CITY TO HOLD FINAL PUBLIC HEARING ON OMC PETITION

City Council agenda Item:  STREET VACATION PETITION – STV 16-01 A PORTION OF COLUMBIA STREET WEST OF CHAMBERS STREET.
According to staff memo provided:
The petition proposes the vacation of a 70 foot right-of-way a distance of approximately
200 feet. The Real Estate Committee has recommended a price of $15.00 per square foot, or
approximately $140,000.00 for the entire proposed vacation area. The assessed per square foot
land value of the surrounding properties within a 300 foot buffer is $7.54, with the omission of
11 of the total 28 properties due to their public ownership. On May 5, 2015, Council approved a
similar street vacation for the Olympic Medical Center at a price of $15.00 per square foot.
Conditions 3 and 5 within the ordinance have been clarified based on Council inquiries.
The Planning Commission conducted a public hearing on this matter on March 23, 2016,
and forwarded a recommendation of approval for the vacation by a vote of 7 – 0. There were no concerns raised by the Commission, or the public, at the meeting.
see page f1 on agenda packet for further details

MAYBE THERE'S SOME LIFE IN THE OLD GAL YET!

PAPA ENTERS INTO LEASE AGREEMENT WITH CITY, FOR OLD FIRE HALL.

Lease Agreement 215 South Lincoln (Old Fire Hall)...
Staff memo: On December 4, 2015 the City received a proposal from Peninsula Area Public Access (PAPA) for the lease of the buildings second floor. The floor area of the second floor is 3,135 square feet. The building was reviewed for fair market value by Chuck Turner of Port Angeles Realty. The fair market value was deemed to be zero (0) due to the substantial tenant improvements needed. A July 2011 condition assessment report identified necessary improvements in excess of $1M. Since the receipt of the proposal PAPA has invested numerous volunteer hours in the cleanup and repair of the building. The cleanup and repair efforts will be ongoing and will constitute services provided to the City in lieu of monthly rent. Prior to these clean up efforts the surplussed building suffered from neglect and dilapidation. Multiple leaks, ceiling failure and roof maintenance are just some of the challenges the building faced prior to services provided by PAPA volunteers. Beyond repairs to the building the PAPA group was awarded the City of Port Angeles Franchise Agreement in November of 2015. Their public access channels will provide substantial benefit to members of the public and the broader Port Angeles community. Programming will also result in training and education for local students in the communications and broadcasting fields.

Editorial note: While I was going through the City Council agenda packet for next Tuesday's City Council meeting I stumbled upon this agenda item. PAPA the new public access channel apparently had been in negations with the city in securing a lease agreement to use the old fire hall on Lincoln street in Port Angeles. I tried to secure an interview with one of the founders of PAPA, Dale Wilson who also  is publisher of the Port O Call, but he wasn't available at the time of this posting.
(see my video commentary)

Other city council agenda highlight items:
 Ethics Board (1) Recommendation
Staff memo: Background/Analysis: On February 4, 2016, a complaint was filed against Deputy Mayor Cherie Kidd alleging she had violated the City’s Code of Ethical Conduct as outlined in Chapter 2.78 of the Port Angeles Municipal Code. On February 16, 2016, Council chose three members from a pre-approved pool of applicants to receive, investigate and make recommendations for disposition of the complaint. Board (1) has completed its review and forwarded its findings and recommendation to Council. In accordance with PAMC 2.78.080, the recommendation of the Board of Ethics shall be subject to review by the City Council.

Customer Service Standards Resolution – Cable Television Franchises
Staff memo: Summary: The proposed Cable Customer Service Standards (Standards) are applicable to all entities that provide cable services under a cable franchise in the City of Port Angeles. The Standards are intended to provide basic “rules of the road” related to the interactions between cable franchise holders and residents and users of cable service in Port Angeles.
Funding: These are obligations the Franchisee(s) must meet – No cost to the City
Recommendation: Pass the proposed Customer Service Standards Resolution

Declaration of Emergency for Structure Fire and Unstable Bluff
Staff memo: Summary: On April 5, 2016, the Port Angeles Fire Department responded to a structure fire at
715 E. Caroline Street. The structure was located on a bluff above the waterfront trail. During the fire, a large portion of the bluff sloughed off and fell onto the trail. The bluff was deemed unstable and it became clear that heavy equipment would be needed to completely extinguish the fire. An emergency was declared by the Acting City Manager in order to facilitate the acquisition of resources to mitigate the situation.
Funding: There are service costs associated with this resolution for engineering, geotechnical and contractor services. Final costs are estimated to be approximately $10,000. A verbal update will be provided at the Council meeting.
Recommendation: Pass the attached resolution affirming and ratifying the Declaration of
Emergency issued by the Acting City Manager and authorize the Mayor to sign in respect to the
structure fire and bluff sloughing incident that occurred on April 5, 2016.

Landfill Stabilization, Project SW02-12, Construction Management Services Contract Amendment No. 3
Staff memo: Summary: Construction management services are provided by Anchor QEA for the Port Angeles  Landfill Stabilization Project. Due to the discovery of large amounts of asbestos and the resulting  claim from the construction contractor, Anchor QEA has provided a substantial amount of additional support to prepare the City to equitably resolve the asbestos claim. In addition, the  construction contractor, Magnus Pacific, was required to achieve substantial completion by  November 10, 2015. Schedule impacts due to the asbestos as well as other issues have extended the completion date to the end of March 2016. This required Anchor QEA to be onsite longer. This amendment compensates Anchor QEA for the additional effort.
Funding: a) The project originally was approved by Council on May 20, 2014 with a contingency
of $1,962,994. The construction management agreement has had two additive amendments valued  at $299,927, and the construction contract has had twelve change orders for a total value of  $1,453,927 and legal expenses valued at $112,056. This leaves a net contingency balance of $97,084 at this time.
In addition, the Engineers report that the construction contract has two pending change orders and quantity take-off variances that are expected to further reduce the construction contract cost by  $432,248. With this, the projected amount of surplus funding available in the project is estimated to be $529,332 which is more than sufficient for this amendment.
Recommendation: Approve and authorize the City Manager to sign Amendment No. 3 to the
Professional Services Agreement with Anchor QEA, increasing the value by $99,000 for a revised
maximum not-to-exceed amount of $1,827,927. Declaration of Emergency for Structure Fire and Unstable Bluff

This week I started doing these video interviews using my IPhone camera, would be nice if I had a better video camera, but you make do with what you have. The lead story is about Platypus new ultimatum from six months, to now just 10 days for the Port to come up with a workable lease agreement with Platypus, to keep them in Port Angeles. FEATURING VIDEO CLIPS!

I plan on featuring short video clips, and interviews using my new IPhone camera.
It will be included in my news reports I do on meetings I attend. Won't be full feature videos of meetings, just video clips of topics of debate.
See test clip!

PORT TO REVIEW RULES OF CONDUCT AND BEHAVIOR DURING PUBLIC MEETINGS

One of the agenda items during the Port meeting on Monday's work session is going over the
rules of conduct and behavior during Port meetings, from the public.
See work session agenda: http://www.portofpa.com/AgendaCenter/ViewFile/Agenda/04112016-143
Regular meeting agenda item highlight:  Oyster Restoration agreement
see full agenda: http://www.portofpa.com/AgendaCenter/ViewFile/Agenda/04112016-144

Editorial Note: One must wonder what brought this subject of reviewing the rules of public meetings by the Port Commission. Could it have something to do with what's going on in the city meetings? I say this because according to the rules, they are banning signs, and many of the similar issues that the city is addressing.

" We did not elect dictators. We elected representatives." ---Marolee Smith

That's from a quote from a letter which Marolee Smith wrote to the City, and the Ethic's board. The letter was forward to the local media outlets. The following is the letter:
I am dismayed to read the pleadings to re-visit the ethic’s board decision by the hired attorneys and by Ms. Kidd.

I find it insulting – to the Ethics Board; the people of Port Angeles; the spirit of the ethics code; the spirit of fairness; as well as, to me personally.

The Board did their job, (perhaps a compromise) but they settled on the most egregious offense committed at the meeting of February 2, 2016. (BRAVO)

What has happened since has been an attempt at brute intimidation to try to influence a decision already made. It is not heroic to make excuses and whine. No one – no individual, no elected official, should forget that none of us, alone, makes a community. It is our love for each other; our ability to admit our foibles, that ultimately, makes us human and binds us together in unity.

I am, now, even more ashamed of our Deputy Mayor and her actions. Here she is, rising up on a high horse – only representing selfish interests. She passed up a learning moment: to reflect; to introspect; to grow. She passed up a time that could have helped us all move together as a community. However, sadly, she is only arrogantly interested in her interests, her desires, and her appearances.

“The opposite of humility is arrogance--the belief that we are wiser or better than others. Arrogance promotes separation rather than community. It looms like a brick wall between us and those from whom we could learn.”     -- John Marks Templeton

Instead, it has become a silly show, a spectacle. A prime example of why our town’s people are angry and upset, and distrustful of all in local government, and sad. Some are hopeless. Some are frustrated. Many are disgusted. This could have been a turning point of the city’s steady decline.

Leading people is not cutting ribbons, showing up, and cheer-leading. It is listening, and apologizing. It is finding humility. It is embracing critics and learning from mistakes.

I believe the attitude of the council (some) and the staff (some) is defeating. The attitude ignores that many citizens are struggling. There is widespread hopelessness, anger, frustration, and community is in discord. Our town is struggling, while others around us are thriving.

The message I hear, is that we, the people, feel disrespected. From raising the utility rates (and service rates) to outright, disregard of the simple things that really do count (i.e. fishing derby, for one) and the outright slaps in the face (i.e. hiring legal advisors for the Deputy Mayor to the tune of $20,000+).

The people want so much more. Our community is fraying at the edges. Nevertheless, it does not need to be this way.

It really does FEEL as if we are here to serve at the pleasure, and whims, of our elected council, which is just backwards.

People say: Why does our local government work against the people? Why do they disregard us? To what end?

I am ashamed at the height of the hubris. I thought it was bad with the hiring of legal counsel from the wallets of the constituents. It was not good when the city attorney continued to “advise” (even though a clear conflict of interest exists). Then, unbelievably, there was sworn testimony, with outright lying, blaming another council member, and crocodile tears. Now, there are these manipulative, arrogant, demanding letters of disagreement with the ethics decision. It is beyond understanding.

It is beyond disappointing.

The deputy mayor lied, under oath. She, literally, blamed a situation (of her making) on another council member. How does an adult lay blame on another, instead of taking a hard look at their actions? I am incredulous.

Essentially, pride is a 'my will' rather than 'thy will' approach to life.     -- Ezra Taft Benson

Why did the ethics-conflicted city attorney not step up, and do his job, at that point? It was NOT in the best interests of the city for one council member to outright attack another -- on record, videotaped, audio-taped, with an audience of citizens, for the whole world to see.

Why didn’t the deputy mayor, at her expense, hire the legal advisors? Then, she could (perhaps), have been reimbursed. That, certainly, would have been more honest and “reasonable”. It would have been less adversarial, too. It feels as if WE (the people) are the enemy. Are we?

Why were the ethics codes put in place? Were they so the people would have an opportunity to speak up?

(Or, were they put in place as faux rules, and enacted so that some out-of-the-area attorney bullshit could be heeded?)

Instead of this becoming a learning moment, one where we all could have found some common ground, it has become a battle. A will of the elected against the electorate. Our government is not supposed to work this way.

We did not elect dictators. We elected representatives.

To Ms. Kidd: A simple apology would have sufficed, and some acknowledgement of wrongful, mistaken, hastily taken actions. Perhaps further Parliamentary training could have been in order.

Finally, to clarify: My motives were NOT (as the Deputy Mayor was quoted in the PDN) politically motivated. It is not a personal vendetta, or anything of the kind. My actions had nothing to do with the fluoride (anti- or pro-). It was not to harass, or demean. It was because I am a law-abiding, long-time resident, and citizen, a taxpayer. I am American. I believe in our form of government, the Constitution, Free Speech, and Liberty for all. I believe in excellence in local government.

I have been insulted and outraged at the degree of disrespect foisted upon the people at the city council meetings; at the ongoing attitude that (and I quote) “you should be grateful for all that we do for you”.

I have zero political motives. Clearly, I am not a politician. (I ran for office, only because I could not bear another dismal election, with no challengers to the incumbents.) I am not a “failed council candidate” (as the PDN seems to like to portray me). I am a person, just like everyone else. I care about the people and my community.
I am tired of the personal attacks (in person, on social media, etc.) To speak up for my fellow citizens takes stamina, and courage. (This has not been without a cost to me.)

I urge the Ethics Council to hear MY PLEAS.
Please, stick with your decision.
Please, honor US.

Respectfully Yours,
Marolee D. Smith

WHETHAM & GASE SPARE OVER CARNEGIE, MERIDETH LEFT OUT OF DISCUSSION UPDATE!

City Council agenda item regarding Carnegie:  The Clallam County Historical Society provided the City of Port Angeles with a letter on December 24, 2015 requesting that their lease agreement for the Carnegie Library (205 South Lincoln) be assumed by the Lower Elwha Klallam Tribe. (See page E 63 of agenda packet

Lower Elwha Klallam tribe to take over lease of Museum at Carnegie in Port Angeles---PDN
Quoting from the article posted:" Councilman Lee Whetham, who voted against the transfer, said the change should be discussed in a public hearing. He said other organizations should have a chance to rent the building and continue to keep the museum open as the tribe has pledged to do in taking on the remaining years of the 20-year agreement."

Editorial Note: During the discussion regarding the Carnegie library, which the report didn't mention was the exchange between Council members Whetham, and Gase.  What was mostly about some legal issues, and regarding real estate. I was hoping that exchange was recorded on the city council minutes, but wasn't. So I am waiting to see if Clallam Public eye got it, so I can share it with you. In the meantime. Councilman Merideth wanted to interject something regarding the Carnegie library decision, but he didn't get a chance to say anything because of the exchange between Gase, and Whetham. Apparently, the mayor didn't see Merideth's hand go up requesting to speak, the mayor called for the vote. I wrote to all three council member's letting them have their chance on what transpired during that discussion, none as of yet answered my email I sent out. As soon as I get more information I'll share it with you.

WORLD AND NATIONAL DIGESTS

WORLD NEWS DIGEST:

FROM THE US MISSION TO THE UN:
Explanation of Vote at the Adoption of UN Security Council Resolution 2279 on Burundi
" The situation in Burundi is beyond fragile. The ongoing repression, harassment, and violence against the legitimate political opposition, the closure of free and impartial media, and widespread impunity for human rights violations and abuses – including those involving killings and alleged sexual violence by security services against political opponents, members of civil society and others – continue. Almost a quarter of a million have fled. Again, over a quarter of a million Burundians have already fled the country since April 2015 out of fear for their lives, and countless more have been internally displaced. People do not flee in the hundreds of *millions unless there is a very, very serious problem."

Statement on Allegations of Abuse Committed by Peacekeepers in the Central African Republic
" This plague of sexual abuse by peacekeepers must stop. These infernal abuses defy the very values the UN was created to uphold, taint the legitimacy of the institution, and undermine the effectiveness of those honorable peacekeepers who are attempting to protect civilians and promote peace."

I visited at times when the Catholic Church and the Protestant Churches were sheltering Muslims who were fleeing for their lives, and when imams in other parts of the country were sheltering Christians who were fleeing for their lives.
