Cantwell Secures Provision to Increase Affordable Housing Production in COVID Relief Bill

Provision could build more than 130,000 affordable homes in the next decade; more than 6,300 additional units in Washington.

WASHINGTON, D.C. – Today, U.S. Senator Maria Cantwell (D-WA) announced the inclusion of a key provision to increase affordable housing production in the COVID-19 relief bill. The provision establishes a permanent 4 percent floor under the Affordable Housing Tax Credit, which will help close the funding gap for affordable housing projects and provide more predictability and flexibility in Housing Credit financing. Cantwell’s provision could increase affordable housing production by at least 130,000 affordable homes over the next 10 years and build more than 6,300 additional affordable housing units in the State of Washington. This would create 170,000 jobs and inject $18.5 billion into the economy. The COVID-19 relief bill also includes a one-month eviction moratorium and $25 billion for rental assistance, of which Washington state will receive $508,706,000.


The Affordable Housing Tax Credit (also called the Low Income Housing Tax Credit, or LIHTC) is responsible for funding 90 percent of the federally-funded affordable housing construction in our country, and has financed over 3 million affordable homes, including nearly 75,000 in Washington state, since its creation in 1986. “Establishing the 4% floor for the Affordable Housing Tax Credit could help us build more than 6,000 additional affordable housing units in the State of Washington and more than 130,000 affordable homes across the nation in the next decade,” said Senator Cantwell. “It will help close the funding gap for affordable housing projects and provide more predictability and flexibility in Housing Credit financing, which in turn will allow developers to target more affordable rental apartments to those who need it most—including extremely-low income households. This bill is a significant step forward in the fight against the affordable housing crisis.”


When the Housing Credit was created in the Tax Reform Act of 1986, Congress set the Housing Credit rate at 4 percent for the acquisition and rehabilitation, or new development, of affordable housing financed by multifamily housing bonds. The credit rate determines how much Housing Credit equity can go into a particular project. However, the actual Housing Credit rates in the market fluctuate according to a formula related to federal borrowing rates. Cuts to federal borrowing rates have dropped interest rates to all-time lows, and as a result, the Housing Credit rates have sunk —the “4 percent” rate is now actually between 3.07 and 3.09 percent in the market.


This means that there is roughly 23 percent less equity per development than Congress originally intended, which has led to less investment in affordable housing. Providing a floor under the 4 percent Affordable Housing Tax Credit will help close the funding gap and provide more flexibility and predictability in Housing Credit financing.


More than 221,000 Washingtonian households are “extremely low-income”—meaning their incomes are at or below the poverty level or 30% of their area median income—and 72% of those households spend more than half of their incomes on housing, according to a report by the National Low Income Housing Coalition. There are only 31 available affordable rental homes for every 100 extremely low-income renter households in Washington state.


Senator Cantwell has been a longtime champion of the need for more affordable housing. In June, Cantwell introduced legislation that would preserve and expand affordable housing amid the COVID-19 pandemic and economic crisis and build more than 500,000 new affordable housing units. In 2019 she introduced the Affordable Housing Credit Improvement Act to expand and strengthen the Affordable Housing Tax Credit and better serve at-risk-and underserved communities, and she joined housing advocates around Washington state and throughout the country in a push to improve and expand the credit. And in 2018, Cantwell successfully secured a nearly $3 billion down payment toward addressing the affordable housing crisis, helping to build over 28,000 units and support an additional 32,000 jobs.

Proclamation 20-83: COVID-19 Prohibitions on Travel from Countries with 501Y.V Variant Circulation


Today Gov. Jay Inslee issued a 14-day quarantine requirement for anyone returning to Washington state after visiting the United Kingdom, South Africa and other countries where a new variant of the SARS-CoV-2 virus, 501Y.V, has been circulating.


Health experts believe this new variant may be more transmissible than other variants. The order applies to anyone who has been present in these countries within the prior 14 days. An individual is permitted to leave quarantine to perform certain essential activities (for example, seek medical treatment), provided that they avoid public transportation and ride-share services, wear a facial covering, separate themselves from other people to the greatest extent reasonably possible, and follow other appropriate social distancing measures. All individuals who are impacted by this order are strongly encouraged to be tested within seven days of returning to Washington.

Proclamation 20-25.10: Stay Safe, Stay Healthy


Gov. Inslee also updated Proclamation 20-25 and related guidance for houses of worship, weddings, and funerals. Currently, houses of worship are permitted to hold indoor services with up to 25% room capacity or 200 people, whichever is fewer.


The 200 person maximum attendance cap is being removed in response to the December 15, 2020 decision of the U.S. Court of Appeals for the Ninth Circuit in Calvary Chapel Dayton Valley v. Sisolak, which struck down Nevada’s 50-person attendance caps, interpreting the Supreme Court’s decision in Roman Catholic Diocese of Brooklyn v. Cuomo to represent a ‘seismic shift in Free Exercise law.’ 


Because the Governor believes the attendance cap will help save lives, he is converting the required 200-person cap to a recommended cap. The Governor recognizes and respects that it is the role of the courts to say what the law is. The Governor does not intend to re-impose mandatory numerical caps specific to religious services unless the Ninth Circuit or the Supreme Court clarifies the state of the law. Other minor modifications are made to align the guidance documents and the proclamation related to music and singing.

Court of Appeals Division II Moves to New Location in Tacoma January 1st

Division II of Washington State’s Court of Appeals will move from its current location in downtown Tacoma’s historic Rhodes Department Store to a new location at 909 A Street in Tacoma on January 1, 2021.


While closed to the public by emergency order until March 31st due to COVID-19, all work of the court has continued throughout the pandemic, including hearing of oral arguments broadcast via TVW, Washington’s public affairs network. Starting in January, judicial offices and administrative staff will continue the business of the court at their new location, utilizing phone, email, mail and other avenues not requiring physical entry for the general public.


Moving during a pandemic has presented its challenges. Despite this, Chief Judge Linda CJ Lee relayed, “Our Court is very excited about this new location because it will allow the court to work more efficiently and better serve the public.”

Senator Murray Negotiates Wins To Make College Affordable and Accessible to More Students.

(Washington, D.C.) – Senator Patty Murray (D-WA), the top Democrat on the Senate education committee, negotiated wins in a bipartisan, bicameral higher education proposal that will be included in the must-pass year end spending bill to make college more affordable and accessible to more students. Senator Murray successfully fought to significantly expand who is eligible for financial aid, remove barriers students face in accessing financial aid, provide financial relief for Historically Black Colleges and Universities (HBCUs), and better support working students, working families, students with low-incomes, and student parents—all of which Senator Murray has long fought for. Each year, an additional 555,000 students will be newly eligible for the Pell Grant, and 1.7 million more grant recipients will be newly eligible for the maximum Pell Grant, as a result of this legislation.


Specifically, Senator Murray secured policies that restore Pell Grant eligibility for incarcerated individuals, students who have been defrauded, and students with drug-related offenses; significantly expand who is eligible to receive Pell Grants and the maximum award; simplify the Free Application for Federal Student Aid (FAFSA); make the financial aid process easier to navigate for students experiencing homelessness and students formerly in foster care; forgive outstanding debts of HBCUs that received loans under the federal HBCU Capital Financing Loan Program; increase support for working students and families by reducing the “work penalty” threshold for financial aid; and takes steps to ensure students with low-incomes and student parents can access programs that support their basic needs.


“Every single person in this country should be able to access and afford a quality higher education—and today we move substantially closer to that goal. For too long, students who are incarcerated, students who have been defrauded by for-profit colleges, and students who have drug-related offenses have been blocked from receiving federal aid. But now, I’m incredibly pleased that these students will finally be able to access aid and begin and continue their education. And as the pandemic and economic recession has made it even more difficult for students to afford and continue college, I’m proud we have taken important strides to make our financial aid process work better—especially for students experiencing homelessness, students formerly in foster care, and working families,” said Senator Murray.


“These are important steps forward, but there’s still a lot of work to be done. I’ll keep fighting to build on this progress and make higher education more affordable, accessible, accountable, and safer for all students,” continued Senator Murray.


The bipartisan, bicameral proposal takes language from Senator Murray’s Pell Grant Preservation and Expansion Act and the Higher Education Access and Success for Homeless and Foster Youth Act, and builds on her longtime efforts to support HBCUs, tribal colleges, and minority-serving institutions, and her efforts to support students with low-incomes and student parents in order to:


Restore Pell grant eligibility for incarcerated individuals, by removing a counterproductive prohibition that has encouraged recidivism and limits incarcerated individuals’ ability to support themselves and their families upon release. Especially important during this pandemic, investing in post-secondary education for incarcerated individuals has also been shown to improve conditions inside prisons;

Restore Pell Grant eligibility for defrauded students, by resetting the clock on a student’s eligibility if they are defrauded by predatory for-profit colleges and successfully receive a borrower defense discharge; and

Restore Pell Grant eligibility for students with drug-related offenses, by repealing a 1998 prohibition on federal financial aid for college students convicted of a drug offense, which disproportionately disqualifies students of color and students with low incomes from receiving aid.

Expand eligibility for the maximum Pell Grant award, by ensuring that all families who make under 175 percent, and single parents who make under 225 percent, of the federal poverty level will receive a maximum Pell Grant.

Increase support for working students and families, by reducing the “work penalty” that many students face when working to support themselves and pay for the rising costs of college. The legislation enacts a 35 percent increase for working students and 20 percent increase for families to the income protection allowance (IPA), shielding more of their income from reducing their financial aid.

Make critical investments in our nation’s HBCUs, by forgiving the debt HBCUs have received to finance capital infrastructure projects and allowing HBCUs to redirect that spending on educating their students.

Support students with low-incomes and student parents, by requiring the Secretary of Education to notify students of their eligibility of programs that support students’ basic needs, including housing and food security and access to child care.

Remove barriers to financial aid for students experiencing homelessness and students formerly in foster care, by easing the application and determination process for becoming eligible for aid.

Gov. Jay Inslee today released a statement on Congress reaching agreement on an omnibus funding package that includes emergency relief to address the health and economic consequences of the COVID-19 pandemic.


“While it is many months overdue, I am pleased Congress has reached agreement on another coronavirus relief package. This will provide sorely-needed support for hundreds of thousands of Washingtonians who are struggling with joblessness, hunger and housing insecurity.


“This agreement averts an unemployment benefit cliff for nearly 100,000 Washingtonians at the end of this year and provides critical assistance to Washington’s industries and small businesses. It also invests in vaccine distribution, rental assistance, schools and broadband. It should be passed and signed as swiftly as possible.


“Make no mistake — this package can only be considered a down-payment on the relief needed to fully recover from this pandemic. I am disappointed that further aid for state, local and tribal governments was not included in this package despite the clear need articulated by nearly every state and governor. Cantwell-Sponsored Bipartisan NASA Authorization Bill Unanimously Passes Senate

WASHINGTON, D.C. – Today, bipartisan legislation introduced by Senator Cantwell (D-WA), the Ranking Member of the Senate Committee on Commerce, Science, and Transportation, passed the Senate by unanimous consent. The NASA Authorization Act of 2020 provides the National Aeronautics and Space Administration (NASA) the clear direction needed to advance the nation’s space initiatives and investments and assert American global leadership in the final frontier.


The State of Washington has played a key role in American space exploration since NASA was first founded. The Lunar Rover—the first and only crewed surface transportation system designed to operate on the Moon—was designed and built in Kent, WA. Three of the Kent-built Lunar Rovers remain on the Moon today. And earlier this month, NASA announced that two women from Washington—Kayla Barron and Anne McClain—were among the 18 astronauts chosen for its Artemis mission, which seeks to return humans to the Moon for the first time since 1972.


Washington state is home to more than three dozen space-related companies and over 1,400 aerospace companies. The space industry employs more than 6,200 workers in Washington and generates $1.78 billion in economic activity throughout the state. Because of the state’s leadership, Forbes in 2016 called Seattle a “silicon valley for space.”


"Congress just took a big step forward in authorizing the Artemis Program, which will send women to lead our next mission to the Moon,” Senator Cantwell said. “It also includes authorizations for continued space exploration and growing the space economy, including extending the International Space Station and supporting the lunar lander system. For more than 50 years, the State of Washington has been a leader in the space program, and with this legislation our state is poised to be a key part of NASA’s return to the Moon—maybe even with a woman from Washington taking that historic first step.”


The NASA Authorization Act of 2020 would:


Support NASA’s human spaceflight and exploration efforts to return American astronauts to the Moon and prepare for future journeys to Mars;

Leverage private sector investment to bolster human space exploration with the Artemis Program and NASA’s Human Landing System, which Blue Origin is building in Kent, WA;

Extend authorization for the International Space Station (ISS) through 2030 and direct NASA to take steps to grow the space economy;

Require the United States to maintain a continuous human presence in low-Earth orbit through and beyond the useful life of the ISS;

Support NASA’s leadership in coordinating the development of next generation spacesuits;

Support vital life and physical science research to ensure that humans can live in deep space safely;

Supports a robust space science program and directs NASA to continue developing the WFIRST astronomy mission, which NASA is developing in partnership with the University of Washington

Direct NASA to improve upon its planetary defense measures in order to protect Earth from asteroids and other near-Earth objects;

Affirm NASA’s commitment to aeronautics research by supporting a robust X-plane program as well as work on efficient propulsion concepts and advanced composites; and

Support NASA’s STEM education and workforce efforts, including authorization of NASA’s Space Grant program which provides education and training opportunities to thousands of Washington students through partnership with the University of Washington.

Single Use Plastic Bags (20-82)


This order delays implementation of a law that passed the Legislature in 2020 that was set to go into effect on January 1, 2021, relating to a statewide prohibition on retailers’ issuance of single-use plastic bags.


The governor is delaying the new law's implementation due to supply issues caused by the COVID-19 pandemic, which are affecting their ability to procure the alternative bags, including:


Increased demand for paper and thicker plastic bags, due to increased demand for takeout and groceries;

Retailers asking customers not to bring bags from home, to protect workers; and

Thicker plastic bag manufacturers transitioning their facilities to manufacture hospital gowns and other PPE.

This order is effective December 31 and it will expire at 11:59 PM on January 30, 2021 unless further extended by the Legislature.

Delaying Implementation of RCW 70A.530.020 -

Single-Use Plastic Bags

WHEREAS, on February 29, 2020, I issued Proclamation 20-05, proclaiming a State of

Emergency for all counties throughout Washington State as a result of the coronavirus disease

2019 (COVID-19) outbreak in the United States and confirmed person-to-person spread of

COVID-19 in Washington State; and

WHEREAS, as a result of the continued worldwide spread of COVID-19, its significant

progression in Washington State, and the high risk it poses to our most vulnerable populations, I

have subsequently issued several amendatory proclamations, exercising my emergency powers

under RCW 43.06.220 by prohibiting certain activities and waiving and suspending specified laws

and regulations; and


WHEREAS, the COVID-19 disease, caused by a virus that spreads easily from person to person

which may result in serious illness or death and has been classified by the World Health

Organization as a worldwide pandemic, continues to broadly spread throughout Washington State,

significantly increasing the threat of serious associated health risks statewide; and

WHEREAS, I issued Proclamations 20-25, et seq., first entitled “Stay Home – Stay Healthy,” in

which I initially prohibited all people in Washington State from leaving their homes except under

certain circumstances, and amended to “Safe Start – Stay Healthy” County-By-County Phased

Reopening, gradually relaxing those limitations based on county-by-county phasing, and on

November 16, 2020, I again amended to “Stay Safe – Stay Healthy – Rollback of County-ByCounty Phased Reopening Responding to a COVID-19 Outbreak Surge,” in response to a large

surge of new cases of COVID-19, increased hospitalizations and ongoing COVID-19 related

deaths in Washington State; and

WHEREAS, despite this guidance, positive COVID-19-related cases and hospitalizations have

been on a steady rise since early September and since the latter part of October through December

2020, COVID-19 cases have significantly increased in Washington, and COVID-19-related

hospitalizations have risen sharply, putting our people, our health system, and our economy in as

dangerous a position as we faced in March 2020; and

WHEREAS, new statute RCW 70A.530.020, which takes effect on January 1, 2021, places

limitations on retail establishments’ provision of paper and plastic bags to customers at a time

when manufacturers of reusable plastic bags that comply with RCW 70A.530.020 have

repurposed their factories to make personal protective equipment for use in response to the 

pandemic, making it difficult for retail establishments, many of which are essential businesses

such as restaurants and grocers, to purchase reusable plastic bags; and

WHEREAS, due to safe distancing requirements, there is a significant increase in consumer

demand for take-out food and groceries, both of which have increased the use of paper and plastic

bags, and other alternatives to single-use plastic bags are not available in ample quantities; and

WHEREAS, the worldwide COVID-19 pandemic and its progression in Washington State

continue to threaten the life and health of our people as well as the economy of Washington State,

and remain a public disaster affecting life, health, property or the public peace; and

WHEREAS, the Washington State Department of Health continues to maintain a Public Health

Incident Management Team in coordination with the State Emergency Operations Center and

other supporting state agencies to manage the public health aspects of the incident; and

WHEREAS, the Washington State Military Department Emergency Management Division,

through the State Emergency Operations Center, continues coordinating resources across state

government to support the Department of Health and local health officials in alleviating the

impacts to people, property, and infrastructure, and continues coordinating with the Department of

Health in assessing the impacts and long-term effects of the incident on Washington State and its

people.

NOW, THEREFORE, I, Jay Inslee, Governor of the state of Washington, as a result of the

above-noted situation, and under Chapters 38.08, 38.52 and 43.06 RCW, do hereby proclaim that

a State of Emergency continues to exist in all counties of Washington State, that Proclamation

20-05 and all amendments thereto remain in effect, and that Proclamation 20-05 is amended to

waive or suspend a statutory provision delaying a limitation on businesses that prevents, hinders

or delays necessary action in coping with the COVID-19 pandemic.

I again direct that the plans and procedures of the Washington State Comprehensive Emergency

Management Plan be implemented throughout state government. State agencies and departments

are directed to continue utilizing state resources and doing everything reasonably possible to

support implementation of the Washington State Comprehensive Emergency Management Plan

and to assist affected political subdivisions in an effort to respond to and recover from the

COVID-19 pandemic.

I continue to order into active state service the organized militia of Washington State to include

the National Guard and the State Guard, or such part thereof as may be necessary in the opinion of

The Adjutant General to address the circumstances described above, to perform such duties as

directed by competent authority of the Washington State Military Department in addressing the

outbreak. Additionally, I continue to direct the Department of Health, the Washington State

Military Department Emergency Management Division, and other agencies to identify and

provide appropriate personnel for conducting necessary and ongoing incident related assessments.

FURTHERMORE, based on the above situation and under the provisions of RCW

43.06.220(2)(g), I also find that strict compliance with RCW 70A.530.020 will prevent, hinder, or

delay the response to the COVID-19 pandemic State of Emergency under Proclamation 20-05,

and therefore, RCW 70A.530.020 is hereby waived and suspended, effective at 11:59 PM on

December 31, 2020 until 11:59 PM on January 30, 2021, or as amended or rescinded.

Violators of this of this order may be subject to criminal penalties pursuant to RCW 43.06.220(5).
