WHEREAS, on August 19, 2020, I issued Proclamation 20-68, proclaiming a State of Emergency for all counties throughout the state of Washington as a result of the impacts on the people of Washington of multiple wildfires that have occurred throughout the state; and

WHEREAS, there were a large number of wildfires throughout Washington State this fire season, caused in part by unusually hot and dry conditions this summer and exacerbated by a historic wind event in early September that brought high winds from the east to the west, and elevated temperatures and windy conditions throughout the State that continued

through most of September; and

WHEREAS, in September alone, in excess of 640,000 acres of land burned, destroying hundreds of homes, businesses, agricultural interests, and public and private infrastructure; and

WHEREAS, the effect of these fires continues to impact the life and health of our citizens, as well as the property and transportation infrastructure of Washington State and is a public disaster that affects life, health, property, or the public peace; and

WHEREAS, under RCW 74.04.660(6), during a state of emergency, the Governor is authorized to extend eligibility for benefits under the Family Emergency Assistance Program to individuals and families without children; and

WHEREAS, the property damage caused by the wildfires has caused economic hardship on individuals and families without children who usually would not be eligible for the Family Emergency Assistance Program in RCW 70.04.660; and

WHEREAS, as a result of the economic impacts of the global COVID-19 pandemic on Washington State, many families have received benefits under the Family Emergency Assistance Program, established by the Department of Social and Health Services under

RCW 74.04.660; and WHEREAS, under RCW 74.04.660, households are only eligible for Family Emergency

Assistance Program once in a 12-month period and therefore, households who already received Family Emergency Assistance Program for COVID-19 related issues would not be eligible for aid related to wildfires in the same 12-month period unless that statutory provision is waived; and

WHEREAS, the provisions of RCW 74.04.660 have already been extended to families without children in proclamations related to the COVID-19 pandemic, specifically Proclamations 20-18, 20-52, 20-65 and 20-66; and

WHEREAS, on September 10, 2020, I issued Emergency Proclamation 20-72, which clarified that the statutory waiver in RCW 74.04.660 is applicable to families with or without children who are suffering economic impacts from Washington’s wildfires and also waived statutory language in RCW 74.04.660(2) limiting eligibility for aid to one period of time during a twelve-month period; and

WHEREAS, on October 2, 2020, in Emergency Proclamation 20-72.1, I extended the statewide wildfire state of emergency, 20-68, as well as the provisions of 20-72 through 11:59 p.m. on October 10, 2020; and

WHEREAS, although fire activity has diminished and there is no longer an emergency situation with respect to firefighting, the aftermath of the fires continues to impact the life and health of our citizens, as well as the property and transportation infrastructure of Washington State, and is a public disaster that affects life, health, property, or the public peace.

NOW, THEREFORE, I, Jay R. Inslee, Governor of the state of Washington, as a result of the continuing impacts of the wildfires and under RCW 38.08, 38.52 and 43.06, do hereby proclaim that a state of emergency continues to exists in all 39 counties, and that the declaration of emergency in Proclamation 20-68 remains in effect as it relates to the continuing impacts of the wildfires, and that Proclamations 20-68 and 20-72 are hereby amended to extend them until 11:59 p.m. on November 9, 2020.

I again direct the plans and procedures of the Washington State Comprehensive Emergency

Management Plan be implemented. State agencies and departments are again directed to

utilize state resources and to do everything reasonably possible to assist affected political

subdivisions in an effort to respond to and recover from the event. My order into active

state service of the Washington State organized militia also remains in effect. The Washington State Emergency Operations Center is instructed to continue monitoring the

event and coordinating all event-related assistance to the affected areas.

WASHINGTON DC – U.S. Senators Maria Cantwell (D-WA) and Patty Murray (D-WA) joined Oregon Senators Ron Wyden (D-OR) and Jeff Merkley (D-OR), New York Senators Chuck Schumer (D-NY) and Kirsten Gillibrand (D-NY), and Senator Tom Carper (D-DE), the top Democrat on the Environment and Public Works Committee, in a letter this week to Environmental Protection Agency (EPA) Administrator Andrew Wheeler requesting information about EPA’s implementation of the White House memorandum ordering federal agencies to withhold federal funds from cities that President Trump falsely claims are being run by “anarchists.”

“We have learned that EPA, in its internal meetings related to the policy, has begun to identify funding sources that could be subject to the directive, some of which are vital for the provision of safe drinking water and the remediation of contamination,” the senators wrote. “Setting aside the legally questionable and abhorrent nature of the President’s directive, EPA’s implementation thereof could endanger human health and the environment.”

More than $1 billion of recent EPA funds to Seattle, Portland, New York City, and Washington, D.C. could be at risk if EPA were to implement the White House memorandum. In their letter, the senators cited multiple examples of funding the EPA may seek to halt, deny, or rescind as a result of President Trump’s directive. These include a $192,200,000 Water Infrastructure Finance and Innovation Act (WIFIA) loan that the city of Seattle received to reduce combined sewer overflows, and as well as $27,914,000 awarded to the state of Washington in FY 2020 for the Clean Water State Revolving Fund, and $24,598,000 for the Drinking Water State Revolving Fund.

“We strongly urge you not to take any action that could result in the collective loss of more than a billion dollars of funding intended to clean up contamination and drinking water in these American cities,” the senators continued. “To do so would be antithetical to EPA’s mission of protecting human health and the environment.”

The senators requested that EPA provide an initial response no later than October 9, 2020.

Kilmer Introduces Bipartisan Legislation to Support Disabled Veterans

Tacoma, WA – Today, U.S. Representative Derek Kilmer (WA-06), along with Representatives Gerald E. Connolly (VA-11) and Brian Fitzpatrick (PA-01), introduced new bipartisan legislation to help ensure disabled veterans are able to fully utilize their benefits amid disruptions in veterans’ health care during the COVID-19 pandemic.

In March 2020, the COVID-19 pandemic caused many Veterans Affairs (VA) health care facilities to cancel or delay non-emergency in-person appointments, including a significant amount of the elective/non-essential medical procedures. Now, as VA facilities begin to work through a backlog of nearly six months of cancelled or re-scheduled appointments, many disabled veterans are at risk of not being able to fully utilize their benefits due to previously rules limiting disabled veteran leave. The Disabled Veteran Leave Extension/Restoration Act will extend the ability of veterans to use their disabled veteran leave and restore leave that has already been lost.

“Our veterans should receive the benefits they have earned and deserve – even in a pandemic,” said Rep. Kilmer. “That’s why I’m proud to introduce bipartisan legislation to ensure that our nation’s disabled veterans are able to take the leave they’ve earned to get the care they need. I’ll keep working to ensure all of our veterans have access to adequate and affordable care.”

“The pandemic has presented challenges to all Americans, particularly our veteran community. We need to make sure we provide flexibility to these heroes so they do not lose access to the leave they have earned and are entitled to. I thank Mr. Kilmer for his leadership on this issue,” said Rep. Connolly.

“Our veterans put their lives on the line for our country, and many returned home with lasting injuries. They deserve all the help that we can provide them,” said Rep. Fitzpatrick. “Allowing disabled veterans to take leave for medical treatment would allow them to live happier, healthier lives. These men and women sacrificed so much to defend our freedoms, and I am proud to support them with this bipartisan, commonsense legislation.”

In 2015, Congress passed the Wounded Warriors Federal Leave Act into Law. This legislation created “disabled veteran leave,” to any new Federal employee who is a veteran with a service-connected disability rated at 30 percent or more for purposes of undergoing medical treatment for such disability for which sick leave could regularly be used. Disabled veteran leave is available during the first 12 months of employment and may not exceed 104 hours. Disabled veteran leave not used during the first 12 months of employment may not be carried over to subsequent years and will be forfeited. Because many veterans have not been able to use their leave during the pandemic, under current law, they will lose it.

The Federal Worker Leave Fairness Act will:

Extend Disabled Veteran leave to 24 months to any Veteran who entered the program between March of 2019 – June of 2021.

Restore any leave that has already been lost to any Disable Veteran who entered the program in March of 2019 or later. This leave will be extended to 24 months from the original leave start date.

The Disabled Veteran Leave Extension/Restoration Act is supported by the Federal Managers Association (FMA), International Federation of Professional and Technical Engineers (IFPTE), and the National Active and Retired Federal Employees Association (NARFE).

“The Federal Managers Association is proud that an FMA member conceived the idea that led to the creation of disabled veteran leave for the federal workforce. Regrettably, Covid-19 has prevented many eligible feds from benefitting from this leave. Congressman Kilmer’s legislation would protect and restore this leave to the brave disabled veterans who have earned it but would otherwise lose it due to the pandemic,” said FMA National President Craig Carter. “We are grateful for Congressman Kilmer identifying this issue and introducing this reasonable and fair solution. Protecting disabled veteran leave for the men and women who have dedicated their lives and careers to our country is honorable and commendable. Congressman Kilmer is a steadfast advocate for the employees at Puget Sound Naval Shipyard and feds across the country. FMA enthusiastically supports this legislation and will work with Mr. Kilmer and his office to get this important bill passed and signed into law.”

(Washington, D.C.) – On a conference call with reproductive health advocates and patients from Washington state, U.S. Senator Patty Murray (D-WA), the top Democrat on the Senate health committee, highlighted Supreme Court nominee Judge Amy Coney Barrett’s extreme opposition to health care reform and reproductive health care, and discussed the threat her nomination would pose to laws and policies enshrining affordable health care, protections for pre-existing conditions, and access to safe, legal abortion. The news conference call came after reports that Senate Republicans are planning to move forward with their plans to try and jam Judge Barrett on to the Supreme Court in a rushed process, in spite of Republican Senate Majority Leader Mitch McConnell’s decision to adjourn the Senate following some of its members—including members of the Senate Judiciary Committee—announcing they had contracted COVID-19.

“This is such a critical time in our nation for so many people, on so many levels,” Senator Murray said in opening remarks during the conference call. “It is … important to keep raising our voices against Senate Republican’s blatant hypocrisy and indifference in trying to rush and fill Justice Ginsburg’s seat on the Supreme Court.”

“There is no question President Trump chose Judge Barrett because he believes she would rule to strike down health care for families across the country, end protections for pre-existing conditions and end safe, legal abortion in this country—this has been his whole judicial agenda from the start,” Senator Murray added.  

During the discussion, Senator Murray heard from Jennifer Allen, CEO of Planned Parenthood Votes Northwest and Hawai’i about the offensive and dire consequences facing women and families if Judge Barrett is appointed to fill Justice Ginsburg’s Supreme Court seat and votes to overturn Roe v. Wade and other vital rights, as well as two women from Washington state who shared their personal stories about the importance of having access to reproductive health care and their fears regarding how Judge Barrett and a conservative Supreme Court majority would rule on important cases impacting health care and more. Gov. Jay Inslee today announced several updates to Washington's Safe Start reopening plan. The changes seek to align guidance and adjustments to regulations of several industries.

"We’re doing this now because we have had ongoing conversations with businesses about how to do these activities safely," Inslee said at a press conference Tuesday. "Instead of tightening restrictions, we can roll some more back to allow safer operation of these activities. Here in Washington, we know the threat of COVID is real and we take it seriously. It is safety, and public health, that come first before anything else in this unprecedented time."

Following a spike in COVID cases in July, Inslee announced a pause to the Safe Start reopening plan. With today’s announcement, all 39 counties will remain in their current phases, but the governor’s announcement allows for more activity in some of the phases.

Gov. Jay Inslee released a statement today on President Trump’s tweet downplaying the threat of COVID-19.

“The president’s reckless comments reflect exactly the same nonsense thinking behind his failed pandemic response that increased the risk of COVID, a virus that has caused 210,000 deaths in the United States already — and hundreds more each day. He hasn’t learned a thing. Since he tested positive for COVID, more than 2,000 additional Americans have died and downplaying this danger is the best he can do?

“His only statement now should be an acknowledgement that COVID is dangerous; that he was wrong when discouraging the use of masks and wrong to mock the experts. He certainly should not be telling people there isn’t anything to worry about.

“It is easy for him to downplay the dangers when he has access to medical care that others don’t have. President Trump has made it clear that the states are on their own. 

“But I am confident that Washingtonians will continue to mask up because we care for each other. Unlike Donald Trump, we realize that wearing a mask is a strength, a sign that we care about families and others around us.

Cantwell Leads Bicameral Letter Outlining Deficiencies in Trump Administration Plan to Log Pristine Tongass National Forest.

WASHINGTON, DC – Today, U.S. Senators Maria Cantwell (D-WA) and Debbie Stabenow (D-MI) and U.S. Representatives Ruben Gallego (D, AZ-07) and Raul Grijalva (D, AZ-03) led a bicameral group of lawmakers in sending a letter to U.S. Secretary of Agriculture Sonny Perdue blasting the administration’s decision to strip protections from protected areas of the Tongass National Forest in Alaska. The decision will allow logging of thousands of acres of old-growth forests and cost taxpayers millions in subsidies. The lawmakers’ letter comes after Cantwell released a statement slamming the Trump administration’s move last week, calling it “environmental corruption.”

“We write today in opposition to the Final Environmental Impact Statement (FEIS) that your Department has released, indicating it will fully exempt the Tongass National Forest from protections under the Roadless Area Conservation Rule. We urge an indefinite delay or reversal of this decision, which will in effect remove existing protections from more than 9 million acres of National Forest System land with established climate mitigation potential and open new areas to logging, roadbuilding, and other industrial development,” the members wrote.

The members’ letter blasts the administration for failing to consult with and listen to the concerns of Alaska Native Tribes that have repeatedly requested meetings to discuss their concerns about the rulemaking and how it will impact their homelands. It also cites economic forecasts and scientific consensus to highlight the severe consequences and limited benefits of the administration’s decision:

“An Alaska Roadless Exemption could actually harm important industries,” the members wrote. “The FEIS itself predicts that logging and timber jobs would not increase as a result of the change, while fishing and tourism, the primary economic drivers of the region, would suffer under such a rule change.”

“Scientists have repeatedly urged maintaining protection for this largely intact, temperate rainforest. The Tongass would rightly be managed as America’s climate forest because of the Tongass’ critical capacity for carbon storage and climate change mitigation. The protection of these lands for their conservation value also supports healthy populations of salmon and other wildlife essential to the people of the region. There is no justification for such an abrupt departure from the long-standing and successful application of the Roadless Rule in the Tongass. Roadless protections in Southeast Alaska support the values most important for the people of the region, the nation, and the world,” the letter continues.

Senator Cantwell has long been the leading Senate champion to protect the 2001 Roadless Rule, which limits costly roadbuilding and destructive logging on roadless landscapes across the National Forest System. The rule helps protect hunting and fishing opportunities, provide critical habitat for 1,600 threatened or endangered species, lessen wildland fire risk, and supply clean drinking water to millions of Americans in 39 states and more than 350 communities across the United States.

In May 2019, Cantwell reintroduced her legislation to codify the 2001 Rule into law along with Senator Tom Udall (D-NM), ranking member of the Senate Appropriations Subcommittee on Interior, Environment, and Related Agencies, and Senator Ron Wyden (D-OR), ranking member of the Senate Energy and Natural Resources Subcommittee on Public Lands, Forests, and Mining, and 16 other Senate cosponsors.

In July 2019, Senator Cantwell led a bicameral letter to Agriculture Secretary Purdue expressing concerns over the rulemaking process, the lack of adequate consultation with local stakeholders, and urging the Department to schedule additional scoping meetings in other areas of the country, like Seattle. And in August 2019, she blasted the administration over its decision to move forward with eliminating protections for the Tongass.

Dear Secretary Perdue:

We write today in opposition to the Final Environmental Impact Statement (FEIS) that your Department has released, indicating it will fully exempt the Tongass National Forest from protections under the Roadless Area Conservation Rule. We urge an indefinite delay or reversal of this decision which will in effect remove existing protections from more than 9 million acres of National Forest System land with established climate mitigation potential and open new areas to logging, roadbuilding, and other industrial development.

From the start of this process it has been clear that the effort to carve out an Alaska Roadless Rule (Alaska Roadless Exemption) would not be based on science or facts. For decades, Southeast Alaska communities have fought for stability and certainty in the management of the Tongass, but that was all upended when USDA agreed to pursue this rulemaking on a political whim. The timing, the process, and the outcome are badly misguided and ignore the input and opposition of Alaska Natives, the American public, and Members of Congress.

The decision to rush an Alaska Roadless Exemption only serves to open a fresh round of controversy and conflict over a highly contentious issue that the agency and the region had previously put behind them. Additionally, to do so during a global pandemic places an undue and ill-conceived burden on the people of Alaska, businesses, and government officials who would prefer to devote themselves to other, far more pressing matters. We do not believe that the process leading to this point followed the spirit or letter of the law, leaving little recourse except for the fate of the Roadless Rule in the Tongass to be decided by an act of Congress or in the courts.

One of our top concerns is that the decision to push ahead with the FEIS for the Alaska Roadless Rulemaking during the pandemic violated your responsibility to properly consult with Alaska Native Tribes that live in the Tongass. Throughout the pandemic the Trump administration has repeatedly refused to be subject to Congressional oversight unless those meetings were held in person. Yet, the United States Forest Service (USFS) denied native Tribes in Southeast Alaska their requests for the agency to hold face-to-face, government-to-government consultations and subsistence hearings prior to finalizing the FEIS. Under the law and binding agency guidance, and out of simple respect, USFS has an obligation to conduct such meetings in person. There is no urgent need to move forward with this rulemaking. In consideration of the health and welfare concerns of tribal villages the agency should have postponed work on the Final Environmental Impact Statement until it was safe to hold such meetings.

As you are also aware, nine of Southeast Alaska’s sovereign Tribes have recently come together to petition the USDA under the Administrative Procedures Act (APA) for the creation of a Traditional Homelands Conservation Rule to better protect the traditional and customary uses of the land and their cultural survival. Considering that the Alaska Roadless Exemption has been promulgated in response to a similar APA petition filed by the State, we would expect the USDA to give the same weight and consideration to this petition from tribal governments. Although the Traditional Homelands Conservation Rule petition requests a rule that is separate from and in addition to the Roadless Rule, an Alaska Roadless Exemption would negatively affect efforts to conserve traditional homelands in the Tongass. Therefore, USDA should not finalize an Alaska Roadless Exemption while a related petition from tribal governments is still pending. We urge postponement of the Alaska Roadless Exemption until sometime in the future in order to allow for in-person meetings with the Tribes regarding the traditional homelands petition and government- to-government consultation on the Alaska Roadless Exemption.

The Forest Service not only has a duty to listen to Native Tribes, but at a time of nationwide crisis has a responsibility to prioritize projects that can put Americans to work restoring our forests, supporting public lands and outdoor recreation, and helping Indigenous communities prepare for climate change. The fact that the Forest Service has spent millions on this rulemaking while other priorities in the Tongass and elsewhere have faltered makes it clear that no substantial reason for abandoning the Roadless Rule has been identified, let alone an urgent one. An Alaska Roadless Exemption could actually harm important industries. The FEIS itself predicts that logging and timber jobs would not increase as a result of the change, while fishing and tourism, the primary economic drivers of the region, would suffer under such a rule change.

Moreover, in the current economic circumstances, there is no realistic near-term probability of demand for Tongass logs or funding for new logging roads. Even before the pandemic, in part due to the administration’s disastrous trade policies, the Tongass was selling virtually no timber and the Forest Service was subsidizing the remaining Tongass timber industry at the rate of $30 million per year. That is why fiscal conservatives are overwhelmingly opposed to this exemption, including groups such as Taxpayers for Commonsense, Citizens for the Republic and National Taxpayers Union.

In addition, contrary to the Forest Service’s assertions, the rulemaking is not needed to allow road- building, hydroelectric, or other projects to move forward in the Tongass. The Forest Service has a long track record of expeditiously granting requests for projects, including building roads, under the Rule’s existing exemptions. During the rulemaking process alone, USFS has approved four of these projects.

We also believe the FEIS has failed to fully analyze the impacts of an Alaska Roadless Exemption. Scientists have repeatedly urged maintaining protection for this largely intact temperate rainforest. The Tongass would rightly be managed as America’s climate forest because of the Tongass’ critical capacity for carbon storage and climate change mitigation. The protection of these lands for their conservation value also supports healthy populations of salmon and other wildlife essential to the people of the region. There is no justification for such an abrupt departure from the long-standing and successful application of the Roadless Rule in the Tongass. Roadless protections in Southeast Alaska support the values most important for the people of the region, the nation, and the world.

All of this, unsurprisingly, has led to bipartisan opposition to this irrational exemption. Forest Service data shows essentially no public support for dropping the Rule on the Tongass, with less than 1% of hundreds of thousands of commenters favoring that approach. In the last two fiscal years House-passed Interior and Environment Appropriations bills have limited funding for new logging roads in the Tongass, while bicameral legislation has been introduced to codify the protections afforded under the 2001 Roadless Rule, including in the Tongass National Forest.

For all these reasons and numerous others, we firmly disagree with the administration’s conclusions in the FEIS seeking to justify an Alaska Roadless Exemption and urge this administration to reverse course. Should you choose to finalize the Alaska Roadless Exemption we request a reply to this letter with detailed responses to each of the several inadequacies we’ve identified and a clear rationale for the proposed exemption along with the FEIS analysis supporting it. We also ask that your reply include a written explanation for the Department’s decision to move forward with this FEIS and any Record of Decision at a time of nationwide emergency and grave uncertainty while omitting in-person consultation with all affected Tribes. Additionally, we request that your response include your full analysis of the economic impact of an Alaska Roadless Exemption, and any correspondence and documents regarding contracts, grants, and costs associated with the rulemaking. We are prepared to use the congressional tools available to us, including oversight hearings, appropriations restrictions, and legislation, to rein in further misuse of the authority and responsibility entrusted to your Department for the long- term welfare of the forests of the American people.

An economically sustainable, collaborative, and science-based management policy for the National Forest System depends on maintaining strong Roadless Rule protections, especially in the Tongass National Forest. Thank you for your consideration.

With Health Care and Reproductive Rights at Stake, Senator Murray Launches Story Drive to Help Washingtonians Speak Out Against Republicans’ Rushed SCOTUS Nomination

(Washington, D.C.) –Today, U.S. Senator Patty Murray (D-WA), ranking member of the Senate Committee on Health, Education, Labor and Pensions, launched a new website to gather and lift up stories from Washingtonians about what is at stake for them if Republicans rush through the nomination of Judge Amy Coney Barrett and put another anti-health care and anti-reproductive rights Justice on the Supreme Court.

“Democrats are going to do all we can to fulfill Justice Ginsburg’s last wish, and make sure people are heard as they reject Republican efforts to ignore the pandemic and jam the Supreme Court with another far-right Justice who would gut health care and take away access to safe, legal abortion in our country.

“Women, men, and patients across the country are standing up, and speaking out to share powerful personal stories about what is at stake for their health care and rights, their families, and their futures—and I’m fighting to make sure the people speaking out in Washington state have a megaphone, so President Trump and his party have no choice but to stop and listen,” said Senator Murray.

With the launch of her new website, Senator Murray urged constituents to join in Democrats’ fight against President Trump’s far-right nominee Amy Coney Barrett, whose troubling record and past writings confirm that she is committed to gutting health care through the courts and ending the right to safe, legal abortion in the United States. Senator Murray’s website will help gather Washingtonians’ stories about living with a pre-existing condition, how the Affordable Care Act impacted them, and the importance of protecting the right to safe, legal abortion and women’s reproductive rights.
