Senator Murray to GSA Administrator: Put Our Nation’s Health and Safety Ahead of Political Loyalty and Begin a Formal Transition Immediately.

(Washington, D.C.) – Today, Senator Patty Murray (D-WA), the top Democrat on the Senate Health, Education, Labor, and Pensions (HELP) Committee, called on General Services Administration (GSA) Administrator Emily Murphy to put politics aside and begin a formal transition of power to provide President-elect Joe Biden and Vice President-elect Kamala Harris with the resources they need to combat COVID-19. In a letter, Senator Murray stressed that Administrator Murphy’s unprecedented delay is undermining critical work to keep communities safe and support students, workers, and families in Washington state and across the country during this crisis.


“You are choosing to put political loyalty ahead of public health and safety by refusing to make a determination of ascertainment to begin a formal transition of power to the President-elect,” wrote Senator Murray to Administrator Murphy.


“By delaying the start of the formal transition, you are impeding the ability for the incoming administration to receive access to resources and personnel. Such a delay could hamper the federal response to the COVID-19 pandemic, which has already claimed over 250,000 lives.  It is completely unacceptable to delay the critical work to save lives, improve educational opportunities for students, or ensure workers are safe and healthy and families are able to make a living during this crisis,” continued Senator Murray.


Senator Murray noted that Administrator Murphy’s continued delays have prevented President-elect Biden and his transition team from accessing current executive branch employees and resources—limiting their ability to coordinate with current officials to facilitate a smooth pandemic response—and prevented the FBI from beginning background investigations on President-elect Biden’s nominees. 


This action follows Senator Murray last week calling on Administrator Murphy to end her delay, immediately ascertain Vice President Joe Biden as President-elect and Senator Kamala Harris as Vice President-elect, and make available the transition resources that are provided by law.

OLYMPIA – The Washington State Department of Health’s (DOH) data report for today includes a backlog of cases. So, while we are reporting 6,277 new cases today, that number represents roughly three days’ worth of cases.


The message from health officials with the Washington State Department of Health has not changed: disease transmission is widespread throughout Washington state and we are at the highest risk we have been at throughout the entire pandemic. Case counts, hospitalizations, and other metrics are all increasing at this time. Washingtonians need to wear their face coverings, watch their distance by staying at least 6 feet away from persons not living in their household, and wash their hands. Do not have friends and other family inside your home for social gatherings. Social gatherings of up to 5 people outside, distanced, and wearing a face covering at all times is a safer way to connect with others. Safest is through telephone or video chats.


We are in a very dangerous time of this pandemic—health care workers, other essential workers, our elders, persons with chronic diseases, and our family and friends all need your help staying safe.

The surge in cases and testing over the last week created a backlog in the DOH data systems as reported Saturday. That backlog has been cleared as of today. To ensure we are getting positive tests in a timely fashion, DOH worked with laboratories to delay their reporting to us of the negative test results. Therefore, DOH will not be reporting daily negative test or total tests data or percent positivity at least through Monday, Nov. 30th. For the most current picture of recent trends, we recommend consulting the DOH dashboard’s epidemiologic curve tab.


“The epidemiologic curve tells the most crucial part of the story, which is that our disease transmission is skyrocketing,” says State Health Officer Kathy Lofy. “We have grave concerns about what will happen in the coming weeks if people gather at Thanksgiving, or any other time in the near future, and spread COVID-19 to their friends and loved ones.”


“COVID-19 activity is increasing throughout Washington state, leading to more cases, straining the testing sites and hospital capacity. It is more critical than ever for Washingtonians to actively help reduce the spread of this deadly virus,” says Secretary of Health John Wiesman. “Everyone should stay home as much as possible, and not congregate with people outside their immediate households, especially during the upcoming holiday. It’s important to wear face coverings when you do go out, and to seek testing if you develop symptoms or if you’ve been exposed to someone who has, or is suspected to have, COVID-19.”

The Treasury Department and IRS issue final regulations regarding like-kind exchanges of real property.

WASHINGTON – Today the Treasury Department and Internal Revenue Service issued final regulations PDF relating to section 1031 like-kind exchanges. These final regulations address the definition of real property under section 1031 and also provide a rule addressing the receipt of personal property that is incidental to real property received in a like-kind exchange.


The 2017 Tax Cuts and Jobs Act (TCJA) limited like-kind exchange treatment to exchanges of real property. As of January 1, 2018, exchanges of personal or intangible property such as vehicles, artwork, collectibles, patents, and other intellectual property generally do not qualify for nonrecognition of gain as like-kind exchanges. Also, like-kind exchange treatment applies only to exchanges of real property held for use in a trade or business or for investment. An exchange of real property held primarily for sale does not qualify as a like-kind exchange.


Under the final regulations, real property includes land and generally anything permanently built on or attached to land. In general, real property also includes property that is characterized as real property under applicable State or local law. In addition, certain intangible property, such as leaseholds or easements, qualifies as real property under section 1031. Property not eligible for like-kind exchange treatment prior to enactment of the TCJA remains ineligible. Neither the TCJA nor the final regulations change whether the properties exchanged are of like kind.



To report a like-kind exchange, taxpayers must file Form 8824, Like-Kind Exchanges, with their tax return for the year they transfer property as part of a like-kind exchange. This form helps taxpayers figure the amount of gain deferred as a result of the like-kind exchange, as well as the basis of the like-kind property received. Form 8824 also helps taxpayers compute the amount of gain they must report if cash or property that isn't of a like-kind is involved in the exchange.

This delay creates unacceptable risks to national security and pandemic response efforts as the United States passed more than 250,000 deaths, including more than 2,600 in Washington state according the state Department of Health.  


“The United States is in the midst of a pandemic that has now claimed over 250,000 lives, with the number of new cases rising daily. Our country also faces a number of ongoing threats, including physical and cyber attacks from foreign actors, violence from domestic extremists, and natural disasters such as wildfires and hurricanes,” wrote the Senators.


“The GSA Administrator’s ascertainment of a President-elect is also critical for agencies’ willingness to share information with the transition team, including classified information, as well as for the expeditious processing of security clearances for candidates for high-level national security positions. Your delay in acknowledging Vice President Biden’s status as President-elect could undermine efforts by the incoming Administration to meet the needs of the American people in a time of national emergency,” continued the Senators.


Under the Presidential Transition Act, GSA is charged with providing resources and support to the President-elect and Vice President-elect so they can be ready to govern from Day One. Administrator Murphy must complete the ascertainment process to allow the President-elect’s transition team to receive needed information from agency officials at public health and national security agencies, ensure incoming national security officials can receive background checks and access to classified information and provide federal funding and resources to support the transition process.


A smooth and efficient transition is one of the hallmarks of American democracy. With the exception of the Presidential election in 2000 and the resulting recount, ascertainment by GSA normally happens within a day after a winner is declared, including in 2008 and 2016. The bipartisan 9/11 Commission found that the shortened transition following the 2000 recount created serious vulnerabilities, including delays related to key national security appointments.

New Judicial Branch Award Highlights Innovations that Keep Courts Working and Responsive

The Washington State Board for Judicial Administration (BJA) has announced the first recipients of its new Innovating Justice Award, which recognizes leadership during the COVID crisis that promotes judicial branch innovation as well as responsiveness to race equity and access to justice issues.


The recipients of the new award provided leadership in launching task forces, developing unique programs, revamping community services, responding to significant distress and questions about racism in the criminal justice system, and in working relentlessly to maintain both safety and access to justice.


“The judicial branch has faced separate, historic challenges this year related to widespread health dangers and to soul-searching questions about race and justice,” said BJA Co-Chair Judge Gregory Gonzales of Clark County Superior Court. “In response, courts and individuals are working in uncharted waters, innovating and adapting and finding new ways to keep justice operational and responsive. The BJA wanted to recognize these efforts and we look forward to hearing about all of the creative work we don’t know about yet.”


The 2020 recipients of the BJA Innovating Justice Award include:


Washington State Supreme Court Chief Justice Debra L. Stephens for her wide-ranging and inclusive response to the COVID-19 pandemic, as well as her leadership in responding to nationwide demonstrations against racial injustice. In responding to COVID, Chief Justice Stephens instituted weekly calls with judges and court officials across the state, established a partnership with state health officials, crafted Supreme Court orders on court operations to provide information and guidance to courts, launched the Resumption of Jury Trials Work Group and then the BJA Court Recovery Task Force. In response to nationwide calls for racial justice, Justice Stephens and the members of the Supreme Court quickly issued a statement and call-to-action for courts and judicial branch members to take responsibility for eradicating bias in the judicial system, a rare statement from a sitting court. “Chief Justice Stephens has made racial equity and access to courts a constant lens through which to filter all measures adopted to deal with the immediate COVID crisis and on which to build better processes in the future,” said the letter nominating her for the award. “Her leadership has helped to make racial equity a top priority in all of our work.”


Tukwila Municipal Court for reframing its probation department in response to community comments and a concern that the department reflect collaboration and support rather than a punitive nature. Judge Kimberley Walden led the change of the probation department to the Court Support Services office, while changing the titles of probation officers to Case Managers. The Court Support Services office also provides a unique and cost-effective treatment for domestic violence offenders that was recently offered on Zoom in order to maintain the service. “We understand the impact words and the meaning of those words have on people. Judge Walden began to think about Tukwila’s operations, and changes we can make to address the concerns of the public,” said the nominating letter. “We are seeing a different response when a person is told they are being assigned a case manager in our Court Support Services division who will provide assistance and connect them to resources that will ultimately help them to stay in compliance with court orders. Their sense of relief speaks volumes. Now when they meet with their case manager they look forward to goal setting, realistic expectations, mentorship, and compassion. They also understand that consequences for most missteps will be measured and designed to promote positive outcomes.”


Benton-Franklin County Superior Court Judge Jacqueline Shea-Brown, for her leadership of the Unlawful Detainer Work Group and its development of a unique new diversion program that requires problem-solving steps and supports in advance of the legal eviction process. Only the third known program of its kind in the nation, the Eviction Resolution Program is designed to help both landlords and tenants and reduce the number of people evicted and facing homelessness, with many of these situations caused by the economic effects of the pandemic. Development of the program involved experts and advocates from many different sectors creating many new elements, and Judge Shea-Brown tirelessly coordinated and supported it all. “Judge Shea-Brown led the disparate interests represented on the Work Group to many consensus agreements, addressing issues both small and large,” said the nominating letter. “Today, judges have been trained, bench cards and related materials produced, and the Eviction Resolution Program is about to go into operation in six pilot counties. None of this could have occurred without Judge Shea-Brown’s steady and consistent leadership.”


Walla Walla County Superior Court Judge John W. Lohrmann for his determined outreach to his court’s large percentage of Hispanic court users who need interpreters, to communicate about the COVID closures and pauses, and his quick and extensive actions to make the courthouse and work of the court safe. Judge Lohrmann directed court interpreters to directly contact Hispanic court clients to explain both the changes in court operations and to provide information about COVID itself. If a court user could not be reached, Judge Lohrmann kept the hearing on the docket with interpreters so the court client would not be turned away, and in some cases he went to extensive lengths to explain the nature of COVID and why it was impacting a family’s case. Judge Lohrmann also acted immediately and extensively to install safety equipment and new procedures, and to adjust hearings with nearby Walla Walla State Penitentiary to protect the prisoners, attorneys and court staff from exposure. “Judge Lohrmann, several years ago, had the foresight to embrace technology, [which] enabled us to immediately facilitate Zoom hearings with the necessary large interactive screens and have a printer in the courtroom for exhibits, and to carry on the Court's business remotely almost immediately,” said the nominating letter. “His foresight in this regard has proven to be invaluable in many ways, but certainly, as he is retiring in this year of the pandemic, it has made all the difference in the world to so many, many people who have come before him.”

Kilmer’s Bipartisan Amendment to Boost Computer Science Apprenticeships Included in House-Passed Apprenticeship Bill

Washington, D.C. – Today, the U.S. House of Representatives passed H.R. 8294, the National Apprenticeship Act of 2020, which invests more than $3.5 billion over 5 years in expanding opportunities and access to Registered Apprenticeships, youth apprenticeships, and pre-apprenticeships. The legislation included Representative Derek Kilmer’s (WA-06) bipartisan amendment to ensure computer science youth apprenticeship, pre-apprenticeship, and apprenticeship programs are prioritized for funding through the comprehensive legislation.


“We know that apprenticeship programs are one of the most effective paths to high quality, work-based learning in America. And in today’s changing economy, it’s important to continue to find ways to prepare our kids for the jobs of the future - jobs in advanced manufacturing, health care, technology, green jobs, and computer science,” said Rep. Kilmer. “That’s why I’m proud that in addition to investing broadly in apprenticeship programs across the board, Congress included my bipartisan amendment to expand access to computer science youth apprenticeship programs. These investments will provide more 21st century job opportunities for our kids, more qualified employees for our local employers, and more economic resiliency for our communities.”


According to the U.S. Department of Labor, 94 percent of people who complete Registered Apprenticeships are employed upon completion, earning an average starting wage of above $70,000 annually. Yet, according to the most recent data, only 0.3 percent of the overall workforce in America have completed an apprenticeship.


During a time of record unemployment, the National Apprenticeships Acts of 2020 would mark the first time the National Apprenticeship system has been comprehensively updated since 1937. The bill also takes the critical first step of codifying into federal law youth and pre-apprenticeship programs, a measure that Rep. Kilmer has long supported through his own legislation - the Compete for the Future Act. The Compete for the Future Act empowers the Department of Education, with the advice of the Department of Labor, to run a prize competition that would award eligible youth and pre-apprenticeship programs with investments to expand their programs and serve more students.


According to the House Committee on Education and Labor, the National Apprenticeship Act of 2020 is expected to create nearly 1 million new apprenticeship opportunities on top of the current expected growth of the apprenticeship system. It is also expected to yield $10.6 billion in net benefits to U.S. taxpayers in the form of increased workers productivity and decreased spending on public-assistance programs and unemployment insurance.


By increasing investments in the national apprenticeship system, the National Apprenticeship Act of 2020 aims to begin to bring America’s investments in apprenticeships more in line with countries around the world. The U.S. spends only about 0.1 percent of gross domestic product (GDP) on workforce training and employment programs, while peer industrialized nations spend roughly six times as much as a share of GDP.


The legislation aims to expand the nation’s workforce development system during our nation’s deepest economic decline since the Great Depression and increase diversity within the national apprenticeship system.


The legislation is endorsed by the American Federation of Labor and Congress of Industrial Organizations (AFL-CIO), Association for Career and Technical Education (ACTE), Center for Law and Social Policy (CLASP), Healthcare Career Advancement Program (H-CAP), Jobs for the Future (JFF), Laborers' International Union of North America (LiUNA), National Electrical Contractors Association (NECA), National Skills Coalition (NSC), National Taskforce on Tradeswomen’s Issues (TWTF), North America’s Building Trades Unions (NABTU), National Urban League (NUL), and Third Way.

You have indicated that the limits on your authority do not permit the CARES Act facilities to make new loans or purchase new assets after December 31, 2020, and you have requested that we return Treasury's excess capital in the CARES Act facilities. We will work out arrangements with you for returning the unused portions of the funds allocated to the CARES Act facilities in connection with their year-end termination.
