICA in Dusseldorf, Germany this week
OLYMPIA, Wash. – The Washington State Department of Commerce kicked off several days of business-to-business meetings and marketing activities today to showcase the state’s life sciences industry at MEDICA, the world’s largest trade show for the medical technology sector.

Germany is Europe’s largest medical device market and the world’s third largest medical market, with an annual market size of €30 billion. Thirty percent of Germany’s medical device imports come from U.S. companies. Leading European countries importing Washington medical devices include Germany, the U.K., Ireland, France, the Netherlands, and Italy, with over half a billion dollars’ worth of medical products exported from Washington State to Europe in 2016. Europe’s medical market provides excellent opportunities for companies to expand sales overseas.

Washington Supreme Court Issues Order on McCleary Education Case

Olympia, WA – The Washington Supreme Court today issued an order in the case of McCleary, et al. v. State of Washington ruling that the State is not on track to meet the September 1, 2018 deadline to fully implement its program of basic education.

The court’s ruling retains jurisdiction of the landmark education case, continues daily sanctions and orders a report by the State by April 9, 2018 on its progress toward full compliance during the next legislative session.

Signed by all nine justices of the Court, the order acknowledges that “the State has made significant progress in fully funding the program of basic education” but notes that the funding system adopted, “delays by over a year implementation of a constitutionally compliant salary model, a critical part of meaningful reform.”

The order summarizes the nearly six years of history in the case, along with analysis of several areas of reform that have satisfied the Court’s mandate, including: K-3 class size reductions; all-day kindergarten; transportation; materials and supplies; and categorical programs such as highly capable students and special education.

However, the order notes that as things stand today, the salary allocation model enacted in EHB 2242 complies with the State’s obligation to fully fund K-12 basic education salaries, but it will not be implemented by September 1, 2018 – the deadline the Legislature itself recognized.

“The court’s constitutional responsibility is to the schoolchildren of this state who have an enforceable right under article IX, section 1 to an amply funded education,” said the Court.  “We cannot erode that constitutional right by saying that the State is now ‘close enough’ to constitutional compliance.”

The ruling responds to the most recent report of the Washington State Legislature and oral argument on progress made toward meeting constitutional education requirements outlined by the Court in its January 5, 2012 original opinion in this case.

The order states that upon reviewing the parties’ submissions in April, the Court will determine what, if any, additional actions to take.  The Court’s most recent order, along with a complete history of the documents filed in this case.

October unemployment rate matches record low

OLYMPIA – Washington’s unemployment rate fell from 4.6 to 4.5 percent in October – equaling the state’s all-time low for unemployment set earlier this year, according to the state Employment Security Department.

“Washington’s economy keeps growing,” said Paul Turek, economist for the department. “The demand for workers remains strong with ample opportunity for employment.”

Washington added 6,900 nonfarm jobs in October. The department released the seasonally adjusted, preliminary jobs estimates from the federal Bureau of Labor Statistics as part of its October Monthly Employment Report.  

In October last year, the statewide unemployment rate was 5.3 percent. The national unemployment rate was 4.1 percent this October and 3.8 percent in the Seattle/Bellevue/Everett area.

Employment Security paid unemployment insurance benefits to 48,122 people in October.


Labor force continues to grow in Washington

The state’s labor force rose to 3.76 million in October — an increase of 14,100 people from the previous month. In the Seattle/Bellevue/Everett region, the labor force increased by 4,500 over the same period.

From October 2016 through October 2017, the state’s labor force grew by 98,700 and the Seattle/Bellevue/Everett region increased by 20,400.

The labor force is the total number of people, both employed and unemployed, over the age of 16.


Seven sectors expand and six contract  

Private sector employment increased by 6,000 and government employment increased by 900 jobs in October.

This month’s report shows the greatest job growth occurred in professional and business services — up 4,800 — and transportation, warehousing and utilities, up 3,100. Other sectors adding jobs were construction (+2,700), wholesale trade (+1,000), government (+900), information (+300), and financial activities (+300).

Education and health services faced the biggest reduction in October, losing 4,000 jobs. Additionally, leisure and hospitality cut 900, retail trade eliminated 700, other services trimmed 300, manufacturing shed 200 and mining and logging clipped 100.


Year-over-year growth remains strong

Washington added an estimated 105,800 new jobs from October 2016 through October 2017, not seasonally adjusted. The private sector grew by 3.4 percent or 91,000 jobs, and the public sector increased by 2.5 percent, adding 14,800 jobs.

From October 2016 through October 2017, 12 of the state’s 13 industry sectors added jobs. Manufacturing (-1,600) was the only sector to report job losses.

The three industry sectors with the largest employment gains year-over-year, not seasonally adjusted, were:

Construction with 17,100 new jobs;
Professional and business services with 16,700 new jobs; and
Government with 14,800 new jobs.

Note: The Bureau of Labor Statistics recently updated its “alternative measures of labor underutilization,” or U-6 rate, for states to include the third quarter of 2017. The U-6 rate considers not only the unemployed population in the official U-3 unemployment rate, but also “the underemployed and those not looking but wanting a job.” The U-6 rate for Washington through the third quarter 2017 was 9.4 percent compared to the national rate of 8.9 percent. Washington’s U-6 rate is the lowest it has been since 2009.

Public safety drives DNR funding needs
Funding for healthier forests, safer timber harvests, and mapping of earthquake and tsunami hazards top the list of Commissioner of Public Lands Hilary Franz’s supplemental budget requests for the Washington State Department of Natural Resources (DNR).

“Public safety is at the heart of what DNR does, and these modest funding requests allow us to help people prepare for and prevent natural disasters,” said Commissioner Franz.

Healthier Forests
The agency is seeking $1.9 million from the state’s supplemental operating budget to expedite projects that will make Washington’s diseased, fire-prone forests healthier.

“People in Puget Sound this summer experienced what our neighbors in central Washington have dealt with for the past decade – increasingly thick smoke from more devastating wildfires. If we’re going to control the spread of these megafires, we need to address the root cause: forest health,” said Commissioner Franz.

Mapping geologic threats and ensuring safer timber harvests
DNR is also requesting $543,000 to map earthquake and tsunami hazards so counties, cities and the people of Washington can understand and mitigate their risks. The agency has also requested $457,300 to ensure design and construction of timber roads does not weaken potentially-unstable hillsides.

Other budget priorities include advanced training for wildland firefighters; cleanup of contaminated sediments; funding for amateur emergency radio operators; and funding to help counties impacted by endangered species regulations replace lost timber revenue.

Needs from capital budget
In addition, DNR has re-submitted requests for funding from the capital budget which the Legislature did not pass before adjourning last session.

“Whether it’s recreation maintenance, forest restoration or helping communities become FireWise, we have a lot of projects that rely on capital dollars to enhance quality of life for all Washingtonians,” Commissioner Franz said.

Commissioner of Public Lands
As the elected Commissioner of Public Lands, Franz oversees management of more than 5.6 million acres of state-owned forest, range, commercial, agricultural, conservation and aquatic lands. More than half of these lands are held in trust and produce income to support public schools, universities, prisons and other state institutions. Lands managed by DNR provide other public benefits including outdoor recreation, habitat for native fish and wildlife and watersheds for clean water. Commissioner Franz also leads the state’s largest fire department and guides regulation of forest practices in Washington’s forests.

I congratulate the Government and people of the Republic of the Philippines for your success in chairing ASEAN in its fiftieth anniversary year.  And I congratulate all the Governments and peoples of ASEAN on the achievement of this milestone.

ASEAN was founded at a time of great turmoil in Southeast Asia.  Five decades on, ASEAN is an indispensable partner in ensuring peace, stability and prosperity in Southeast Asia and beyond.

The five men who signed the founding ASEAN declaration were two Muslims from Indonesia and Malaysia, a Christian from the Philippines, a Hindu from Singapore and a Buddhist from Thailand.  This is just one sign of remarkable diversity at the heart of your region, as we meet at a time of proliferating divisions and crises.

Globalization is delivering new opportunities — but increasing economic and social inequalities, heightening citizens’ anxieties and putting pressure on social cohesion.  Climate change is exacerbating severe weather events like hurricanes and storms.  I commend ASEAN’s leadership at the national and regional levels for your decisive action to strengthen resilience and reduce the risk posed by climate change and other natural disasters.  I will stress the importance of collective action at the global and regional levels at the COP23 [twenty-third Conference of the Parties to the United Nations Framework Convention on Climate Change] in Germany later this week.

As I told the General Assembly of the UN in September, I am extremely concerned by the threat of global terrorism and violent extremism, including in this region.  The United Nations is prioritizing support for national and regional efforts to counter terrorism and to prevent violent extremism, including the establishment of a dedicated UN Office of Counter‑Terrorism.  We welcome the adoption of the Manila Declaration to Counter the Rise of Radicalization and Violent Extremism, and its recognition of the importance of comprehensive approaches and preventive action.

The United Nations stands ready to provide technical support to ASEAN and its member countries in their efforts to counter terrorism and violent extremism, and to combat transnational crime, including drug trafficking and people trafficking, through policies able to protect their citizens with effective law enforcement and respect for human rights.  The international community must raise the level of its response to all these complex threats.  Multilateralism and regional cooperation will be critical to a peaceful and prosperous future. Delegates expressed concern today about protection for whistle‑blowers and managerial accountability as well as staff’s lack of knowledge of dispute mechanisms at their disposal as the Fifth Committee (Administrative and Budgetary) examined the Organization’s track record for resolving conflict for tens of thousands of employees worldwide.

The Organization’s system for administering justice comprises formal and informal mechanisms to resolve disputes, including both a Dispute and Appeals Tribunal staffed by professional judges, the Office of Staff Legal Assistance, the Management Evaluation Unit, as well as the Office of the United Nations Ombudsman and Meditation Services.

On effective protection from retaliation, the delegate from Switzerland, also speaking for Liechtenstein, stressed the importance of an environment in which staff members felt safe reporting misconduct, or lodging a case with tribunals or appearing as a witness before them.  Observing that the latter two cases were still excluded from protection against retaliation, he called on the United Nations to remedy that situation.

The representative of the United States echoed that sentiment, emphasizing that the United Nations could not be a transparent and accountable organization without adequate protection for those who reported wrongdoing, stressing, “there should be no fear of retaliation at the United Nations”.

Ecuador’s representative, speaking on behalf of the “Group of 77” developing countries and China, noted that during the reporting period, no decision had been made on the accountability of managers whose decisions had been found to be grossly negligent and had led to litigation and financial losses, underscoring that such issues must be further analysed and addressed.  Moreover, she noted with concern the widespread lack of knowledge among staff members of the internal system of justice, as well as the high degree of self‑representation before the United Nations Dispute Tribunal despite the availability of free legal assistance.  (read more at link source)

By renewing the mandate of the Somalia and Eritrea Monitoring Group, we signal our continued commitment for greater security and peace for the region.

We wish to acknowledge the recent engagement between the Government of Eritrea and the United States and international community, and we encourage Eritrea to continue working toward addressing the Security Council’s concerns. While we appreciate our dialogue with Eritrea, we must note our disappointment that the Monitoring Group and the Committee Chair continue to be prevented from visiting the country. This lack of cooperation hinders the ability of the Monitoring Group to fulfill its mandate to fully assess Eritrea’s compliance. Confirmation of Eritrean compliance with the sanctions regime is essential to easing the sanctions regime. Allowing the Monitoring Group to visit and fulfill its mandate is a necessary initial step.

We remain deeply concerned about the Monitoring Group’s reports of possible sanctions violations, including the interdiction of military encrypted radios from North Korea to Eritrea, as well as Eritrean support for regional armed groups. We also expect Eritrea to share any additional information available to resolve lingering questions regarding any Djiboutian prisoners in its custody.

Turning to Somalia, we acknowledge the ongoing efforts made by the Federal Government of Somalia toward security sector reform and to comply with its reporting requirements under the sanctions regime. Remarks at a UN Security Council Open Arria-Formula Meeting on the Situation in Venezuela

It’s interesting; when we decided to do this Arria-formula meeting, it was very much because when we held it back in May, we had all hoped for a better turnout. We had seen all the things that were happening in Venezuela. We saw it being reduced to the point of less democratic, more abusive. We saw the people hurting, and so that is the reason we decided to have a follow-up meeting today to continue the pressure on the government to right the wrongs that they had had happen.

What we have since found is we received pressure from regional partners not to have this meeting. This goal is not to degrade anyone. This is not to humiliate a region. This is only to lift up the region. This is a region that has many strong countries, and when you’ve got one right there that’s the weak one, it makes everyone look bad. And so that’s the reason we think it was important.

But what was more telling was to see my Security Council friends that fell to the Venezuelan pressure to not attend at all. And I will tell you that is proof to me that all of the issues that we’re fighting for the Venezuelan people – all of the wrongs that we see – the fact that the government would go so far as to try and get people not to show up to a meeting is guilt. And that’s unfortunate.

We are here today to discuss the situation in Venezuela. It is one of the most breathtakingly tragic situations in the world. Here you have a country that by all measures should be in a strong condition. It is a country with vast natural resources and economic potential. A country with a democratic experience. A country that sits in a region that has made remarkable progress in moving away from dictatorships and toward freedom.

And yet, all of that potential is being squandered by a government that cares only for preserving its own power, rather than promoting the freedom and welfare of its people. Through violence, massive repression, corruption, and financial mismanagement, the Maduro regime is showing its true colors as a dictatorship. It is denying the voice of its own people by imprisoning political opposition, rejecting its own democratically elected National Assembly, and putting forth sham elections that everyone understands are phony.

The Venezuelan people desperately want to control their own destinies. They know what a real democracy is like. They see it in their neighboring countries. USDA BLOG: Farm to School Success in Hawaii

It takes the right amount of water and sunlight for seeds to grow into a thriving garden. So too, it takes the right mix of factors to integrate local foods into communities. Some of these factors include committed stakeholders, planning, collaboration, and financial resources.

Hawaii offers two successful examples of how federal funds can seed local agencies in the cultivation of their community food system goals. Kona Pacific Public Charter School & Friends of Kona Pacific Public Charter School (Kona Pacific) and The Kohala Center, Inc. (TKC) collaborate to advance their shared goals of improving student and community health, the regional agricultural economy, ecological understanding and a connection to native Hawaiian culture.

In 2011, Kona Pacific was awarded a $3 million direct loan through the USDA Rural Development Community Facilities Program. The project financed the purchase and expansion of a 38-acre parcel of land with an organic farm and a small elementary school campus. The space emphasizes Kona Pacific’s educational focus on agriculture. An on-site garden serves as a platform for multidisciplinary lessons and a place where students grow crops using traditional cultivation techniques.

TKC, a partner of Kona Pacific, is a community-based institute for research, conservation and education. In 2014, TKC was funded through an Agricultural Marketing Service Specialty Crop Block Grant to help schools and farmers maximize the use of the USDA’s Fresh Fruit and Vegetable Program, available to high-need elementary schools as a source and market for local foods.

TKC further accelerated buying local foods through a 2015 USDA Farm to School Grant, a competitive grant administered by USDA’s Food and Nutrition Service to entities across the country to advance farm to school initiatives, and a 2015 USDA Rural Cooperative Development Grant. TKC used the grants to develop reports on sourcing local food for child nutrition programs in Hawaii, build school and farmer connections, launch planning for the Hawaii Island Charter School Food Hui with Kona Pacific, create a garden-based curriculum, participate in the Hawaii Lieutenant Governor’s Farm to School Advisory Group and strengthen the capacity and impact of the Hawaii Farm to School Hui, a network of farm to school stakeholders on each Hawaiian island advancing local food systems.

In 2016, Kona Pacific worked with the Hui to increase charter school participation in federal nutrition assistance programs through the National Institute of Food and Agricultures’ Community Food Project. Kona Pacific was also awarded a USDA Farm to School Grant to assess their 10 farm to school initiatives and develop an integrated farm to school action plan, which included financial sustainability.

As demonstrated by Kona Pacific and TKC, local food initiatives grow and flourish over time. Communities can strategically use federal resources to foster local food systems, economic opportunities and self-sufficiency. Each of these USDA programs was leveraged at a different time and with a different purpose, however, each investment supported the long-term goal of developing a locally controlled food system that supports both Hawaiian producers and citizens.

The 2018 Farm to School Grant Request for Application (RFA) is open through December 8, 2017. Since the grant program’s inception in 2013, USDA has invested more than $25 million in farm to school grants among 365 projects reaching more than 13 million students across all 50 states, Washington, D.C. and the U.S. Virgin Islands. Puerto Rico and U.S. Virgin Islands — Today, U.S. Secretary of Education Betsy DeVos traveled to both Puerto Rico and the U.S. Virgin Islands to observe the recovery and rebuilding efforts firsthand and to discuss with local leaders how the Department of Education can best assist in those efforts.
"My heart goes out to those in Puerto Rico and the Virgin Islands who have had their lives upended by the recent hurricanes," said Secretary DeVos. "There is certainly a long road to recovery ahead, but seeing the rebuilding efforts in person today was truly inspiring. While in San Juan, Puerto Rico, Secretary DeVos toured a public elementary school and met with local officials including Governor Ricardo Rosselló, Secretary of Education Julia Keleher and K-12 and higher education leaders to discuss the state of the recovery efforts.
After leaving Puerto Rico, Secretary DeVos traveled to St. Thomas to meet with Governor Kenneth Mapp and representatives from both the Virgin Islands Department of Education (VIDE) and the St. Thomas School District. She also toured a public high school with St. Thomas/St. John School District Deputy Superintendent Racquel Berry-Benjamin and participated in a small group discussion with Charlotte Amalie High School's principal, teachers and students.
The final stop took place at The University of the Virgin Islands with university President Dr. David Hall. Secretary DeVos participated in a roundtable session with Dr. Hall, university leadership and students to discuss their needs and the challenges that lay ahead of them in the recovery process.

As a School Ambassador Fellow with the U.S. Department of Education, I had the opportunity to help plan and coordinate a visit for First Lady Melania Trump and Secretary Betsy DeVos to Orchard Lake Middle School in West Bloomfield, MI. The school was selected because they had pledged their commitment to anti-bullying initiatives promoting inclusion and acceptance. Orchard Lake Middle School prides itself on diversity and anti-bullying programs, so the principal and staff knew that they would be a good fit for FLOTUS’s bullying prevention platform.

Breaking Bully Stereotypes
I have spent the last decade focusing on breaking bully stereotypes and shifting the conversation around such a critical topic, so I jumped at the chance to be part of this work at a national level. Most of the bullying I faced as a student occurred in middle school, so I was shocked to see it happen with my third graders. The most surprising part, however, was when I realized which students were doing the bullying. Some of my sweetest, smartest, and most seemingly innocent kids were often the ones doing the most harm. I see the same trends and patterns with every class.

One thing these kids all have in common is that they do not see themselves as bullies since they do not resemble the exaggerated characters in TV and movies. No one is a bully all the time, and this misconception makes it hard for kids to accept their actions as bullying behavior. This problem can be perpetuated in any school lunchroom when kids are left feeling isolated and excluded, while the classmates doing the excluding don’t understand the harm they cause. Effective anti-bullying initiatives can really help change those dynamics, and having the First Lady and Secretary share that message really helps kids pay attention.

Students Realize the Magnitude of the Event
I was able to be at the school for most of the day, hours before the special guests arrived. I could feel the energy in the building as students buzzed with anticipation. It was fascinating to watch all that happened behind the scenes and the planning and manpower it took to execute a one-hour visit. But the students reminded me why this event was so important. While the adults were scurrying around making sure things were running smoothly, the middle schoolers were enjoying the moment, recognizing the magnitude of what was happening. They knew their school was being highlighted and it meant they were doing something right, and that is an empowering feeling.

Sharing a message with kids about the importance of compassion and kindness is something that everyone should stand behind, and that day, everyone did. It is a big deal to have the First Lady and Education Secretary of the United States at their school, and this is something that these kids will remember for the rest of their lives. I am quite sure they will also remember that no one should eat alone either.

NEWS FROM NASA: NASA Space Station Cargo Launches Aboard Orbital ATK Mission

The International Space Station will receive about 7,400 pounds of cargo, including new science and technology investigations, following the successful launch of Orbital ATK’s Cygnus spacecraft from NASA’s Wallops Flight Facility in Virginia Sunday.

Orbital ATK’s eighth contracted cargo delivery flight to the station launched at 7:19 a.m. EST on an Antares rocket from Pad 0A at Wallops, and is scheduled to arrive at the International Space Station Tuesday, Nov. 14.

This is the fifth flight of an enhanced Cygnus spacecraft, and the second using Orbital ATK’s upgraded Antares rocket. The spacecraft for this mission is named in honor of Gene Cernan, the last human to step foot on the Moon. Cernan, who passed away in January at age 82, set records for both lunar surface extravehicular activities and the longest time in lunar orbit.

Expedition 53 astronauts Paolo Nespoli of ESA (European Space Agency) and Randy Bresnik of NASA will use the space station’s robotic arm to grapple Cygnus, about 4:50 a.m. Tuesday. Cygnus will remain at the space station until Dec. 4, when the spacecraft will depart the station and deploy several CubeSats before its fiery re-entry into Earth’s atmosphere as it disposes of several tons of trash.

The resupply mission will support dozens of new and existing investigations as Expeditions 53 and 54 contribute to about 250 science and research studies.

Highlights from the new experiments will include studies on antibiotic resistance, high-speed data transmission, plant growth and improved power and communication technologies.

The E. coli AntiMicrobial Satellite (EcAMSat) mission will investigate the effect of microgravity on the antibiotic resistance of E. coli, a bacterial pathogen responsible for urinary tract infection in humans and animals. Antibiotic resistance could pose a danger to astronauts, especially since microgravity has been shown to weaken human immune response. The experiment will expose two strains of E. coli to three different doses of antibiotics; one of these strains is deficient in the gene responsible for the increased antibiotic resistance in microgravity. Results from this investigation could help determine appropriate antibiotic dosages to protect astronaut health during long-duration missions and help us understand how antibiotic effectiveness may be increased in microgravity, as well as on Earth.

The Optical Communications and Sensor Demonstration (OCSD) project will study high-speed optical transmission of data and small spacecraft proximity operations. It will test functionality of laser-based communications using CubeSats that provide a compact version of the technology.

Results from OCSD could lead to significantly enhanced communication speeds between space and Earth and a better understanding of laser communication between small satellites in low-Earth orbit.

The Biological Nitrogen Fixation in Microgravity via Rhizobium-Legume Symbiosis (Biological Nitrogen Fixation) investigation examines how low-gravity conditions affect the nitrogen fixation process of Microclover, a resilient and drought tolerant legume. The nitrogen fixation process, a process by which nitrogen in the atmosphere is converted into a usable form for living organisms, is a crucial element of any ecosystem necessary for most types of plant growth. This investigation could provide information on the space viability of the legume’s ability to use and recycle nutrients and give researchers a better understanding of this plant’s potential uses on Earth.

As space exploration increases, so will the need for improved power and communication technologies. The Integrated Solar Array and Reflectarray Antenna (ISARA), a hybrid solar power panel and communication solar antenna that can send and receive messages, tests the use of this technology in CubeSat-based environmental monitoring. ISARA may provide a solution for sending and receiving information to and from faraway destinations, both on Earth and in space.

For more than 17 years, humans have lived and worked continuously aboard the International Space Station, advancing scientific knowledge and demonstrating new technologies, making research breakthroughs not possible on Earth that will enable long-duration human and robotic exploration into deep space. A global endeavor, more than 200 people from 18 countries have visited the unique microgravity laboratory that has hosted more than 2,100 research investigations from researchers in more than 95 countries.

Clearing the Way for Energy Innovators

The regulatory rollback continues in Washington, and the latest victories come not a moment too soon for many American businesses. Two actions by Environmental Protection Agency (EPA) Administrator Scott Pruitt will help rein in Obama-era environmental rules that had hovered ominously over key U.S. industries, such as energy, for far too long.

The U.S. Chamber of Commerce applauded Administrator Pruitt’s announcement that he would end the so-called sue and settle scheme, which allowed special interest groups to sue EPA in an attempt to force it to take action on their pet issues. Instead of fighting these lawsuits in the courts, EPA usually settled behind closed doors, allowing outside advocacy groups to take control of the agency’s regulatory priorities. Activist organizations successfully used this tactic over a hundred times to force certain outcomes without any public oversight or involvement.
While Administrator Pruitt’s executive action immediately halts the sue and settle gambit, it’s important that Congress also takes legislative action. Otherwise, future administrations could easily revive this abusive practice. That’s why the Chamber has long pushed the Sunshine for Regulations and Regulatory Decrees and Settlements Act, which would help Congress reassert its control over federal regulatory actions. The House passed the bill last month, and the Chamber encourages the Senate to quickly follow suit.

In another welcome move, Administrator Pruitt announced a proposal to repeal the Clean Power Plan (CPP), which would have raised the cost of energy without regard to the impact on families and businesses. The Chamber fought back against the rule for years, including leading a lawsuit along with 28 states and 160 petitioners that resulted in the Supreme Court granting an unprecedented stay to block its implementation.

Now that outright repeal is on the table, we stand ready to work with EPA and all stakeholders to come up with a durable and effective approach to reducing greenhouse gas emissions. Through private sector-led innovation, technology, and ingenuity, America’s energy innovators can make all energy sources cleaner and more affordable.

These latest actions have been met with a sigh of relief from businesses large and small, and so have many other deregulatory efforts from the administration this year. The Chamber has long fought against harmful rules—and in favor of smart, balanced rules—for the simple reason that a heavy-handed regulatory approach fuels uncertainty, stalls hiring, and chokes growth. Now that the government is starting to get out of the way, businesses can focus on what they do best—creating jobs and growing the economy.

WASHINGTON, DC – U.S. Secretary of Labor Alexander Acosta today welcomed the start of National Apprenticeship Week, a nationwide opportunity for companies, trade and industry groups, nonprofit organizations, unions, labor-management organizations, and educational institutions to highlight how apprenticeship programs can address the nation’s skills gap. President Donald J. Trump has proclaimed November 13 – 19 as National Apprenticeship Week.

By increasing the number of apprenticeships, more Americans will be on the path to family-sustaining jobs,” said Secretary Acosta. “Hundreds of National Apprenticeship Week events are scheduled across the nation to show how apprenticeships work. To help Americans obtain relevant skills and family-sustaining jobs, President Trump issued an Executive Order Expanding Apprenticeships in America. Apprenticeships provide paid, relevant workplace experiences and opportunities to develop skills that job creators demand. Hundreds of companies—big and small, across industries—have shown an interest in apprenticeships since President Trump signed his Executive Order.
The President’s Executive Order called for the Secretary of Labor to establish a Task Force on Apprenticeship Expansion. This afternoon, the first meeting of the Task Force will take place at the Department of Labor in Washington.
National Apprenticeship Week events and activities include: apprenticeship program open houses, skills competitions, community forums, apprentice graduations, business open houses, high school or college career fairs, industry roundtable events, and more.

WASHINGTON –The Internal Revenue Service today advised taxpayers about steps they can take now to ensure smooth processing of their 2017 tax return and avoid a delay in getting their refund next year. This is the first in a series of reminders to help taxpayers get ready for the upcoming tax filing season. Additionally, the IRS has a special page on its website with steps to take now for the 2018 tax filing season.

Gather Documents


The IRS urges all taxpayers to file a complete and accurate tax return by making sure they have all the documents before they file their return, including their 2016 tax return. This includes Forms W-2 from employers, Forms 1099 from banks and other payers, and Forms 1095-A from the Marketplace for those claiming the Premium Tax Credit. Doing so will help avoid refund delays and the need to file an amended return later. Confirm that each employer, bank or other payer has a current mailing address.

Typically, these forms start arriving by mail in January. Check them over carefully, and if any of the information shown is inaccurate, contact the payer right away for a correction.

Taxpayers should keep a copy of their 2016 tax return and all supporting documents for a minimum of three years. Doing so will make it easier to fill out a 2017 return next year. In addition, taxpayers using a software product for the first time may need the Adjusted Gross Income (AGI) amount from their 2016 return to properly e-file their 2017 return. Renew Expiring ITINs
Some people with an Individual Taxpayer Identification Number (ITIN) may need to renew it before the end of the year. Doing so promptly will avoid a refund delay and possible loss of key tax benefits.
Any ITIN not used on a tax return in the past three years will expire on Dec. 31, 2017. Similarly, any ITIN with middle digits 70, 71, 72 or 80 will also expire at the end of the year. Anyone with an expiring ITIN who plans to file a return in 2018 will need to renew it using Form W-7.
Once a completed form is filed, it typically takes about seven weeks to receive an ITIN assignment letter from the IRS. But it can take longer — nine to 11 weeks -- if an applicant waits until the peak of the filing season to submit this form or sends it from overseas. Taxpayers should take action now to avoid delays.
Taxpayers who fail to renew an ITIN before filing a tax return next year could face a delayed refund and may be ineligible for certain tax credits. For more information, visit the ITIN information page on IRS.gov.

Refunds Held for Those Claiming EITC or ACTC Until Mid-Feb
By law, the IRS cannot issue refunds for people claiming the Earned Income Tax Credit (EITC) or Additional Child Tax Credit (ACTC) before mid-February. The law requires the IRS to hold the entire refund — even the portion not associated with EITC or ACTC. The IRS expects the earliest EITC/ACTC related refunds to be available in taxpayer bank accounts or debit cards starting on Feb. 27, 2018, if direct deposit was used and there are no other issues with the tax return. This additional period is due to several factors, including the Presidents Day holiday and banking and financial systems needing time to process deposits. This law change, which took effect at the beginning of 2017, helps ensure that taxpayers receive the refund they’re due by giving the IRS more time to detect and prevent fraud.
As always, the IRS cautions taxpayers not to rely on getting a refund by a certain date, especially when making major purchases or paying bills. Though the IRS issues more than nine out of 10 refunds in less than 21 days, some returns require further review.

For a Faster Refund, Choose e-file
Electronically filing a tax return is the most accurate way to prepare and file. Errors delay refunds and the easiest way to avoid them is to e-file. Nearly 90 percent of all returns are electronically filed. There are several e-file options:

IRS Free File,
Volunteer Income Tax Assistance and Tax Counseling for the Elderly programs,
Commercial tax preparation software, or
Tax professional.
Use Direct Deposit.

Combining direct deposit with electronic filing is the fastest way for a taxpayer to get their refund. With direct deposit, a refund goes directly into a taxpayer’s bank account. There’s no reason to worry about a lost, stolen or undeliverable refund check. This is the same electronic transfer system now used to deposit nearly 98 percent of all Social Security and Veterans Affairs benefits. Nearly four out of five federal tax refunds are direct deposited.
Direct deposit saves taxpayer dollars. It costs the nation’s taxpayers more than $1 for every paper refund check issued but only a dime for each direct deposit.

The Federal Reserve Board and the Consumer Financial Protection Bureau (CFPB) today announced the dollar thresholds in Regulation Z (Truth in Lending) and Regulation M (Consumer Leasing) that will apply for determining exempt consumer credit and lease transactions in 2018. These thresholds are set pursuant to the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank Act) amendments to the Truth in Lending Act and the Consumer Leasing Act that require adjusting these thresholds annually based on the annual percentage increase in the Consumer Price Index for Urban Wage Earners and Clerical Workers (CPI-W). If there is no annual percentage increase in the CPI-W, the Federal Reserve Board and the CFPB will not adjust this exemption threshold from the prior year. However, in years following a year in which the exemption threshold was not adjusted, the threshold is calculated by applying the annual percentage change in CPI-W to the dollar amount that would have resulted, after rounding, if the decreases and any subsequent increases in the CPI-W had been taken into account. Transactions at or below the thresholds are subject to the protections of the regulations.

Based on the annual percentage increase in the CPI-W as of June 1, 2017, the protections of the Truth in Lending Act and the Consumer Leasing Act generally will apply to consumer credit transactions and consumer leases of $55,800 or less in 2018. However, private education loans and loans secured by real property (such as mortgages) are subject to the Truth in Lending Act regardless of the amount of the loan.

Although the Dodd-Frank Act generally transferred rulemaking authority under the Truth in Lending Act and the Consumer Leasing Act to the CFPB, the Federal Reserve Board retains authority to issue rules for certain motor vehicle dealers. Therefore, the agencies are issuing these notices jointly.

Washington – Today, the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC) designated ten current or former Venezuelan government officials pursuant to Executive Order (E.O.) 13692.  These individuals are associated with undermining electoral processes, media censorship, or corruption in government-administered food programs in Venezuela.  This designation follows October 15, 2017 state elections in Venezuela, which were marked by numerous irregularities that strongly suggest fraud helped the ruling party unexpectedly win a majority of governorships.

Despite calls for an independent audit of the election results, the Venezuelan government proceeded to swear in the winning candidates through an oath of office before the illegitimate Constituent Assembly (Asamblea Constituyente or AC), further illustrating the authoritarian nature of the Maduro regime.  In addition, the environment in which these elections were held – including censorship, the abuse of state media, and rampant corruption extending even to the distribution of food to Venezuela's starving population – raises questions concerning the freedom and fairness of the electoral process.

"As the Venezuelan government continues to disregard the will of its people, our message remains clear:  the United States will not stand aside while the Maduro regime continues to destroy democratic order and prosperity in Venezuela," said Secretary of the Treasury Steven T. Mnuchin.  "We will maintain our vigorous efforts to sanction Venezuelan government officials who are complicit in Maduro's attempts to undermine democracy, violate human rights, inhibit the freedom of expression or peaceful assembly, or engage in public corruption, unless they break from Maduro's dictatorial regime."

Today's designations consist of the following ten current or former officials of the Government of Venezuela.  As a result of today's actions, all assets of these individuals subject to U.S. jurisdiction are frozen, and U.S. persons are generally prohibited from dealing with them.

Today, U.S. Secretary of Commerce Wilbur Ross announced the signing of approximately a quarter trillion dollars in deals facilitated by the Department of Commerce between private U.S. businesses and Chinese entities. The agreements, most of which occurred as part of the U.S. Department of Commerce’s 2017 U.S. CEO Delegation to China, will bring thousands of new jobs to America.
“American businesses are the most innovative in the world, and, when given access, can compete with anyone,” said Secretary Ross. “I believe these deals can provide a solid foundation for a stronger relationship that is more free, fair, and reciprocal between the U.S. and China.”
Addressing the imbalance in U.S.-China trade has been a central focus of discussions between President Trump and President Xi since their first meeting at Mar-a-Lago in April. Today they joined each other at the Great Hall of the People to witness the signing of fifteen of the largest agreements.
“It was a great honor for these to be witnessed by President Trump and President Xi today,” continued Secretary Ross. “A special thank you to our CEO Delegation for their hard work in support of this historic event.”
The Delegation participated in two days of productive exchanges with Chinese businesses and government officials where they advocated for American business interests. They also established relationships that will pay dividends far into the future.

U.S. Department of Commerce Issues Affirmative Final Countervailing Duty Determinations on Biodiesel from Argentina and Indonesia

Today, the U.S. Secretary of Commerce Wilbur Ross announced the affirmative final determinations in the countervailing duty (CVD) investigations of imports of biodiesel from Argentina and Indonesia.
Commerce determined that Argentina and Indonesia are providing unfair subsidies to its producers of biodiesel at rates from 71.45 to 72.28 percent and 34.45 to 64.73 percent, respectively.
As a result of today’s decision, Commerce will instruct U.S. Customs and Border Protection (CBP) to collect cash deposits from importers of biodiesel from Argentina and Indonesia based on the final rates.
“The unfair government subsidization of products is something the Department takes very seriously,” said Secretary Ross. “While the United States is committed to free, fair and reciprocal trade with all countries, the Trump Administration will stand up for American workers and companies being unfairly harmed.”

In 2016, imports of biodiesel from Argentina and Indonesia were valued at an estimated $1.2 billion and $268 million, respectively.
The petitioner is the National Biodiesel Fair Trade Coalition, an ad hoc association composed of the National Biodiesel Board and 15 domestic producers of biodiesel.
The countervailing duty laws provide U.S. businesses and workers with an internationally accepted mechanism to seek relief from the harmful effects of unfairly subsidized imports into the United States.
Enforcement of U.S. trade law is a prime focus of the Trump administration.  From January 20, 2017, through November 9, 2017, Commerce has initiated 77 antidumping and countervailing duty investigations – a 61 percent increase from 48 in the previous year.
CVD laws provide U.S. businesses and workers with an internationally accepted mechanism to seek relief from the harmful effects of unfairly subsidized imports into the United States.  Commerce currently maintains 412 antidumping duty and CVD orders which provide relief to American companies and industries impacted by unfair trade.
If the U.S. International Trade Commission (ITC) makes affirmative final injury determinations, Commerce will issue CVD orders.  If the ITC makes negative final determinations of injury, the investigations will be terminated and no orders will be issued.

WH: Remarks by President Trump at APEC CEO Summit | Da Nang, Vietnam
PRESIDENT TRUMP: What an honor it is to be here in Vietnam -- in the very heart of the Indo-Pacific -- to address the people and business leaders of this region.

This has already been a remarkable week for the United States in this wonderful part of the world. Starting from Hawaii, Melania and I traveled to Japan, South Korea, and China, and now to Vietnam, to be here with all of you today.

Before we begin, I want to address all those affected by Typhoon Damrey. Americans are praying for you and for your recovery in the months ahead. Our hearts are united with the Vietnamese people suffering in the aftermath of this terrible storm.

This trip comes at an exciting time for America. A new optimism has swept all across our country. Economic growth has reached 3.2 percent, and going higher. Unemployment is at its lowest level in 17 years. The stock market is at an all-time high. And the whole world is lifted by America’s renewal.

Everywhere I’ve traveled on this journey, I’ve had the pleasure of sharing the good news from America. But even more, I've had the honor of sharing our vision for a free and open Indo-Pacific -- a place where sovereign and independent nations, with diverse cultures and many different dreams, can all prosper side-by-side, and thrive in freedom and in peace.

I am so thrilled to be here today at APEC, because this organization was founded to help achieve that very purpose. America stands as a proud member of the community of nations who make a home on the Pacific. We have been an active partner in this region since we first won independence ourselves.

In 1784, the first American ship sailed to China from the newly independent United States. It went loaded with goods to sell in Asia, and it came back full of porcelain and tea. Our first president, George Washington himself, owned a set of tableware from that ship.
In 1804, Thomas Jefferson sent the explorers, Lewis and Clark, on an expedition to our Pacific Coast. They were the first of the millions of Americans who ventured west to live out America’s manifest destiny across our vast continent.
In 1817, our Congress approved the first full-time Pacific development [deployment] of an American warship. That initial naval presence soon grew into a squadron, and then a fleet, to guarantee freedom of navigation for the growing number of ships, braving the high seas to reach markets in the Philippines, Singapore, and in India.
In 1818, we began our relationship with the Kingdom of Thailand, and 15 years later our two countries signed a treaty of friendship and commerce -- our first with an Asian nation.
In the next century, when imperialist powers threatened this region, the United States pushed back at great cost to ourselves. We understood that security and prosperity depended on it.

For domestic flights, standard state licenses acceptable until fall 2020

Washington residents have until October 2020 to determine what type of identity document they will need to travel on commercial flights within the United States or to access certain federal facilities. This is when federal requirements will be enforced regarding what kinds of state-issued identification are acceptable.
The new identification requirements are part of the REAL ID Act passed by Congress in 2005. Currently, Washington state residents can obtain a standard driver’s license or ID, or an enhanced driver’s license or ID. Proof of identity and residence is required to obtain a standard card, while an individual must also show proof of U.S. citizenship to obtain an enhanced card.
Beginning in July 2018, Washington State must clearly mark its standard driver’s license and ID cards as noncompliant with federal requirements. By fall of 2018, the Washington State Department of Licensing expects to be in full compliance with the law, and it will apply for certification from the Department of Homeland Security. In October 2020, after REAL ID certification is granted, Washington residents flying domestically or accessing some federal facilities will be required to show an enhanced ID or other form of acceptable federal identification.
This timeline is part of the agreement state and federal officials have reached after several years of discussion.
DOL notes Washingtonians are not required to get an enhanced driver’s license or ID card, and encourages residents to consider their options and look at other forms of federally acceptable ID they may already have.

Statement from FDA Commissioner Scott Gottlieb, M.D. on new steps to improve FDA review of shared Risk Evaluation and Mitigation Strategies to improve generic drug access

To manage the risks associated with drugs, the FDA employs a range of tools. For drugs that are associated with serious risks, the FDA can require drug makers to develop a Risk Evaluation and Mitigation Strategy (REMS) to ensure that the benefits of the drug outweigh the risks. REMS can contain a variety of tools – such as a Medication Guide or patient package insert with information specifically written for patients, a communication plan, and various “Elements to Ensure Safe Use” (ETASU). These elements may include requirements for prescriber training or patient counseling. These safety strategies are critical tools for the FDA to protect patient safety, which is why we want to help manufacturers apply these programs correctly, consistently, and efficiently.
But as I announced earlier this year as part of our Drug Competition Action Plan, we also need to make sure that REMS programs maintain their role in serving public health and don’t become a tool companies can use to delay or block competition from generic products entering the market. Today, we’re announcing that we are exploring a two-pronged approach to addressing shared REMS issues. First, we will continue to work to find ways to encourage the use of shared system REMS between all innovator and generic companies producing a drug. Second, we will explore new steps that the FDA can take to reduce the likelihood that branded drug companies can use the existence of REMS as a way to slow the entry of generic competition.

Current law requires that branded and generic companies try to reach agreement on the implementation of a single, shared system REMS rather than maintaining separate REMS for the branded drug and its generic competitor. Any generic drug application referencing a branded drug with a REMS with ETASU must use a single, shared system REMS with the innovator, unless the FDA waives that requirement and permits the generic drug to use a separate, comparable REMS program. But we know that negotiations to reach agreement on shared system REMS can take extended periods of time. This can block the timely entry of a generic competitor. I believe branded firms sometimes use these negotiations strategically, as a way to slow generic competitors.

As someone who enjoys eating out with my family and picking up the occasional take-out meal, I – like many Americans – want to know what’s in the food I eat. As FDA Commissioner, I also know that more people are eating meals away from home, and our diets are increasingly comprised of foods we get from restaurants or take-out meals. FDA is committed to leveraging nutrition to enhance health and reduce disease, and the agency soon will be announcing a broader policy effort in this area. One important step is ensuring consumers have access to reliable and actionable information about the foods they eat so that they can make more informed choices about their diets and health for themselves and their families.

But information about the foods we get in restaurants and in take-out meals isn’t consistently available. Often we’re left without good insight into how many calories we’re consuming away from our homes, or what type of nutrition we may receive. At a time when more than a third of U.S. adults are obese and more people are trying to make healthier lifestyle decisions, we know making informed choices about our diets has the potential to save and improve lives. For instance, it can help to reduce the risk of many obesity-related conditions, such as heart disease, stroke, diabetes and certain types of cancer. This is why we’re seizing the opportunity to empower Americans to more carefully consider their food choices by providing access to uniform and consistent calorie and nutrition information for foods on display, menus and menu boards.

FDA takes seriously the authority Congress granted to us in overseeing federal food labeling standards, including our mandate to make calorie information available on menus. From the outset, the agency recognized the enormity of our responsibility, not only to implement this law in a way that meets the needs of American consumers, but doing so while being pragmatic and not overly burdensome to restaurants and similar retail food establishments. In considering how and what information to make available, we have taken into account the significant variation in the ways Americans purchase foods – ranging from traditional restaurant menus to the growth in grab-and-go foods at grocery and convenience stores. Importantly, our approach also makes sure that these provisions can be efficiently implemented by restaurants and similar retail food establishments and sustained for the long run.

When FDA first proposed a rule in 2011 to address what information should be provided in menus at restaurant chains and other similar retail food establishments, the agency understood this was just the first of many steps we would need to take to ensure that our regulations would be properly and effectively implemented. FDA also recognized that striking the appropriate balance would require a dialogue with the diverse parties impacted by our requirements to ensure we fully understood and considered the various concerns, challenges, opportunities and possible consequences of our regulations. We took that obligation seriously, and as we developed the final regulations, we were informed by hundreds of comments from consumers, industry representatives and other interested parties, along with insights captured during many meetings and discussions with a broad spectrum of stakeholders.

About 1 in 5 U.S. adults used some form of tobacco product in 2015, according to new data published by the Centers for Disease Control and Prevention and the U.S. Food and Drug Administration’s (FDA) Center for Tobacco Products in the Morbidity and Mortality Weekly Report (MMWR).

This is the first time CDC, in coordination with FDA, has used the National Health Interview Survey (NHIS) to assess the range of different tobacco products used by U.S. adults. The survey has been used to assess current (“every day” or “some day”) cigarette smoking among U.S. adults since 1965, but ongoing surveillance of other tobacco products began more recently.

About 42 million adults – more than 87 percent of the nation’s nearly 49 million tobacco product users – reported using a combustible product such as cigarettes, cigars, or pipes (including hookahs and water pipes). The remaining adult tobacco users reported using e-cigarettes or smokeless tobacco products such as chewing tobacco, snuff, dip, snus, and dissolvable tobacco.
“Too many Americans are harmed by cigarette smoking, which is the nation’s leading preventable cause of death and disease,” said CDC Director Brenda Fitzgerald, M.D. “CDC will continue to use proven strategies to help smokers quit and to prevent children from using any tobacco products.”

Key findings from analysis of tobacco use data
These data from the 2015 National Health Interview Survey also found that 9.5 million American adults reported “every day” or “some day” use of two or more tobacco products. Among all adults, cigarettes were the most commonly used product (15.1 percent); followed by e-cigarettes (3.5 percent); cigars, cigarillos, or filtered little cigars (3.4 percent); smokeless tobacco (2.3 percent); and pipes, water pipes, or hookahs (1.2 percent).
Use of any tobacco product varied by sex, age, race/ethnicity, U.S. region, education, marital status, annual household income, sexual orientation, health insurance coverage, disability status, and presence of serious psychological distress.

HHS Names Patient Matching Algorithm Challenge Winners

The U.S. Department of Health and Human Services’ Office of the National Coordinator for Health Information Technology (ONC) today announced the winners of the Patient Matching Algorithm Challenge.

ONC selected the winning submissions from over 140 competing teams and almost 7,000 submissions using an ONC-provided dataset.  “Patient matching” in health IT describes the techniques used to identify and match the data about patients held by one healthcare provider with the data about the same patients held either within the same system or by another system (or many other systems). The inability to successfully match patients to any and all of their data records can impeded interoperability resulting in patient safety risks and decreased provider efficiency.

“Many experts across the healthcare system have long identified the ability to match patients efficiently, accurately, and to scale as a critical interoperability need for the nation’s growing health IT infrastructure.  This challenge was an important step towards better understanding the current landscape,” said Don Rucker, M.D., national coordinator for health information technology.

DOJ: Department of Justice Announces Significant Tool in Prosecuting Opioid Traffickers in Emergency Scheduling of All Fentanyls

The Department of Justice today announced that the Drug Enforcement Administration (DEA) intends to take immediate action against the flow of illicit fentanyl analogues into this country and the alarming increase in overdose deaths linked to synthetic opioids by scheduling all fentanyl-related substances on an emergency basis.
When the DEA’s order takes effect, anyone who possesses, imports, distributes, or manufactures any illicit fentanyl analogue will be subject to criminal prosecution in the same manner as for fentanyl and other controlled substances.  The action announced today will make it easier for federal prosecutors and agents to prosecute traffickers of all forms of fentanyl-related substances.  
 “President Trump has made it a cornerstone of his presidency to combat the deadly drug crisis in America, and today the Department of Justice is taking an important step toward halting the rising death toll caused by illicit fentanyls in the United States,” said Attorney General Jeff Sessions.  “By scheduling all fentanyls, we empower our law enforcement officers and prosecutors to take swift and necessary action against those spreading these deadly poisons.  I also urge the many members of Congress who clearly share our concern and alarm over fentanyl’s role in our opioid overdose epidemic to do their part by permanently scheduling these lethal substances.”

OLYMPIA -- The Washington State Department of Health has taken disciplinary actions or withdrawn charges against health care providers in our state.
The department’s Health Systems Quality Assurance Division works with boards, commissions, and advisory committees to set licensing standards for more than 80 health care professions (e.g., medical doctors, nurses, counselors).
Information about health care providers is on the agency website. Click on “Look up a health care provider license” in the “How Do I?” section of the Department of Health website (doh.wa.gov). The site includes information about a health care provider’s license status, the expiration and renewal date of their credential, disciplinary actions and copies of legal documents issued after July 1998. This information is also available by calling 360-236-4700. Consumers who think a health care provider acted unprofessionally are encouraged to call and report their complaint.

DOJ: New Orleans Woman Convicted for Role in $3.2 Million Medicare Kickback Scheme

A federal jury found a New Orleans woman guilty today for her role in an approximately $3.2 million Medicare fraud and kickback scheme.
Acting Assistant Attorney General Kenneth A. Blanco of the Justice Department’s Criminal Division, Acting U.S. Attorney Duane A. Evans of the Eastern District of Louisiana, Acting Special Agent in Charge Daniel Evans of the FBI’s New Orleans Field Office and Special Agent in Charge C.J. Porter of the U.S. Department of Health and Human Services Office of Inspector General’s (HHS-OIG) Dallas Field Office made the announcement.
After a three-day trial, Sandra Parkman, 61, was convicted of one count of conspiracy to commit health care fraud, one count of conspiracy to pay and receive kickbacks, two counts of health care fraud and five counts of accepting kickbacks.  Sentencing is scheduled for Jan. 17, 2018, before U.S. District Judge Kurt D. Engelhardt of the Eastern District of Louisiana, who presided over the trial.
According to evidence presented at trial, from 2004 to 2009, Parkman and others engaged in a scheme to provide medically unnecessary durable medical equipment, including power wheelchairs, to Medicare beneficiaries in and around New Orleans.  The evidence showed that Parkman received kickback payments from the equipment supply company in return for providing eligible Medicare beneficiaries’ personal information to the company, as well as to obtain physican signatures on order forms.
As a result of the scheme, Parkman’s co-defendant, Tracy Richardson Brown, caused Medicare to pay over $3.2 million based on those illegally obtained referrals, the evidence showed.
Brown was previously convicted following a trial in June 2016 and was sentenced to 48 months in prison.
This case was investigated by the FBI and HHS-OIG.  Trial Attorneys Kate Payerle and Jared Hasten of the Criminal Division’s Fraud Section are prosecuting the case.
The Fraud Section leads the Medicare Fraud Strike Force, which is part of a joint initiative between the Department of Justice and HHS to focus their efforts to prevent and deter fraud and enforce current anti-fraud laws around the country.  The Medicare Fraud Strike Force operates in nine locations nationwide.  Since its inception in March 2007, the Medicare Fraud Strike Force has charged over 3,500 defendants who collectively have falsely billed the Medicare program for over $12.5 billion.


Justice Department Sues Northwest Trustee Services, Inc. in Bellevue, Washington, for Illegally Foreclosing on Homes of at Least 28 Servicemembers

The U.S. Department of Justice today filed a lawsuit in U.S. District Court for the Western District of Washington, alleging that Northwest Trustee Services, Inc. (Northwest) violated the Servicemembers Civil Relief Act (SCRA).  The complaint alleges that since 2010, Northwest completed foreclosures on at least 28 homes owned by servicemembers without obtaining the required court orders.

The SCRA protects the rights of servicemembers on active duty by suspending or modifying certain civil obligations.  The law prohibits foreclosing on the home of a servicemember during active military service and one year thereafter without a court order if the mortgage originated prior to the servicemember’s period of military service.
 The department launched an investigation into Northwest’s practices after United States Marine veteran Jacob McGreevey of Vancouver, Washington, submitted a complaint to the department’s Servicemembers and Veterans Initiative in May 2016.  Northwest had foreclosed on McGreevey’s home in August 2010, less than two months after he was released from active duty in Operation Iraqi Freedom.  McGreevey sued both PHH Mortgage (his mortgage servicer) and Northwest in 2016, but a U.S. District Court Judge accepted PHH and Northwest’s argument that McGreevy had waited too long to file his case, and dismissed the case on that basis.  The department’s investigation revealed that, in addition to McGreevey, NWTS had foreclosed on other homes of SCRA-protected servicemembers in violation of the SCRA since 2010.
“As we reflect this Veterans Day on the great debt we owe to those who have fought so hard for our freedom, we also reaffirm our commitment to protecting the rights of those who serve,” said Acting Assistant Attorney General John M. Gore of the Justice Department’s Civil Rights Division.  “Our men and women in uniform make immense personal sacrifices to keep our country safe.  Losing their home to an unlawful foreclosure should not be one of them.”
 “The loss of a home is a devastating blow for anyone – but far worse for active duty service members often called to war zones far from Western Washington,” said U.S. Attorney Annette L. Hayes. “Our investigation revealed that Northwest Trustee Services repeatedly failed to comply with laws that are meant to ensure our service members do not have to fight a two front war – one on behalf of all of us, and the other against illegal foreclosures.  My office will continue to work closely with our colleagues in the Civil Rights Division in Washington, D.C. to protect Western Washington service members from this kind of misconduct.”
In addition to monetary damages for affected servicemembers, the SCRA provides for civil monetary penalties of up to $60,788 for the first offense and $121,577 for each subsequent offense.  The department will also seek injunctive relief to prevent future foreclosures that violate the SCRA.

Former Department of Veterans Affairs Employee Indicted on Charges of Wire Fraud, Bribery and Theft

A federal grand jury sitting in the District of Columbia returned an indictment yesterday charging a former Department of Veterans Affairs (VA) official with a scheme to steal benefit money for veterans in need from the VA.
Acting Assistant Attorney General Kenneth A. Blanco of the Justice Department’s Criminal Division made the announcement.
Russell M. Ware, 39, of Upper Marlboro, Maryland, was charged with four counts of wire fraud in connection with a scheme to steal more than $66,000 from the VA.  Ware was also charged with one count of bribery and one count of theft of government property.
According to the indictment, between September 2013 and May 2014, Ware devised a scheme to steal more than $21,000 in VA disability benefit money, which he had wired to his own bank account.  The indictment further alleges that from October 2014 to February 2015, Ware directed additional disability benefits totaling almost $46,000 to a friend, Jacqueline Crawford, 33, of Gulfport, Mississippi, who was not entitled to receive the money.  Crawford then kicked back more than $13,000 to Ware, at Ware’s direction, usually through the use of Walmart2Walmart money transfers.  Crawford pleaded guilty in February 2017, to an information charging her with a single count of theft of government property related to the scheme, and is awaiting sentencing.

A business owner was charged by a federal grand jury in Boston, Massachusetts, with attempting to obstruct the internal revenue laws, aiding and assisting in the filing of fraudulent corporate, personal, and employment tax returns, tax evasion, and structuring financial transactions, announced Acting Deputy Assistant Attorney General Stuart M. Goldberg of the Justice Department’s Tax Division.
According to the indictment, Nicholas Boulas, of North Reading, owned and operated Nick’s Painting Service Inc. (NPS), which provided painting services to residential and commercial customers in the Boston area.  From 2009 through 2014, Boulas allegedly concealed approximately $4 million in business receipts by cashing approximately $2.7 million in checks and directing a substantial number of customers to write checks to him personally, which he cashed and deposited using multiple personal bank accounts.  According to the indictment, he structured cash transactions to involve less than $10,000 in currency in order to evade the banks’ reporting requirements – banks are required to file reports with the U.S. Treasury for transactions involving more than $10,000 of currency, conducted by or on behalf of the same person on the same day.

Two stories this week that are related mostly having to do with the issue with fluoridation in the Peninsula Daily News regarding the election results that wasn't to surprising.

Fluoridation opponents spent little time basking in victory over a Nov. 7 general election advisory ballot that recommends the city's municipal water supply should stay unfluoridated, which it has been since August 2016.
They want the Port Angeles City Council to guarantee fluorosilicic acid will stay out of the water by passing a resolution making it so, anti-fluoridation activist Mike Libera said Wednesday

"  Of course it was worth it. It was a great strategy. We got rid of fluoride. Our Water, Our Choice! chair Eloise Kailin of Sequim called the change in government a solution in a Jan. 22 Peninsula Daily News interview. We think now that the change of government is not necessary, she said Wednesday."

Editorial Comment: I knew when the issue of fluoridation was placed on the ballot, that many would see the issue of changing the form of government would be a pointless venture, since the voters repeated their disdain for fluoride in their our water supply, after a citizen advisory vote by utility customers were ignored by the current city council, that lead to the three ring circus all last year of ethics complaints, and the bright idea of changing the government structure. I imagine many like me who signed that petition to change the government, changed their minds and voted against it. From what I read many of the anti fluoride folks changed their minds also regarding changing a second class city. Now, the question is will the city honor the decisions of the voters to be rid of fluoridation for good? Is it any wonder there are called to have a resolution to that effect, after they ignored the will of the people on that citizen advisory vote last year?
