NO MATTER HOW THE ETHIC RULINGS PAN OUT....

THE TAXPAYERS WILL BE THE LOSERS

In yesterdays edition of the Peninsula Daily news early edition, ran the story that no decision will be made regarding the ethical conduct of Deputy mayor, Cherie Kidd until next Thursday. Apparently, a decision was made during Friday's mornings Ethic complaint hearing which was hearing the complaint of Council members, Dan Gase, and Deputy Mayor Cherie Kidd. According to a news flash from the Peninsula Daily News under the headline: Ethics panel finds Port Angeles deputy mayor violated code---PDN
Quoting from the article posted: Among possible actions that could be recommended are removal from the position of deputy mayor, issuance of a cease-and-desist order to the council member that the person can seek review of from Clallam County Superior Court, a verbal admonition, a letter of reprimand or public censure. The council also could decide not to take action, according to City Attorney Bill Bloor.

So from I read from the article posted, the "punishment" amounts to be either a scolding, or removal of her posting as deputy mayor, not from the council. In essence readers this look into misbehavior of the council members involve is one big circus act at the expense of the taxpayer. Do you really think the council is going to demand her removal from the council? Or her position? Think again, that would probably end up in court battles lasting for months, all on the taxpayer's dime in legal fees. Oh, you may have one or two council members scolding her for bad behavior, maybe have her censored. Don't think many council members will go for a letter of reprimand, without implicating themselves. So those who think these ethic complaints are going to force these council members to quit, thin again. Even if one or all four does, where would that leave the council? They wouldn't be able to do anything until they appoint new members to the council, and who in their right mind would want to be appointed to the council, when the next regular city council race is in 2017! Forget about holding any special elections if all four council members quit, it would cost the taxpayer even more.
Not saying these ethic complaint should never be filed, just don't expect much after the rulings of the ethic boards who will be ruling on them. Ask yourself, is it really worth it?

Olympic Medical Center Street Vacation Petition 

Another City Council highlighted item on the agenda for next week:
According to the staff memo provided:
A petition requesting the vacation of a portion of City rights-of-way was received on
January 29, 2016, from the Olympic Medical Center. The petition is valid and it is signed by one
hundred percent of the abutting property owners. The petition proposes the vacation of right-of way in order to consolidate property to provide additional off-street parking and allow for the reconstruction of the helicopter landing site so that Olympic Medical Center may provide more comprehensive emergency services on the North Olympic Peninsula.
The landing site is currently inadequate for some types of aircraft. When an emergency
aircraft does land at the facility, multiple hospital employees are required to place temporary
safety fencing, and those employees that are parked adjacent to the helipad are sometimes forced to wait for the area in which they are parked to safely open before they may leave.
The Planning Commission conducted a public hearing on this matter on March 23, 2016,
and forwarded a recommendation of approval for the vacation by a vote of 7 – 0. There were no concerns raised by the Commission, or the public, at the meeting.

ELWHA TRIBE TO ASSUME LEASE AGREEMENT OF OLD LIBRARY....

WHILE THE CLOUD OF ETHIC'S LINGER OVER CITY COUNCIL.

That will be one of the topics on the City Council agenda coming next Tuesday. The council that is this current ethical drama, will manage to conduct business under the cloud of ethic complaints. According to the staff memo provided, regarding assuming the lease to the Elwha Tribe: On December 24, 2015, City staff received a letter from the Clallam County Historical Society. The letter requested that their lease agreement for the Carnegie Library (205 South Lincoln) be assumed by the Lower Elwha Klallam Tribe. The City’s Real Estate Subcommittee was provided with the letter at their February 1st meeting. At that time it was agreed that staff should obtain information on fair market value for the property along with sending an invitation to interested parties to attend their March 7th Committee meeting. An estimate for fair market value was provided by Chuck Turner of Port Angeles Realty.
The estimate identified the lower floor of the Carnegie as having a value of 40 cents per square foot. The Lower Elwha Klallam Tribe simultaneously provided information on the hours and services they planned to provide in the building. Staff recommended a value of 40 cents for the office space located on the lower floor with no cost for the public and museum areas of the building. Tracey Hosselkus, Chief Operating Officer of the Lower Elwha Klallam Tribe was present at the meeting and presented a different view on lease rate that took into account services provided. The Real Estate Committee agreed with a vote of 2 to 1 to recognize value in the public services and additional hours being provided by Tribe resolving to maintain the existing lease rate of $1 per month. The approving committee members calculated the costs of having to provide full time staff to maintain regular open hours for the building and associated museum. Committee member Lee Whetham requested addition legal analysis to ensure the approach was not in conflict with the constitutional prohibition against gifts of public funds. Other items on the agenda are on Fluoridation:
A verbal report on the progress of the ad hoc committee regarding looking into alternative solutions for those who don't want fluoridation. Which I might add will probably turn out to be a complete waste of time and money, just like these ethical complaints being filed which seems at this point turning out to be thus far with the ethics committee droping the complaint against Council member Dan Gase. Quote from article posted: Gase said he was not surprised by the decision.
“It's a shame they had to go through the time for what was really a frivolous claim,” he said afterward. “It's kind of like trying to prove a negative.”

I have this gut feeling charges against Kidd will also be dismissed, along with the other complaints filed. Care to make a wager on that? Both Kidd, and Gase came loaded for bare with hired attorneys paid by taxpayer money, I can imagine the Mayor will also follow suit and hire an attorney and I'm just guessing here, be paid for by the taxpayer. The thing of it is, many of the monies used from taxpayers, are probably from the very ones filing these claims, and opposing fluoridation through tax revenues collected. So in essence its the compliant filers, and anti-fluoride crowd paying for the defense of those who are being targeted by these complaints, isn't that a hoot!
The other item regarding fluoride which is on the City Council agenda next week is: Fluoride Infrastructure Update .
According to the staff memo provided (page L5) of the agenda packet:
Background/Analysis: During Public Comment periods, at several recent Council meetings,
members of the public have made numerous misstatements regarding the fluoridation facilities and
processes. This paper intends to correct those misstatements:
1. The building which contains the fluoride infrastructure is in very good condition. It is a 10
year old metal building which should remain in good condition for the next 20-30 years
given regular routine maintenance. The public statement that the building is in poor shape
and in need of replacement is incorrect.
2. There are no plans for any major rebuilding of the fluoridation system. The water utility
budgets approximately $2000/year for routine maintenance of the system, which includes
any parts replacement. With this planned routine maintenance, there is no requirement for
a major capital project. The public statement that a $200,000 project is required is
incorrect.
3. The water utility tests water fluoride levels on a daily basis with specialized, calibrated
equipment in the water plant laboratory. The utility also uses an independent, state
certified laboratory to provide additional water testing. These test results are reported to
the Department of Health on a monthly basis. The fluoride levels consistently remain
within State mandated levels. The statement that fluoride levels are 2x to 3x regulatory
levels is incorrect. If any citizen is concerned with water purity, the utility will perform
additional water testing at additional locations in the City.

WHILE WE JUDGE THE ETHICS OF OTHERS, PERHAPS WE SHOULD PONDER OUR OWN

Matthew 7:3: And why do you look at the speck in your brother’s eye, but do not consider the plank in your own eye?

I say, that quote from the bible still says a lot on many levels. I said it many times, that during the meeting on Feb 2, of the city council meeting there was rudeness displayed on both sides. These ethic complaints in my opinion have now become a distraction from the very issue that lead us all to these latest incarnations of ethic complaints which in my opinion may end up costing the taxpayers more money, and a waste of time. I'm just waiting for the end result of this three ring circus. This whole think to me smells of retaliatory strikes from both sides of the argument. The reason why I say this not to side with the four council members who decided to ignore the will of the people of ending adding fluoride into our water system. What I am pointing out is that many people of the audience, and at least one other council member was out of line, in making their points during the meeting. Neither the two leading newspapers even made mention of Councilman Whetham's "Real mayor" comment, which to me was just as rude, so why the other two newspapers ignoring that little bit of rudeness?  Of course those who filed the complaints against, Downie, Gase, and Kidd deny that their complaints filed had nothing to do with the main argument that lead us to this, Fluoridation. All the while this Ethic three ring circus is being played out, the city's business is being ignored!  Wasn't Kidd's intention to do something about the aggressive pan handlers? We heard nothing on that as of yet, or was that just a campaign promise set aside by Kidd? Yes, we have a right and obligation, to point out the flaws of governmental officials, but we should also take a look at ourselves in the mirror, and examine our ethical conduct when we go to these meetings and lend support for a cause we care about. Just something to ponder readers, what's good for the goose is good for the gander.

THOUGHTS OF CLASS REUNION, AND A SOLE WATER FOUNTAIN AT PA HIGH

The infamous sole water fountain,
located in the 100 building of PA High School.
Talk of class reunion brought this subject to my mind. This is more than just a sole water fountain that the current student body has to use for the entire school. Yes, kids bring in bottled water, juice, pop, and so forth. It's the very idea that the school which many of us attended over the many years, as fallen to such disrepair that kids have to drink from a sole water fountain. You probably heard by now that the school board is going to try once again to pass a, what I call; "A Readers Digest" version of a facility bond issue. According to the press release issued by the committee who was studying the issue: Facilities Committee Makes Recommendation to Directors---Port Angeles School Board
Port Angeles, Wash. – The Port Angeles School District’s Facilities Committee made its report to the directors at the School Board meeting held Thursday, March 10, 2016 at the Central Services Building.
The 2016 Committee was formed to look at all existing facilities in the School District and provide Superintendent Marc Jackson and directors with a long-range facilities recommendation designed to meet the needs of the students for the next 20 years or more.
Committee members Nolan Duce, Chris Riffle and Steve Methner gave the report to the board.
The committee’s recommendation reads as follows:
1.) Rather than an entire school replacement, build a new science and technology classroom building at Port Angeles High School to replace the 100 and 900 buildings, and make site improvements.*
2) Concurrently, update Stevens Middle School to accommodate moving all district sixth grade classes to that campus.  This will involve expanding the cafeteria, kitchen, music, and gym areas, and adding a permanent classroom building.
3) Either from the capital projects budget over several years or as part of this bond measure, allocate approximately $500,000 to prevent critical systems failures at Hamilton Elementary and Franklin Elementary during phase one of the long-term plan.
*As an alternative, the district could consider replacing only the 100 building, resulting in approximately 16,000 fewer square feet of new construction, and reducing the size of a bond measure.  Re-evaluation of the OSPI deficiency assessments and the two additional architectural/engineering reports from 2007 and 2014, or funding new ones, might be explored as well in order to reconsider refurbishment rather than replacement.

Hall way inside building 100 of PA HIGH SCHOOL

In my opinion, replacing one building at a time starting with building 100 which many people see first when coming to the school is a good move. The last time they tried passing a bond levy for the entire high school the voters weren't very receptive, some I imagine was experiencing price tag sticker shock.
Schools play a big part in attracting businesses who may want to invest in the area. When big businesses sees schools in disrepair they tend to think the community aren't all that concerned with school facilities that may one day just fail.
While some are planning class reunions, we tend to forget what was left behind while many of us entered college, and careers, somethings like replacing school buildings seem to fall through the cracks of our collective conscience. Leaving future students of our old stomping grounds to study in a facility that has lived it's time.



MAROLEE SMITHS MORE INFO ON ETHIC COMPLAINT

In an forwarded email to the City Clerk Marolee Smith wrote the following request for additional information:
As, a citizen of Port Angeles, and as the originator of Ethic's complaint #1,  would like to ask for all emails that were exchanged between council members and Mr. Bloor regarding Council Rules of Procedure, to be sent to me AND to be sent to the three member ethics panel.  The information I am seeking, specifically, regarding the Regular City Council meeting of 2/2/16, including all of the following:

1.) All  written exchanges regarding the sign ban. I would request memos, emails, and other correspondence between council members and legal council. (Mr. Bloor made statements to the PDN, which seemed to suggest that this had been voted on by the whole council. I find no record of this in any council meeting minutes, so would like clarification.)  I would like to know Mr. Bloor's comments -- email exchanges, memos, etc., --  regarding the night of 2/2/16.  I would like clarification on where the ordinance/rule exist which bans citizen signs in the chambers. If no ordinance exists, then by who's authority signs were posted prohibiting citizen's personal signage in meetings.

2.) All written exchanges regarding Council Rules of Procedures between Mr. Bloor  and all council members, regarding clarification of adjournment procedures as they relate to the published agenda, as well as council chair's requirement to ask if there is any" executive business", and/or requirement for a motion/second, and vote to adjourn meeting.  I would like to include any emails sent to council that deal with IF the council is bound by ANY Parliamentary procedure. What do the Council Rules say, and if this is not the rules in effect, then, what rules do we use, and  and if so, how do they  differ from Roberts Rules of Order?

3.) For council members (not involved in other ethics violations) Meredith, Whetham, Bruch and Collins to submit written (or be called as witnesses) statements regarding the Council Meeting of 2/2/16. What did they witness regarding  the actions of the Acting Mayor and did she follow procedures as outlined by the Council Rules, as well as follow published agenda, specifically regarding adjournment of the meeting.  As well, did they they participate in the decision to ban citizen's signage in the chambers that evening. I would, also like to know, what they witnessed regarding gavel pounding by Ms. Kidd. (Was it excessive, and loud?)

4.) For City Staff present at the Council Meeting of 2/2/16, to submit written (or be called as witnesses) to the actions of the Deputy Mayor in regards to observance of Council Rules, "normal" adherence of procedures, following the published agenda, and the frequency and volume of the gavel pounding by Ms. Kidd.

Please, Council members, Ms. Veneklasen, and others, send this information to me, asap, as time is of the essence, and send copies to the Ethics Board Members, and the City Clerk..

State Board funds infrastructure development and economic feasibility studies in Clallam, Spokane and Whitman counties.

Quoting from the Press release:

Proposals approved for CERB funding at the board’s March 17 meeting are:
 Clallam County - $50,000 grant to the Jamestown S’Klallam Tribe for the Wastewater Infrastructure Planning Support Study.  This is a feasibility study to produce a preliminary engineering report (PER) with an environmental report for the connection to the City of Sequim sewer collection and disposal system, which treats effluent to Class A standards.  CERB funds were matched by $21,389 in local resources.
 Clallam County - $50,000 grant to the Port of Port Angeles for the Marine Trades Industrial Park – Site Plan.  This is a feasibility study/master plan for a marine trades industrial park at the former K Ply mill site.  The study will include a preferred site layout alternative that will maximize the utilization of the 19 acres waterfront site, cost estimate, and project phasing schedule.  CERB funds were matched by $50,000 in local resources.

PORT PRESS RELEASE ISSUED: Port Awarded $50K of WA State CERB Funds
The Washington State Community Economic Revitalization Board (CERB) announced last Friday that the Port of Port Angeles will receive a $50,000 grant for the Marine Trades Industrial Park site plan. The grant will partially fund the feasibility study/master plan for the Marine Trades Industrial Park located at the former KPly mill site on Marine Drive in Port Angeles. The study/plan will include a preferred site layout alternative that will maximize the utilization of the 19 acres of waterfront property, a cost estimate and a project phasing schedule. The CERB funds will be matched with $50,000 of budgeted Port funds to complete the Marine Trade Industrial site plan.
“The CERB team was integral in the Port receiving this grant,” stated Jesse Waknitz, the Port’s Environmental Manager. “With CERB’s assistance through the grant process and their funding support, the former KPly mill site is well on its way to becoming a job producer for Clallam County once again.” Waknitz was the Port’s lead in applying for and receiving this CERB grant.
CERB approved $172,500 total in public investments for infrastructure development and economic feasibility studies geared toward business growth and job creation in Clallam, Spokane and Whitman counties. Also in Clallam County, the Jamestown S’Klallam Tribe will receive a $50,000 grant for their wastewater infrastructure planning support study.

As Mr. Meiner pointed out in the PDN article (2/20/16) “This is a quasi-judicial proceeding.”
If I am to understand correctly (based on the general definition of “quasi-judicial”) decisions of such a body require findings of facts to reach conclusions of law that justify the decisions. Counting minutes and timing is not, and was not, the whole of the complaint. The real focus of the complaint was rude behavior, and not following procedure of any parliamentary rules of order.
To this end, I would request that you (the ethics board), again, view the full video, listen to the city recorded audio, and watch the cell phone video (link provided in the addendum to my complaint). Then read my complaint and the addendum.
I believe these are all the “facts” that you need.
Because, as Mr. Meiner pointed out, this is NOT a judicial proceeding. I, nor Ms. Kidd, should be asked to provide “evidence” or a list of witnesses.
It is YOUR duty to investigate, and you should call witnesses and ask questions, if you so desire.
It should not be my burden. I should NOT have the duty of proof to say, AGAIN, what I have already said in my original complaint AND the addendum submitted. What other facts can I possibly give you?
There is nothing I can add via witnesses, or testimony, beyond what you already have at your disposal. As the person lodging the complaint, I should have no obligation to also “argue” my complaint. You have had ample time to review it, and analyze it.
I believe ethics were violated. It is up to you to decide if they have been.

Senators Cantwell, Murray Introduce Bill to Help Washington State, U.S. Ports Compete

In a press released issued: WASHINGTON, D.C. – Today, U.S. Maria Cantwell (D-WA) and Patty Murray (D-WA) introduced the Harbor Maintenance Trust Fund Reform Act of 2016, a new bill that would significantly increase investment in Washington state and other U.S. ports, which in turn will support American jobs and help U.S. ports maintain a competitive edge in an increasingly global maritime economy. The bill would make sure all of the money collected through the Harbor Maintenance Tax (HMT) each year is returned directly to ports in order to improve infrastructure and keep ports competitive. Right now, the HMT is not being collected or spent in a way that ensures ports can continue to compete on a level playing field. Because of this, U.S. ports, which drive job creation and anchor our economy, can’t make the infrastructure investments they need to support American businesses.

DOJ: Attorney General Loretta E. Lynch Statement on Terror Attacks in Brussels

Lynch: " I stand with President Obama and the American people in condemning this morning’s horrific attacks in Brussels.  This was an appalling assault on the people of Belgium, on the European Union and on every nation that stands for peace and the rule of law.  The Department of Justice is in contact with our counterparts in Belgium and we have offered any and all assistance that we can bring to bear.  In the days ahead, we will continue to work with law enforcement abroad in order to help ensure those responsible are brought to justice.  And as we go forward, our thoughts, prayers and deepest condolences will be with the victims and their loved ones.

CHAPMAN ISSUES STATEMENT ON HIS CANDIDACY FOR STATE REP.

Today, yours truly went to the Clallam County Commission meeting and took some snap shots of candidates running for both the County Commission seat vacated by Mike Chapman, who earlier this week announced his intention for the State Representative position that   Rep. Kevin Van De Wege  is vacating to run for State Senator Jim Hargrove's spot since he is retiring. I took my camera and took some pictures of the two leading contenders for Chapman's seat on the County Commission, Maggie Roth (R), and Ron Richards (D). I also had an little impromptu debate after the meeting with Roth, and Richards. More on that later...
Right now I want to focus on Chapman and the following press release he issued:

Mike will fight to ensure that tax dollars are used wisely to invest
in local infrastructure and transportation projects to create jobs
and help our economy to improve. He knows our local economy must
support good paying jobs with good benefits for everyone, not just a
privileged few.

The Olympic Peninsula is a special place with clear air and clean
water, and lots of open access to public lands. Mike will work hard
to keep it that way. He believes we need to envision and embrace the
many opportunities for recreation and industry afforded to us by our
natural resources. The Olympic Peninsula, as a carbon bank and prime
tree habitat, stands to benefit as we work to establish a state
carbon policy that will make our area a cutting edge leader in
reducing the harmful effects of climate change. Mike knows this will
also work to revive and grow our natural resource based economy.

A four term Clallam County Commissioner with previous service as a
local law enforcement officer and US Customs Inspector, including
apprehending terrorist Ahmed Ressam, Mike Chapman has the right
qualities and experience to represent the communities of Clallam,
Jefferson, and Grays Harbor counties. Mike and his wife of 27 years,
Bobbi, reside in Port Angeles. They have 2 sons Larsson a sophomore in
college and Anders a HS senior. Mike holds a AAS from Shoreline
College, a BA from Northwest College and a Master's Degree from

Duquesne University.


Speaking about Vets!
Both Commission candidates gave their views on fixing the old fire hall complex pictured here for a possible new vet center. As you recall Maggie, Roth husband Terry Roth wanted to convert the old fire hall into a new vet center. As you recall nothing came of the project because of the lack of funds.
I brought up the question of a new vet center because it was Roth's dream of having a vet center close to the memorial park for vets that sits right next to this building.

HINT: She still hopes to fulfill Terry's dream of converting the property to a vet center, cultural historical center....But, like her opponent the main issue is providing the best services for the vets.

Richard said there are larger issues then new vet centers that needs to be addressed, like finding jobs for disabled vets, and other vets. Both candidates agreed that the larger issues of providing vets job opportunities and benefits are imperative. Both candidates mention the current Vet center next to the YMCA, and the improvements which were made to it, like for example more accessible to disabled vets.


Yes readers I got the two contenders to sit side by side for a little chat!

The second question I asked was about the Carlsborg Sewer project. Both Richards, and Roth stated that the opportunity funds should be used for the project, provided if there is anything left of the fund, which the County Treasurer will go over during the meeting on Thursday at 9AM
