Case closed: Ferguson resolves lawsuit against chicken conspirators, bringing total to $37.7 million.

 

Ferguson used funds from chicken and tuna price-fixing cases to send checks to those most affected by conspiracies


SEATTLE — Attorney General Ferguson announced today he resolved his antitrust lawsuit against the final defendants in a sweeping conspiracy to artificially raise the price of chicken on Washington families. The remaining three defendants — House of Raeford Farms, Wayne-Sanderson Farms and Foster Farms — will pay $2.2 million, pending court approval. As a final tally, Ferguson’s broiler chicken price-fixing case involving a total of 19 defendants recovered $37.7 million.


“The corporations involved in these conspiracies cheated in order to increase their profits – and they harmed families in the process,” Ferguson said. “We did what we set out to do — hold these corporations accountable for their greed, restore a level playing field that allows all businesses to thrive, and get money back to Washingtonians most harmed.”


In December 2023, Ferguson announced the $35.5 million from this case, and $5.1 million from a similar case related to price fixing in the canned tuna industry, would be returned to consumers most harmed by the conspiracies. Following a claims process that closed June 5, the office has distributed approximately $30 million to Washingtonians. The claims administrator is processing the remaining claims.


The remaining funds will be used for future antitrust work, including the office's challenge of the proposed merger of Kroger and Albertsons. The Attorney General's Antitrust Division receives one hundred percent of its funding from successful case outcomes.


As part of all of the resolutions, the 19 companies named in the original lawsuit entered into legally binding agreements to conduct internal training and certify that they have corporate policies to ensure they follow state and federal antitrust laws. Under the terms of the consent decrees, if any of them engage in price-fixing or other anticompetitive conduct in the next five years, the Attorney General’s Office can go to court to seek civil penalties.


Checks sent across Washington state


In December 2023, Ferguson began mailing checks to Washingtonians as restitution from resolutions with chicken and tuna companies Ferguson sued for engaging in a similar price-fixing conspiracy. The Attorney General’s Office had $35.5 million from resolutions in the chicken producers lawsuit and $5.1 million from the tuna lawsuits — $40.6 million overall. The office initially sent checks of $50 or $120 directly to Washingtonians whose household income was at or below 175% of the federal poverty level. Additionally, restitution was available through a claims process to homes that did not receive a check.


As of July 4, 274,595 households cashed the checks originally sent out in December 2023, totaling approximately $27 million for Washingtonians. Ferguson sent out a total of 28,530 additional claims checks. Of those, 15,709 have been cashed so far, for a total of $1,591,860.


The deadline for claims passed on June 5 and the administrator for the program continues to verify additional claims made in its final week.

Simmons Foods Inc. for $425,000;

Case Foods Inc. for $395,000;

OK Foods Inc. for $375,000;

Foster Farms, LLC for $300,000; and

Harrison Poultry Inc. for $290,000.

Ferguson named Wayne Farms and Sanderson Farms as separate companies in the 2021 lawsuit, but they later merged.


The broiler chickens lawsuit


The 19 broiler chicken producers named in Ferguson’s 2021 lawsuit account for approximately 95 percent of the “broiler” chickens sold in the United States — a term for virtually all chicken produced for consumption. Broiler chickens are used for everything from chicken breasts consumers purchase at the grocery store, to chicken nuggets and chicken sandwiches individuals buy at fast food restaurants.


An estimated 90 percent of Washingtonians — about 7 million Washingtonians — buy products derived from the chickens these companies produce. In addition, Washington businesses, colleges, hospitals and nursing homes were impacted by the companies’ illegal conduct.


The Attorney General’s Office investigation found a coordinated, industry-wide effort to restrain production through the exchange of competitively sensitive information, signals during investor calls and direct coordination between players in the industry. Ferguson asserts their conduct violated Washington state antitrust laws.

Public and private forest managers have performed nearly 800,000 acres of forest health treatments in central and eastern Washington since 2017 to reduce wildfire risk and improve forest resilience

 

The Washington State Department of Natural Resources published a report Monday detailing the scope and scale of forest health treatments completed in central and eastern Washington since the launch of the 20-Year Forest Health Strategic Plan in 2017.

 

As of May 31, 2024, the Department of Natural Resources (DNR) and its partners had completed 790,790 acres of treatments in central and eastern Washington, with about 391,465 acres of those treatments occurring within the more than three dozen priority landscapes identified within the 20-Year Strategic Plan. The 144,673 treatment acres completed in 2023 is more than 31,000 acres more than the previous single-year high set in 2018.

 

The gross number of treatment acres includes 365,633 acres of forest health treatments on lands managed by the USDA Forest Service, 164,349 treatment acres on DNR state trust lands, and 139,099 acres of treatments completed by the DNR Service Forestry Program. “To have completed almost 800,000 acres of forest health treatments in less than seven years is an epic achievement we should all be proud of,” said Commissioner of Public Lands Hilary Franz. I have pushed my staff and our partners in the fight against our forest health crisis to think bigger and to aim higher to restore our forests to health and resilience. Though we will reach our initial goal sooner rather than later, we must treat it like a checkpoint, not the finish line."

 

Many forest health treatments require multiple activities take place to truly achieve objectives such as fuels reduction, wildlife habitat restoration, and creation of potential control lines for use in the event of a wildfire. Completed treatments also require regular maintenance to remain effective.

 

“Working at this pace and scale would not be possible without the $500 million commitment the State Legislature made when it passed my House Bill 1168 in 2021 to fully fund implementation of the 20-Year Forest Health Strategic Plan and so many other efforts to prevent catastrophic wildfires, restore forest health, and improve community resilience in the face of climate change,” Franz said.

 

The more than 790,000 treatment acres reported as of May 31 represents a nearly 190,000-acre increase since the most recent progress report issued in October 2023, but close to 100,000 acres of that increase includes treatments completed prior to fall of last year.

 

Tens of thousands of treatment acres completed by the DNR Service Forestry Program went unreported prior to this year. Agency staff recognized the discrepancy early in 2024 and re-entered the data using the same criteria used by each of the other reporting agencies and partners since 2017.

 

Additional factors that led to a record-setting year of forest health treatments included increased amounts of prescribed fire and non-commercial thinning. These treatments not only help make forests more able to not only survive, but benefit from low-severity wildfires, but also provide tools for wildland firefighters to use when responding to new fire starts.

“Properly completed and maintained forest health treatments are a game changer for fire management personnel,” said Tim Love, Assistant Region Manager of Wildland Fire Management in DNR’s Northeast Region. “These treatment areas allow us the opportunity to safely engage the fire due to the moderated fire behavior which correlates to shorter flame lengths and less intense heat, making it easier and safer for our ground resources.”

 

It is also important to note that number of treatment acres reported is likely a small undercount due to different agencies reporting their completed and in-progress forest health projects at different times during the year. Data reported for 2023 should be considered mostly complete, but data reported for 2024 should be considered mostly incomplete.

Industry publication “The Land Report” celebrates DNR’s commitment to conservation in a recent article.

 

The Washington State Department of Natural Resources (DNR) is proud to announce that it has received The Land Report's "Timberland Deal of the Year" award for its exceptional work on the Deep River Woods transaction.

 

Deep River Woods, encompassing over 20,000 acres of prime timberland in Wahkiakum County, faced potential division and development before DNR’s purchase. Partnering with The Conservation Fund, DNR secured the acquisition of all 20,505 acres from Manulife Investment Management for $121 million. This landmark deal marks the largest land acquisition by the state in over a decade.

 

"The Deep River Woods transaction exemplifies our commitment to preserving Washington state's natural resources for future generations," said Commissioner of Public Lands Hilary Franz. "This acquisition not only expands our capacity for sustainable forestry but also underscores our dedication to maintaining the economic vitality and ecological integrity of our landscapes."

 

The acquisition was structured through a partnership where DNR acquired 9,115 acres for $55 million, while The Conservation Fund purchased the remaining 11,390 acres for $66 million. This collaborative effort will preserve a vital timberland ecosystem and reinforce the economic foundation of local communities dependent on the forest products industry.

 

The transaction, facilitated by LandVest on behalf of Manulife, represented a complex yet successful negotiation that balanced conservation interests, economic development, and community sustainability.

 

Deep River Woods is expected to continue as a working forest, contributing significantly to Washington’s timber industry and supporting local communities through sustainable land management practices.

OLYMPIA – The Washington Invasive Species Council and Washington Department of Fish and Wildlife (WDFW) are asking boaters to “Clean, Drain, and Dry” their boats and equipment this boating season to prevent the introduction and spread of invasive species and to protect Washington’s waterways.


“We need your help to protect Washington waters,” said Stephanie Helms, executive coordinator for the Washington Invasive Species Council. “And, the best way for any Washingtonian to help protect our waterways from hitchhiking invasive species is to take simple steps to Clean, Drain and Dry your boat.”


Invasive species, which include aquatic plants and animals, can attach themselves on the surface of a boat, motors, trailers, and other equipment. That includes non-motorized watercraft such as kayaks and inflatable paddleboards, and any equipment that touches the water including boots and waders.


Some aquatic invasive plants, such as Eurasian milfoil, grow quickly and crowd out native species and plants to take over native habitats. The plants can grow so densely that they clog boat engines and can make swimming difficult and unpleasant. Eurasian milfoil is present in much of the state but can be prevented from establishing in new waterbodies by following Clean, Drain, Dry, protocols.


Other devastating invasive species, such as zebra and quagga mussels, are not known to be present in Washington but are high priorities for prevention.


“Quagga and zebra mussels will be a multimillion-dollar problem annually if they are introduced to our lakes and rivers,” said Justin Bush, WDFW’s aquatic invasive species policy coordinator. “They would require expensive and ongoing maintenance at water facilities such as dams, irrigation systems and fish ladders, and could also harm the environment including salmon recovery. It is estimated that the invasive mussels would cost more than $100 million a year just for hydropower and water infrastructure alone."


This July 1, WDFW, the lead state agency for prevention and management of aquatic invasive species in Washington, received $3.6 million in additional state and federal funding to increase monitoring, prevention, and response readiness for quagga and zebra mussels in the Snake and Columbia Rivers, and other watersheds statewide. 


These increased efforts are in response to the September 2023 detection of quagga mussels in the Snake River outside Twin Falls, Idaho. More information about the recent increased funding is in WDFW's recent blog post.


“There has never been a more important time to clean, drain, and dry your boat and equipment,” said Bush. “The health of our waters, fisheries, tourism industry, recreational opportunities and statewide economy depends on it.”


Here are simple actions to Clean, Drain and Dry watercraft and equipment:


Clean shoes, waders, life vests, boat hulls and engines, trailers and other equipment by removing all visible plants, algae and mud. Use a stiff-bristled brush to clean equipment.

Drain any accumulated water from boats or gear–including water used in cleaning–before leaving the vicinity.

Let boats or gear fully dry before using again.

WDFW inspects boats, kayaks and other watercraft for aquatic invasive species at five watercraft check stations. In 2024, the Department inspected more than 58,000 watercraft and intercepted 25 mussel-fouled watercraft that were cleaned and decontaminated. It is illegal to transport aquatic invasive species from one waterbody to another in Washington. Violators could face a year in jail and $5,000 in fines. “Invasive species do not obey rules, respect laws or property lines,” Helms said. “Which is why we all must work together to protect all that we love in Washington state; together, we can do this.”

KILMER ANNOUNCES NEW FEDERAL INVESTMENTS FOR KITSAP TRANSIT AND THE MAKAH TRIBE.

 

TACOMA, WA – Today, U.S. Representative Derek Kilmer (WA-06) announced that the U.S. Department of Transportation (USDOT) will be awarding more than $18.3 million in federal funding to two projects in Washington’s Sixth Congressional District through the Rebuilding American Infrastructure with Sustainability and Equity (RAISE) discretionary grant program for 2024. This funding includes $17 million for Kitsap County Public Transportation Authority (Kitsap Transit) and more than $1.3 million for the Makah Tribe.


Earlier this year, Rep. Kilmer wrote to U.S. Transportation Secretary Pete Buttigieg in support of both Kitsap Transit’s and the Makah Tribe’s applications to the RAISE discretionary grant program.


“This is a big deal,” said Rep. Derek Kilmer (WA-06). “These investments in projects across Washington state will help move people and freight better. That’s important for our local economies, for quality of life, and for helping community connectivity.  Having the federal government provide this grant funding means we will see improvements without the cost being borne entirely by taxpayers in our neck of the woods. That’s a huge win for our region.”


Kitsap Transit will receive $17 million to construct a full-service maintenance facility and procure five double decker routed battery electric buses.


The construction of a full-service maintenance facility is a new initiative by Kitsap Transit to strategically address the challenges posed by the outdated Charleston Base facility. This 1940s maintenance facility, currently operating at full capacity with only three maintenance bays, has become increasingly overcrowded and is inadequately equipped to handle the evolving needs of Kitsap Transit's expanding fleet. With an anticipated annual growth of their electric fleet as they work towards their 30 by 2025 goal, the current facility's limitations in handling battery replacements, ensuring safe access to the tops of buses, and providing charging capabilities in the maintenance bays pose a significant concern. This new federal funding will assist in the construction of a new full-service maintenance facility that would address these challenges by providing the necessary infrastructure to support the maintenance and charging requirements of the expanding electric bus fleet, ensuring the safety and efficiency of Kitsap Transit's operations.


The facility will include updated maintenance workspaces with crane lifts, elevated walkways, and high voltage protective equipment. The facility will also incorporate designs for the inclusion of internal charging infrastructure and onsite green energy production. The success of this project aims to not only fortify Kitsap Transit's vital transportation network, but also contribute significantly to environmental sustainability and enhanced service provision throughout Kitsap County.


“Having a maintenance facility that can accommodate Kitsap Transit’s new electric buses is vital for the agency’s future operations, creating a more equitable and environmentally friendly transit system for the residents of Kitsap County and beyond.  We are so excited, as this project will not only save taxpayers millions of dollars in spent fuel, labor costs, and vehicle miles traveled over the next three decades, but it will significantly cut agency emissions and reduce traffic congestion on some of our busiest roads.  It will also provide us with a much-needed backup for our 1940’s-built maintenance facility that is small and not designed for either battery buses or double-decker buses. Kitsap Transit appreciates the continued support from the Department of Transportation and is grateful for this new opportunity,” said Kitsap Transit’s Executive Director, John Clauson


“The City of Bremerton greatly appreciates this major investment in our public transit system which many of our residents rely on. This funding will help support current service needs in the county as well as our growing population while helping to electrify the transit fleet to reduce carbon emissions for our local communities,” said City of Bremerton Mayor Greg Wheeler and Chair of the Kitsap Transit Board.


The Makah Tribe will receive $1.3 million to support the planning, market analysis, feasibility study, engineering, design, and permitting for a multi-use barge loading facility to mitigate critical supply chain interruptions in Neah Bay, Washington, where the Makah Tribe is located. Neah Bay is located at the crux of the Pacific Ocean and several crucial shipping lanes servicing the Puget Sound and Canada. The Makah Tribe currently relies on SR 112 for transportation in and out of Neah Bay, including all commercial supplies, tourist traffic, logging trucks, and local passenger vehicles. SR 112 is often considered to be in poor condition – and experiences regular closures due to washouts, landslides, rock fall, and fallen trees and powerlines. These road closures affect the economic vitality, public health and safety, and community well-being for the Makah Tribe. A multi-use barge loading facility in Neah Bay would aim to provide an alternate marine route for cargo transportation and provide key benefits to the Makah Tribe and the region. The facility would allow for loading of outgoing forestry products, delivery of emergency supplies transport into Neah Bay, and transportation of critical cargo for the community’s relocation efforts out of the Tsunami Inundation Zone and anticipated waste removal from the Warmhouse Superfund site.


“One of the greatest transportation challenges faced by the Makah Tribe is supply chain interruption caused by frequent closures of SR112. Interruptions impact every facet of day-to-day life for our members from off-Reservation medical care, fuel supply, consumable products, medicine, and waste disposal. The RAISE 2024 funding ($1.3M) will be used for planning, market analysis, feasibility study, engineering, design and permitting of the MBLF. The Makah Tribe is grateful to the Bi-Partisan Infrastructure Law (BIL) that will provide this funding,

The RAISE discretionary grant program provides an opportunity for the USDOT to invest in road, rail, transit and port projects that promise to achieve national objectives. RAISE discretionary grants help project sponsors at the state and local levels, including municipalities, Tribal governments, counties, and others complete critical freight and passenger transportation infrastructure projects. The eligibility requirements of RAISE allow project sponsors to obtain funding for projects that may be harder to support through other U.S. DOT grant programs.


Previously known as the Better Utilizing Investments to Leverage Development (BUILD) and Transportation Investment Generating Economic Recovery (TIGER) Discretionary Grants, Congress has dedicated nearly $14.3 billion for fifteen rounds of National Infrastructure Investments to fund projects that have a significant local or regional impact.


Overall this year, the U.S. Department of Transportation is awarding just over $1.8 billion in total RAISE grant funding to transportation and infrastructure projects across the country – including nearly $90 million to projects in Washington state, the most of any state.

WSDA TO GAIN AUTHORITY TO ACCREDIT CANNABIS LABORATORIES STARTING JULY 1, 2024.

OLYMPIA – Starting July 1, 2024, the Washington State Department of Agriculture (WSDA) will have the regulatory authority to accredit cannabis laboratories.


For over five years, WSDA has been engaged in a process to improve the integrity and oversight of the laboratories that test cannabis destined to be processed and sold in the state. Laboratories test cannabis for pesticides, heavy metals and cannabinoid concentration, serving as a valuable public health safeguard for Washington consumers.

Cannabis laboratories have been scrutinized at times due to concerns about “THC inflation” and “lab shopping” — a practice where businesses seek out laboratories that will provide higher THC numbers in hopes of attracting more customers. But regulators, legislators and laboratories have worked to improve the reputation and integrity of regulated cannabis by creating stronger standards and oversight.

 

For example, in 2019, the Legislature passed HB 2052, directing the Department of Ecology (ECY) to steer a Cannabis Science Task Force to develop recommendations for laboratory quality standards. The task force worked to create recommendations for the testing of potency, pesticides, residual solvents and heavy metals in cannabis. Testing methods and standards were developed to meet the needs of the regulatory framework governing cannabis in Washington.


New laboratory standards

Another recommendation from the task force was to create an interagency team (ICT), that included WSDA, to develop new laboratory standards. In response, the Legislature passed HB 1859, which required WSDA to serve as the lead agency of the ICT responsible for and maintaining quality standards for cannabis testing laboratories.

 

Today, the ICT has a new, more descriptive name: Cannabis Lab Accreditation Standards Program (CLASP) and is intended to foster a cohesive collaboration for cannabis science in Washington. The program lives up to its name by partnering with other state government agencies, while also listening to and integrating feedback from private cannabis labs, cannabis licensees, and the greater I-502 community.

 

WSDA’s evolving role

Originally, the intent was for WSDA to lead the development of the new laboratory standards, while ECY, which audits drinking water and soil laboratories, would begin to accredit cannabis labs. However, seeing an opportunity to streamline the process, WSDA submitted a request for legislation, HB 2151, that would allow the agency to take on accreditation of laboratories in addition to their role of developing the new standards.


Starting July 1st, WSDA will have the regulatory authority to accredit laboratories. At that time, laboratories will have a six-month grace period to make the necessary updates to comply with the new, more stringent standards. By having a cohesive local team of chemists and microbiologists, WSDA can provide a continuous service and support laboratories seeking accreditation, emphasizing compliance and heightened integrity.

IN FOCUS: North Cove turns the tide

From fastest eroding West Coast beach to one of the best restored.

The 1.1 mile long North Cove beach is located along the north entrance to Willapa Bay in Pacific County and was once the fastest eroding ocean beach on the U.S. West Coast. 

Starting in 2018, we worked arm in arm with the local community to reverse chronic and rapid shoreline erosion eating away the beach. This year, these concerted efforts have been recognized by the American Shore and Beach Preservation Association as one of the nation’s Best Restored Beaches.

North Cove has come a long way. For decades, the area used to be called “washaway beach” as winter storms, tidal currents and ocean-borne waves ate away bluffs, dunes, and trees as well as homes, garages, and other structures facing the Pacific Ocean. Through the years, advancing erosion took out a lighthouse, a U.S. Coast Guard station, and 640 parcels of property. It wasn’t unusual to see toppled homes and debris scattered on the beach. 


Coastal erosion also threatened lands culturally and historically significant to the Shoalwater Bay Indian Tribe as well as State Route 105, a lifeline corridor connecting coastal communities in Pacific and Grays Harbor counties. About 800 acres of local cranberry farms faced being flooded by saltwater.


To finally halt the erosion and restore the beach, we worked with community members, looking at natural, dynamically stable beaches on other parts of the high wave-energy Washington coast. 


Mimicking what they saw, the community, led by David Cottrell, strategically placed about 46,500 cubic yards of natural material –cobbles, gravel, and pebbles  – to create cobblestone berms along the backshore of the beach, complemented with large, assembled wood structures and planted native vegetation. 


Cottrell, who passed away in 2023, was born and raised in the North Cove community. He was a long-time cranberry farmer and commissioner for Pacific County Drainage District No. 1. He was also a mathematician and keen observer of coastal dynamics. 

The cobble berms proved to have a natural stabilizing effect by absorbing and dissipating wave energy while the large woody material and new vegetation retained sand that rebuilt protective dunes. On one 3,000-foot reach, the width of the dune area grew seven-fold in six years – the accumulation of more than 232,000 cubic yards of sand along the beach.


“David was an innovator and problem solver who worked well with everyone,” said Ecology coastal engineer George Kaminsky. “A quiet giant in the North Cove community, he intuitively understood coastal processes better than most coastal engineers.” 


Since the natural materials dynamically adjust to waves and water levels, the nature-based approach, if maintained, will also provide long-term coastal resilience to climate change and sea level rise.


“We are so pleased that the beach environment has transitioned from one littered with house debris, concrete foundations, and destroyed infrastructure to a broad healthy recreational beach enjoyed by the public and multiple species of interest,” Kaminsky said. “It was David’s insight and initiative that started the North Cove dynamic revetment, which has effectively halted a century-long trend of shoreline retreat and saved the remaining North Cove community.”


In Cottrell’s honor, Kaminsky said the community and Ecology will continue working on the project to enhance its long-term resilience.


“North Cove serves as a model for grassroots community engagement,” he said. “The results have rejuvenated the community and inspired investments in similar nature-based approaches to enhance coastal resilience across the country and around the world.”/DOE
